Justice S.SIRI JAGAN\n\n Dated :13\/11\/2008\n\n O R D E R\n                         S.SIRI JAGAN, J\n                  ==================\n                   W.P(C)No.25889 of 2008\n                  ==================\n       Dated this the 13th day of November, 2008.\n\n                         J U D G M E N T\n<\/pre>\n<p>    The petitioner filed this writ petition complaining that the<\/p>\n<p>Corporation is encroaching into the property belonging to him<\/p>\n<p>covered by Ext.P1 patta and seeking the following reliefs:<\/p>\n<blockquote><p>           &#8220;i) To issue a writ of mandamus and command the<br \/>\n    respondents 2 to 4 not to do any activities in the property of<br \/>\n    the petitioner, otherwise than in accordance with law.\n<\/p><\/blockquote>\n<blockquote><p>           ii)  To issue a writ of mandamus and command<br \/>\n    respondents 2 to 4 to remove the waste materials and debris<br \/>\n    dumped in to the property of the petitioner.&#8221;\n<\/p><\/blockquote>\n<p>The Secretary of the Corporation has filed a counter affidavit in<\/p>\n<p>paragraph 3 of which it is stated thus:\n<\/p>\n<blockquote><p>           &#8220;3. It is submitted that the Writ Petition itself is not<br \/>\n     maintainable either on law or on facts. The allegations<br \/>\n     raised in the Writ Petition are contrary to the fact of the<br \/>\n     case. The property which is now in question, is a Tsunami<br \/>\n     affected area. In order to protect the banks of kayal, the<br \/>\n     Corporation Council has decided to construct a retaining<br \/>\n     wall in that area and which was approved by the<br \/>\n     Corporation Council.       The Corporation has started<br \/>\n     construction of retaining wall at Konthuruthy Ferry, which<br \/>\n     is the disputed land. The allegation that the respondents<br \/>\n     encroached the property of the petitioner, is false and<br \/>\n     hence denied.      The Corporation has no intention to<br \/>\n     encroach the petitioner&#8217;s property as alleged in the Writ<br \/>\n     Petition.    During the construction time, either the<br \/>\n     petitioner nor any of the neighbouring persons of the<br \/>\n     disputed property, never objected.      It is submitted that<br \/>\n     there is absolutely no reclamation of kayal area lying to the<br \/>\n     eastern side of the property of the petitioner by the<br \/>\n     Corporation. The construction and protection of retaining<br \/>\n     wall is absolutely necessary, since the rear side of the kayal<\/p>\n<p><span class=\"hidden_text\">W.P(C)No.25889 of 2008             &#8211; 2 &#8211;<\/span><\/p>\n<p>      is declared water transport way through which barges to an<br \/>\n      fro from Cochin refinery, fishing boats, private boats etc<br \/>\n      are conducting regular service and this water transport way<br \/>\n      is connecting Chitrapuzha and Cochin port. It is further<br \/>\n      submitted that a project of water supply scheme of HUDCO<br \/>\n      is also lying through the disputed area.&#8221;\n<\/p><\/blockquote>\n<p>In view of the said categoric averment in the counter affidavit<\/p>\n<p>that the Corporation has no intention to encroach into the<\/p>\n<p>petitioner&#8217;s property as alleged in the writ petition, the<\/p>\n<p>petitioner submits that the above statement in the counter<\/p>\n<p>affidavit may be recorded and the writ petition may be closed.<\/p>\n<p>Ordered accordingly.\n<\/p>\n<\/p>\n<p>                                            S.SIRI JAGAN, JUDGE<\/p>\n<p>rhs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.G.
