Justice J.M.JAMES\n\n Dated :04\/12\/2006\n\n O R D E R\n                                    J.M.JAMES, J.\n\n                             - - - - - - - - - - - - - - - - - - - -\n\n                        W.P.(C) No.  30213  of   2006 (V)\n\n                             -  - - - -  - - - - - - - - - - - - - - -\n\n                    Dated this the 4th day of December, 2006\n\n\n                                   J U D G M E N T\n<\/pre>\n<p>              Through  Exhibit  P1   order  dated  21\/08\/2006,  the  second<\/p>\n<p>respondent Society was appointed with Administrators, under Rule<\/p>\n<p>35   of   the   Kerala   Co-operative   Societies   Rules,   1969,   in   short   &#8216;the<\/p>\n<p>Rules&#8217;.   It was directed through  Exhibit  P1 that the administrators<\/p>\n<p>of   the   Society   shall   take   steps   to   conduct   an   election   to   the   new<\/p>\n<p>committee, according to Rule 35 of the Rules.\n<\/p>\n<p>              2.      The grievance of the writ petitioner is that, though<\/p>\n<p>the   Administrators   took   over   the   management   of   the   second<\/p>\n<p>respondent   Society,   on   21\/08\/2006   itself,   no  steps  had  been   taken<\/p>\n<p>so   far,   to   proceed   under   Rule   35(1)   of   the   Rules.     Therefore,   it   is<\/p>\n<p>prayed   by   the   writ   petitioner,   who   is   a   member   of   the   second<\/p>\n<p>respondent   Society,   to   direct   respondents   1   to   3   to   conduct   an<\/p>\n<p>election   to   the   managing   committee   of   the   second   respondent<\/p>\n<p>Society,   before   the   expiry   of   six   months   period   as   stipulated   in<\/p>\n<p>Exhibit P1 order dated 21\/08\/2006.\n<\/p>\n<p>W.P.(C) No.30213\/2006 (V)<\/p>\n<p><span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>             3.       After   hearing   both   sides   and   considering   the<\/p>\n<p>submissions made by either side, I dispose of the writ petition with<\/p>\n<p>the following directions:-\n<\/p>\n<blockquote><p>              i.      The Administrators, who have been appointed as<\/p>\n<p>              per  Exhibit  P1   order   dated   21\/08\/2006,   shall   comply<\/p>\n<p>              with the directions contained in Rule 35 of the Rules,<\/p>\n<p>              so   that   a   new   committee   to   the   second   respondent<\/p>\n<p>              Society would be selected.\n<\/p><\/blockquote>\n<blockquote><p>\n              ii.     A resolution, as required under Rule 35(1) shall<\/p>\n<p>              be   passed   before   60   days   in   advance   of   the   date   of<\/p>\n<p>              expiration  of the  term of the  present Administrators,<\/p>\n<p>              and   fix   date,   time   and   place   for   conduct   of   the<\/p>\n<p>              election of the new committee.\n<\/p><\/blockquote>\n<blockquote><p>\n              iii.    A copy of the resolution so passed shall be sent<\/p>\n<p>              to the Registrar by registered post within a week.<\/p>\n<p>              iv.
