3.   28.6.2010.               Five       petitioners,            while     invoking<\/p>\n
                   inherent      jurisdiction         of    this    Court       under<\/p>\n
                   Section       482     of     the        Code     of    Criminal<\/p>\n
                   Procedure, have prayed for quashing of order<\/p>\n
                   dated     29.1.2008         passed       by     Sri    D.     Ram,<\/p>\n
                   Judicial Magistrate, Ist Class, Patna city in<\/p>\n
                   Complaint Case No.660 of 2007. By the said<\/p>\n
                   order, the learned Magistrate, on the basis<\/p>\n
                   of complaint petition, after examination of<\/p>\n
                   complainant         and    four    witnesses,         has    taken<\/p>\n
                   cognizance      of    the    offences          under    Sections<\/p>\n
                   323, 341, 504 and 354 of the Indian Penal<\/p>\n
                   Code    and   summoned       the     petitioners        to   face<\/p>\n
                   trial.\n<\/p>\n
                              Mr. Rama Kant Sharma, learned Senior
\n                     2<\/span><\/p>\n
Counsel       appearing           on        behalf         of      the<\/p>\n
petitioners,        while       pressing           the     petition,<\/p>\n
submits that the present complaint petition<\/p>\n
was       filed          maliciously               against         the<\/p>\n
petitioners, who are resident of Delhi. It<\/p>\n
was argued that opposite party no.2, who was<\/p>\n
wife of Tej Pal, son of petitioner nos.1 and<\/p>\n
2, earlier had filed a criminal case against<\/p>\n
her husband and all the five petitioners vide<\/p>\n
Chowk P.S. Case No.149 of 2007 under Sections<\/p>\n
498A and 307 of the Indian Penal Code. In the<\/p>\n
present       case,         allegation             against         the<\/p>\n
petitioners is that while the petitioners had<\/p>\n
appeared      in    a     court        at     Patna       city    for<\/p>\n
executing bail bonds and they were returning,<\/p>\n
the complainant was abused and assaulted by<\/p>\n
all     the   accused        persons.          Learned          Senior<\/p>\n
Counsel       submits       that        for        quashing        the<\/p>\n
criminal case which was lodged against the<\/p>\n
petitioners        and    husband       of    the        complainant<\/p>\n
two     petitions        were     filed       vide       Cr.     Misc.<\/p>\n
No.52222 of 2007 and Cr. Misc. No.53384 of<\/p>\n
2007 and a Bench of this Court by its order<\/p>\n
dated     19.3.2010         has        quashed       the        entire<\/p>\n
criminal proceeding of Chowk P.S. Case No.149<\/p>\n
of 2007 except the case of husband of the<\/p>\n
complainant        Tejpal       Singh,       who    was     not    the
\n                      3<\/span><\/p>\n
petitioner. On this strength, it was argued<\/p>\n
that even earlier prosecution was malicious<\/p>\n
and due to that reason it was quashed by this<\/p>\n
Court.      Learned      counsel       for   the       petitioners<\/p>\n
has further argued that petitioner nos.1 and<\/p>\n
2 are old persons and they were not in a<\/p>\n
position to indulge in such offence. Learned<\/p>\n
counsel for the petitioners has also referred<\/p>\n
to paragraph-11 of the petition to impress<\/p>\n
upon the court that all the petitioners were<\/p>\n
not in a position to indulge in such offence.<\/p>\n
In    paragraph-11,           it     has   been    stated       that<\/p>\n
petitioner no.4 is Mousi of the complainant<\/p>\n
and    she     was       posted       as     Junior      Judicial<\/p>\n
Assistant in Delhi High Court.\n<\/p>\n
            Mr.    Equbal          Asif      Neyazi,         learned<\/p>\n
counsel appearing on behalf of opposite party<\/p>\n
no.2, submits that even prior to the filing<\/p>\n
of    the     present          complaint       petition,         the<\/p>\n
brother      of   the         complainant      had      filed    an<\/p>\n
Informatory       petition         before    S.H.O.       Sarswati<\/p>\n
Police Station, New Delhi. He further submits<\/p>\n
that there is no point to challenge the order<\/p>\n
of    cognizance         on    the    ground      of    so    called<\/p>\n
malicious prosecution. It was submitted that<\/p>\n
occurrence         was          witnessed          by        several<\/p>\n
independent       witnesses          and,    accordingly,         at
\n                    4<\/span><\/p>\n
the enquiry stage, altogether four witnesses<\/p>\n
were     examined,           who         had     categorically<\/p>\n
supported the case of the complainant. It was<\/p>\n
further argued that at this initial stage,<\/p>\n
this Court may not interfere with the case.<\/p>\n
          Mrs.       Indu      Bala           Pandey,     learned\n\nAdditional       Public      Prosecutor          appearing        on\n\nbehalf    of   the     State       has    also       opposed     the\n\nprayer of the petitioners.\n\n          Besides      hearing       learned         counsel     for\n\nthe    parties,        I    have      also       examined        the\n\n<\/pre>\n
materials available on record. This Court is<\/p>\n
not inclined to interfere with the order of<\/p>\n
cognizance. It is opinion of this Court that<\/p>\n
Code     of    Criminal        Procedure          is     a      self<\/p>\n
contained Code and there is already remedy<\/p>\n
available in the Code to the petitioners and<\/p>\n
as such, at this initial stage of cognizance,<\/p>\n
it is not proper for this Court to interfere<\/p>\n
with the order of cognizance. The order of<\/p>\n
cognizance       was       passed        in    the      month    of<\/p>\n
January,2008.      This Court is of the opinion<\/p>\n
that it is not an exceptional case warranting<\/p>\n
exercise of inherent jurisdiction in favour<\/p>\n
of the petitioners. Accordingly, the petition<\/p>\n
stands rejected.\n<\/p>\n
          It is made clear                that rejection of
\n                           5<\/span><\/p>\n
        the petition will not prejudice either of the<\/p>\n
        parties   since       this    Court   has   rejected    the<\/p>\n
        present petition mainly on the ground                  that<\/p>\n
        there is already remedy available in the Code<\/p>\n
        of Criminal Procedure.\n<\/p>\n
                  In   view          of   rejection    of      this<\/p>\n
        petition, the order of stay dated 19.9.2008
\nMd.S.\n<\/p>\n
        stands automatically vacated.\n<\/p>\n<\/p>\n
