Justice P.BHAVADASAN\n\n Dated :08\/04\/2010\n\n O R D E R\n<\/pre>\n<p>                         P.BHAVADASAN, J.\n<\/p>\n<p>                   &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                     WP(C) No.12374 of 2010\n<\/p>\n<p>                   &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                       Dated 8th April 2010<\/p>\n<p>                              Judgment<\/p>\n<p>           In this Writ Petition filed under Article 227 of the<\/p>\n<p>Constitution of India, the relief sought for by the petitioner<\/p>\n<p>is as follows :\n<\/p>\n<blockquote><p>                  &#8220;Direct the learned 2nd Additional Subordinate Judge,<\/p>\n<p>           Kozhikode to record the settlement arrived at between the<\/p>\n<p>           parties in the suit OS 222\/1996 as evidenced by Exts.P6<\/p>\n<p>           and P7 and to dispose of the suit OS No.222\/1996 as<\/p>\n<p>           expeditiously as possible, recording the settlement, without<\/p>\n<p>           insisting the presence of the 1st respondent in the Court.&#8221;<\/p><\/blockquote>\n<p>           2. The petitioner, as plaintiff, instituted two suits,<\/p>\n<p>as OS Nos.222\/1996 and 395\/1994 before the Sub Court,<\/p>\n<p>Kozhikode. The respondents herein were the defendants in<\/p>\n<p>the suits.   OS No.222\/1996 was filed for dissolution of<\/p>\n<p>partnership firm, accounting and injunction and OS<\/p>\n<p>No.395\/1994 was filed praying for a declaration that the<\/p>\n<p>expulsion of the petitioner from the partnership firm is<\/p>\n<p>invalid and unenforceable as against the petitioner. Both<\/p>\n<p><span class=\"hidden_text\">WPC 12374\/10                     2<\/span><\/p>\n<p>the suits were decreed by the Court below as per<\/p>\n<p>Judgment dated 31.10.1997, a copy of which is produced<\/p>\n<p>as Ext.P1. The court below decreed OS No.222\/1996 and<\/p>\n<p>a preliminary decree was passed dissolving the firm with<\/p>\n<p>effect from 15.02.1996.     Various other details are also<\/p>\n<p>given in the Petition, which are not relevant for the present<\/p>\n<p>purpose. It appears that when the final decree application<\/p>\n<p>was pending, the parties decided to settle their disputes<\/p>\n<p>and entered into a compromise memorandum. Accordingly,<\/p>\n<p>such a compromise was entered into and it was signed by<\/p>\n<p>the parties to the suit.    While so, it appears that the<\/p>\n<p>petitioner filed IA No.695\/10 for advancing the hearing and<\/p>\n<p>the second respondent filed a statement, stating that the<\/p>\n<p>first respondent was incapable to look after his affairs and<\/p>\n<p>also praying that a guardian may be appointed for that<\/p>\n<p>purpose. Copies of the IA and statement are Exts.P2 and<\/p>\n<p>P3.    Later, the second respondent also filed IA No.850\/10<\/p>\n<p>for withdrawing the averments made against the first<\/p>\n<p>respondent in the statement dated 23.09.2009. In IA<\/p>\n<p><span class=\"hidden_text\">WPC 12374\/10                    3<\/span><\/p>\n<p>No.850\/10, the court below directed the first respondent to<\/p>\n<p>appear before the Court on 21.05.2010.         The learned<\/p>\n<p>counsel for the petitioner submitted that since the dispute<\/p>\n<p>between    the   parties  was    already   settled  and    a<\/p>\n<p>memorandum of understanding has been signed by the<\/p>\n<p>parties, and the same was brought to the notice of the<\/p>\n<p>court below, there is no justification for ordering personal<\/p>\n<p>appearance of the first respondent. The learned counsel<\/p>\n<p>also pointed out that throughout the proceedings, the first<\/p>\n<p>respondent&#8217;s counsel had no case that the first respondent<\/p>\n<p>was incapable of looking after his affairs.<\/p>\n<p>           Since the parties have already settled their<\/p>\n<p>disputes, there is no reason why the Court should not<\/p>\n<p>accept the same unless it is found to be not in accordance<\/p>\n<p>with law. Once a compromise is filed, the issue regarding<\/p>\n<p>the capacity of the 1st respondent to look after the affairs,<\/p>\n<p>does not survive. Further, as pointed out by the learned<\/p>\n<p>counsel, the first respondent, throughout the proceedings<\/p>\n<p>had not raised the issue regarding incapability of the first<\/p>\n<p><span class=\"hidden_text\">WPC 12374\/10                     4<\/span><\/p>\n<p>respondent.   It is felt that the order passed by the Court<\/p>\n<p>below cannot be sustained. Accordingly, this Petition is<\/p>\n<p>allowed.
