    Petitioner challenges Exts.P40 and P41 as evidenced by<\/p>\n
Clause 4 of Ext.P38. The prayers, inter alia, are as follows:<\/p>\n
           “ii. Issue a writ in the nature of certiorari or<\/p>\n
     such other appropriate writ, order or directions<\/p>\n
     quashing Exts.P40 and P41 and the decision<\/p>\n
     evidenced by Clause 4 of Ext.P38.\n<\/p><\/blockquote>\n
           iii) Issue a writ in the nature of mandamus<\/p>\n
     or such other appropriate writ, order or direction<\/p>\n
     commanding the 1st respondent to co-operate for<\/p>\n
     the joint inspection on the basis of Exts.P20, P25<\/p>\n
     etc. and abide by the results of such inspection.<\/p>\n<\/blockquote>\n
           iv) Declare by issuance of appropriate writ,<\/p>\n
     order or direction that the petitioner is not liable<\/p>\n
     to pay any compensation to the 1st respondent on<\/p>\n
     the basis of the agreement between the petitioner<\/p>\n
     and the 2nd respondent.”\n<\/p><\/blockquote>\n
There are further prayers relating to the irrecoverability under<\/p>\n
the Revenue Recovery Act, including without deciding actual<\/p>\n
WPC. 4895\/09 G                  2<\/span><\/p>\n
damage.\n<\/p>\n
      2. Petitioner Company entered into an agreement with the<\/p>\n
second respondent for the laying of pipes in the area covered by<\/p>\n
Phase II and III from Thaikkattukara to different villages of<\/p>\n
Cherthala Taluk. The Project is intended to give drinking water<\/p>\n
to more than six lakhs of people. It is the case of the petitioner<\/p>\n
that digging is to be done by the petitioner by using JCB. The<\/p>\n
first respondent BSNL is alleged to have interfered stating that<\/p>\n
the cables were damaged, meetings were convened and<\/p>\n
decisions were taken. Ext.P2 is a tripartite agreement between<\/p>\n
the petitioner, the BSNL and the Kerala Water Authority.<\/p>\n
Clauses 3 and 4 being relevant, they are extracted below:<\/p>\n
             “3. If local\/OF cable is damaged on course<\/p>\n
        of the work, IVRCL has to settle all the dispute<\/p>\n
        regarding the claim in consultation with BSNL.<\/p>\n
        BSNL will prepare the estimate in consultation<\/p>\n
        with M\/s. IVRCL (BSNL has to ensure the<\/p>\n
        correctness of the estimate before sending it to<\/p>\n
        IVRCL for making (4) payment) and raise demand<\/p>\n
        note as per BSNL HQ instructions for damage vide<\/p>\n

       letters No:110-7\/2002-Regin dated 5th October,<\/p>\n
       2004 and No:110-7\/2002-Regin dated 16-01-2003<\/p>\n
       of Jt. DDG (Regulation-1, BSNL HQ.Delhi (copies<\/p>\n
       attached) to M\/s. IVRCL, if M\/s. IVRCL is not<\/p>\n
       paying the bill within 30 days, KWA JBIC project<\/p>\n
       will pay the amount to BSNL within 30 days by<\/p>\n
       recovering the amount from Running bill at KWA<\/p>\n
       Office, Tvm.”\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
The revenue recovery notices, in short, are raised at the instance<\/p>\n
of the first respondent claiming compensation for the alleged<\/p>\n
damage done by the petitioner. A Counter Affidavit is filed on<\/p>\n
behalf of the first respondent BSNL.\n<\/p>\n
     3. I heard the learned counsel for the petitioner, learned<\/p>\n
standing counsel appearing on behalf of respondents 1 and 2,<\/p>\n
and also the learned Government Pleader. Exts.P37 and P39 are<\/p>\n
the Minutes of the District Collector. Ext.P44 is the Minutes of<\/p>\n
the Meeting held by the Additional Secretary, Water Resources<\/p>\n
Department. In short, it is contended that there may be a joint<\/p>\n
inspection. Of course, according to the learned counsel for the<\/p>\n
WPC. 4895\/09 G                   4<\/span><\/p>\n
first respondent BSNL, as also the Kerala Water Authority, a<\/p>\n
joint inspection was already commenced on 20.9.2008.<\/p>\n
      4. After having heard the parties, I am of the view that<\/p>\n
interest of justice will be subserved, if a joint inspection is<\/p>\n
ordered to be conducted in the presence of the representatives of<\/p>\n
the petitioner, the first respondent and the Water Authority and<\/p>\n
under the watchful eyes of the representative of the District<\/p>\n
Collector, Alappuzha. In this regard, I take note of clause 3 of<\/p>\n
Ext.P2 tripartite agreement which, undoubtedly, contemplates<\/p>\n
the first respondent taking the petitioner into confidence in the<\/p>\n
matter of raising a claim for damage, if any, caused by the<\/p>\n
petitioner. Accordingly, the Writ Petition is disposed of as<\/p>\n
follows:\n<\/p>\n
      A joint inspection will be conducted in regard to the<\/p>\n
various demands of the first respondent in the presence of the<\/p>\n
representatives of the petitioner, the first respondent and also the<\/p>\n
second respondent Water Authority.          The fourth respondent<\/p>\n
District Collector will convene a meeting of the representatives<\/p>\n

of the petitioner, and respondents 1 and 2. No notice need be<\/p>\n
issued to them and in view of the urgency of the matter, the<\/p>\n
representatives as aforesaid will be present in the office of the<\/p>\n
fourth respondent at 11 AM on 10.03.2009.              The fourth<\/p>\n
respondent District Collector will, after deliberations with the<\/p>\n
representatives, fix a schedule of the dates on which the<\/p>\n
inspections in regard to the various demands are to be held.<\/p>\n
The representatives of the petitioner and respondents 1 and 2<\/p>\n
will be present, so that the joint inspection is carried on<\/p>\n
smoothly. The schedule of dates shall be so arranged that the<\/p>\n
joint inspection should be completed within ten weeks from<\/p>\n
10.03.2009. The representative of the fourth respondent will be<\/p>\n
present at the time of all the joint inspections. Should there arise<\/p>\n
any dispute during the carrying out of the joint inspection, the<\/p>\n
representative of the District Collector shall immediately bring it<\/p>\n
to the notice of the fourth respondent and further steps will be<\/p>\n
taken as directed by the fourth respondent. The costs will be<\/p>\n
defrayed by the party who was meeting the costs earlier. I also<\/p>\n

make it clear that the joint inspection which was already<\/p>\n
completed need not be reopened.          The revenue recovery<\/p>\n
proceedings against the petitioner will be kept in abeyance<\/p>\n
unless and until the inspections are completed as directed.<\/p>\n
Provided the second respondent will ensure that there are<\/p>\n
sufficient funds to meet the demands due to the first respondent<\/p>\n
from the petitioner, it will be open to the second respondent to<\/p>\n
release monthly payments.\n<\/p>\n
