(1) 730\n JT 1992 (1)\t 8\t  1991 SCALE  (2)531\n\n\nACT:\n    Service Law: Civil Services Examination, 1990--Seniority\nof successful candidates--Directions by the Court.\n\n\n\nHEADNOTE:\n    The\t appellant filed an application before\tthe  Central\nAdministrative Tribunal, Patna Bench, for a declaration that\nthe  second proviso to rule 4 of Civil Services\t Examination\nRules  was violative of Articles 14 and 16 of the  Constitu-\ntion of India. By an interim order the Tribunal allowed\t the\nappellant  to appear at the Civil Services  (Main)  Examina-\ntion, 1990, subject to the result of the final orders in the\noriginal  application. The said application was\t transferred\nto this Court.\n    In a bunch of similar cases, the Central  Administrative\nTribunal,  Delhi  upheld  the validity of Rule\t4  of  Civil\nServices  Examination Rules. In appeal to this Court  (Civil\nAppeal\t Nos.  5439-52\/90)**  by  an  interim  order   dated\n7.12.1990, the appellants therein were allowed to appear  in\nCivil  Services (Main) Examination, 1990; and while  finally\ndisposing  of  the appeals, the judgment of CAT,  Delhi\t was\naffirmed.\n    Dismissing\tthe  case of the appellant in  view  of\t the\njudgment in C.As Nos. 5439-52\/90,** this Court,\n    HELD:   The\t appellant  was also entitled  to  the\tsame\nbenefits  as granted to the appellants in Civil Appeals\t No.\n5439-52\/90, namely:\n    (i)\t All  those candidates who appeared  for  the  Civil\nServices (Main) Examination, 1990, pursuant to this  Court's\norder dated 7.12.90 and qualified themselves for the  inter-\nview,  shall be permitted to appear for the  interview\ttest\nand  that if those candidates completely and  satisfactorily\nqualify\t themselves by getting through the written  examina-\ntions as well as the interview shall be given proper alloca-\ntion and appointment on the basis of their rank in the merit\nlist  notwithstanding the restriction imposed by the  second\nproviso to rule 4 and this Court's judgment\n113\nupholding  the\tvalidity of the said proviso since  the\t re-\nspondents have no\/ questioned and challenged the  directions\ngiven by C.A.T. Principal Bench, Delhi in its judgment dated\n20.8.1990.\n    (ii)   The un-challenged directions given by the  C.A.T.\nin   its judgment as well as directions given by this  Court\nin its order dated 7.12.90 were not controlled by any  rider\nin  the sense that the said directions were subject  to\t the\nresult\tof  the cases and hence those  directions  would  be\nconfined  only to those candidates who appeared\t for  C.S.E.\n1990  and  no  further. The seniority  of  those  successful\ncandidates  in\tC.S.E. 1990 would depend on the\t service  to\nwhich  they  have qualified. The seniority of the  left\t out\ncandidates would be maintained in ease they have joined\t the\nservice\t to which they have been allocated on the result  of\nprevious C.S.E. and such candidates will not be subjected to\nsuffer loss of seniority as held by the C.A.T. Rao for the Respond-<br \/>\nents.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n    S.\tRATNAVEL PANDIAN, J. The above case has been  regis-<br \/>\ntered  in pursuance of our order dated 23.11.90 in  Transfer<br \/>\nPetition  (Civil) No.546\/90 transferring O.A.No.191 of\t1990<br \/>\nunder Article 139 (A) of the Constitution of India from\t the<br \/>\nfile  of the Central Administrative Tribunal,  Patna  Bench,<br \/>\nPatna.\tthe  appellant&#8217;s prayer is to dispose of  the  above<br \/>\ncase along with Civil Appeal Nos. 5439-52\/90 (arising out of<br \/>\nSLP (Civil) Nos. 13525-38 of 1990). The relief sought for by<br \/>\nthe appellant before the CAT, Patna Bench was similar to the<br \/>\none  before  the CAT, Principal Bench, Delhi that  being  to<br \/>\ndeclare the second proviso to Rule 4 of C.S.E. as  violative<br \/>\nof  Articles  14  and 16 of the Constitution  of  India.  On<br \/>\n29.8.90 the<br \/>\n<span class=\"hidden_text\">114<\/span><br \/>\nPatna  Bench  in M.P. No. 36\/90 granted\t an  interim  relief<br \/>\nwhich reads thus:\n<\/p>\n<blockquote><p>\t      &#8220;Heard the learned counsel for the  applicant.<br \/>\n\t      The applicant may be allowed to appear at\t the<br \/>\n\t      Civil Services Main Examination, 1990, subject<br \/>\n\t      to result of the final orders in the  original<br \/>\n\t      application.  The\t respondents  are   directed<br \/>\n\t      accordingly.  Copy  be given  to\tthe  parties<br \/>\n\t      today.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>    Mr. Salman Khurshid appearing for the appellant  submit-\n<\/p><\/blockquote>\n<p>ted  that the interim direction given by the Patna Bench  if<br \/>\ncovered by the directions given in paras 5(ii) and 6 of\t the<br \/>\norder of CAT, Delhi he has no further submission to be made,<br \/>\nand the implementation of those directions will satisfy\t his<br \/>\nrelief.\n<\/p>\n<p>    We\tin our order dated 7.12.1990 have clarified  certain<br \/>\ndirections  given  by the CAT, Delhi with reference  to\t the<br \/>\nvarious\t interim orders passed by it in a number of OAs\t and<br \/>\nfinally gave the following direction:\n<\/p>\n<blockquote><p>\t      &#8220;Hence we permit all those candidates  falling<br \/>\n\t      under Para Nos. 5 (ii), 6 and 7 to sit for the<br \/>\n\t      main examination subject to the condition that<br \/>\n\t      each candidate satisfies the Secretary,  Union<br \/>\n\t      public  Service Commission that  he\/she  falls<br \/>\n\t      within these categories and that the concerned<br \/>\n\t      candidates have passed the preliminary  exami-<br \/>\n\t      nation  of 1990 and have also applied for\t the<br \/>\n\t      main  examination\t within the due\t date.\tThis<br \/>\n\t      permission  is only for the  ensuing  examina-<br \/>\n\t      tion., As we are now permitting those who have<br \/>\n\t      passed the preliminary examination of 1990 and<br \/>\n\t      have  applied for the main examination on\t the<br \/>\n\t      basis  of\t the unquestioned  and\tunchallenged<br \/>\n\t      directions given under paras 5(ii), 6 and 7 of<br \/>\n\t      the judgment of the CAT, Principal Bench,\t New<br \/>\n\t      Delhi,  the  same benefit is extended  to\t the<br \/>\n\t      other appellants also who satisfy those condi-<br \/>\n\t      tions  as mentioned under paras 5 (ii), 6\t and\n<\/p><\/blockquote>\n<blockquote><p>\t      7.&#8221;<\/p><\/blockquote>\n<p>    The\t above\tdirection virtually confirms  the  direction<br \/>\ngiven  by  the\tPatna Bench in M.P.  No.36\/90  allowing\t the<br \/>\nappellant therein to sit for C.S.E. (Main) of 1990. However,<br \/>\nwe  have not subjected our direction with any rider  in\t the<br \/>\nsense that that direction will be subjected to the result of<br \/>\nthe  appeals.\tIn fact, we have in  the  judgment  rendered<br \/>\ntoday  in Civil Appeal Nos. 5439-52\/90 and batches  given  a<br \/>\ndirection  to the respondents inclusive of the Union  Public<br \/>\nService\t Commission  that  &#8220;all those  candidates  who\thave<br \/>\nappeared  for the Civil Services (Main)\t Examination,  1990,<br \/>\npursuant to our permission given in the order dated  7.12.90<br \/>\nand who have<br \/>\n<span class=\"hidden_text\">\t 115<\/span><br \/>\ncome  out successfully in the said examination\tand  thereby<br \/>\nhave  qualified themselves for the interview, shall be\tper-<br \/>\nmitted\tto  appear for the interview test and that if  those<br \/>\ncandidates completely and satisfactorily qualify  themselves<br \/>\nby  getting through the written examinations as well as\t the<br \/>\ninterview shah be given proper allocation and appointment on<br \/>\nthe  basis of their rank in the merit  list  notwithstanding<br \/>\nthe  restriction  imposed  by the  second  proviso  and\t our<br \/>\npresent judgment upholding the validity of the said  proviso<br \/>\nsince the respondents have not questioned and challenged the<br \/>\ndirections  given  by CAT, Principal Bench, Delhi  in  para-<br \/>\ngraphs\t5(ii), 6 and 7 of its judgment dated  20.8.1990.  We<br \/>\nwould like to make it clear that the unchallenged directions<br \/>\ngiven by the CAT in its judgment as well as directions given<br \/>\nby  us in our order dated 7.12.90 are not.controlled by\t any<br \/>\nrider in the sense that the said directions were subject  to<br \/>\nthe result of the cases and hence those directions would  be<br \/>\nconfined only to those candidates who appeared for CSE, 1990<br \/>\nand no further. The seniority of those successful candidates<br \/>\nin CSE, 1990 would depend on the service  to which they have<br \/>\nqualified. The seniority of the left-out candidates would be<br \/>\nmaintained  in\tcase they have joined the service  to  which<br \/>\nthey  have been allocated on the result of previous CSE\t and<br \/>\nsuch  candidates  will not be subjected to  suffer  loss  of<br \/>\nseniority as held by the CAT, Delhi in its judgment&#8221;.<br \/>\n    Therefore, we hold that this appellant is also  entitled<br \/>\nfor  the same above benefit.
