Mazmudar for the applicant. As the First Appeal is<br \/>\nadmitted,  RULE returnable on 14th September<br \/>\n2010.  The judgement and award dated 30th November 2009<br \/>\npassed by the Honourable Motor Accident Claims Tribunal (Main),<br \/>\nRajkot (&#8216;the Tribunal&#8217; for brevity) in Motor Accident Claim Petition<br \/>\nNo.868 of 2008 is stayed qua the applicant-Insurance Company only on<br \/>\ncondition that the applicant\/ appellant- Insurance Company shall<br \/>\ndeposit the awarded amount before the Tribunal on or before 20th<br \/>\nAugust 2010. Once the amount is deposited, the Tribunal shall;\n<\/p>\n<p>(i) invest the<br \/>\namount in a Cumulative Fixed Deposit Account of any Nationalized Bank<br \/>\nin the name of  respondent\/ claimants initially for a period of three<br \/>\nyears  with periodical renewals till the appeal is<br \/>\nfinally decided by this Court.\n<\/p>\n<p>(ii)\tThough the<br \/>\namount is deposited in the name of the respondent\/ claimants, the<br \/>\nFixed Deposit Receipt shall remain with the Nazir of the Tribunal<br \/>\ntill the appeal is finally decided by this Court.\n<\/p>\n<p>(iii)\tThe<br \/>\nTribunal is directed to pay interest accruing on the Fixed Deposit<br \/>\nevery quarter to the claimants in equal proportion on proper<br \/>\nverification.\n<\/p>\n<p>2.\tIt is<br \/>\nclarified that it will be open for the claimants to file execution<br \/>\napplication against opponent no.1. In the event the claimants are<br \/>\nable to recover the amount from opponent no.1, the aforesaid<br \/>\ndirection of payment of interest will stand cancelled.\n<\/p>\n<p>(RAVI<br \/>\nR.
