Zabed Hussain\n                                    Versus\n                               The State of Bihar\n                                   -----------\n<\/pre>\n<p>03\/-   28\/07\/2011                  Heard learned counsel for the petitioner, learned counsel<\/p>\n<p>                     for the complainant and learned Additional Public Prosecutor for the<\/p>\n<p>                     State.\n<\/p>\n<p>                                   Petitioner is named accused in this complaint case being<\/p>\n<p>                     husband of the complainant with allegation of demand of dowry,<\/p>\n<p>                     torture etc. It is also pointed out that one case under Section 125 of<\/p>\n<p>                     the Code of Criminal Procedure was also going on between the<\/p>\n<p>                     parties, wherein, Rs. 800\/- per month was ordered to be paid by way<\/p>\n<p>                     of interim maintenance to the complainant by the petitioner.<\/p>\n<p>                     Submission is that, the said amount is being continuously paid to the<\/p>\n<p>                     complainant, but learned counsel for the complainant refuted such<\/p>\n<p>                     submission as regard to payment.\n<\/p>\n<p>                                   Further, submission is that, said case under Section 125<\/p>\n<p>                     of the Code of Criminal Procedure has already been disposed of and a<\/p>\n<p>                     sum of Rs. 3,000\/- per month has been awarded as maintenance to be<\/p>\n<p>                     paid against which petitioner has preferred revision.<\/p>\n<p>                                   Considering the facts and circumstances and nature of<\/p>\n<p>                     allegation, in the event of producing proof of payment of interim<\/p>\n<p>                     maintenance of Rs. 800\/- per month as ordered or in case of non-<\/p>\n<p>                     payment, payment of entire dues at above rate with further<\/p>\n<p>                     undertaking to continue payment of said amount, subject to any order<\/p>\n<p>                     on the point by the competent court, in the event of his<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>            arrest\/surrender before the court below within four weeks, let the<\/p>\n<p>            petitioner, namely, Md. Zabed Hussain, be enlarged on bail on<\/p>\n<p>            furnishing bail bond of Rs. 10,000\/- (ten thousand only) with two<\/p>\n<p>            sureties of the like amount each to the satisfaction of Chief Judicial<\/p>\n<p>            Magistrate, Munger, in connection with Complaint Case No. 958C of<\/p>\n<p>            2009, subject to condition laid down under Section 438 (2) of the<\/p>\n<p>            Criminal Procedure Code with additional condition to remain<\/p>\n<p>            physically present before the court below on each and every date at<\/p>\n<p>            least for two years or till disposal of the case, whichever is earlier, in<\/p>\n<p>            case of failure on two consecutive dates, without giving any<\/p>\n<p>            reasonable explanation, the liberty granted shall be deemed to be<\/p>\n<p>            cancelled.\n<\/p>\n<\/p>\n<pre>Praveen\/-                             ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
