APP for Respondent(s) :\n1, \n=============================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>1.\tRule.\n<\/p>\n<p>Mr LB Dabhi learned APP waives service of rule on behalf of the<br \/>\nrespondent-State.\n<\/p>\n<p>2.\tThe<br \/>\npresent application has been preferred by the applicant-convict for<br \/>\nsuspension of sentence and regular bail.\n<\/p>\n<p>3.\tHeard<br \/>\nMr AV Nair learned advocate for the applicant-convict.\n<\/p>\n<p>4.\tBefore<br \/>\n  we proceed to consider the contentions raised by the learned<br \/>\nadvocate for the applicant, the past conduct of the applicant<br \/>\ndeserves to be recorded. At the time, when the appeal was admitted by<br \/>\nthis court on 2.9.2008, the following has been recorded:\n<\/p>\n<p> Learned<br \/>\nadvocate for the appellant does not press the request for releasing<br \/>\nthe appellant on bail during the pendency of Criminal Appeal.  Hence,<br \/>\nthe request stands dismissed as not pressed.\n<\/p>\n<p>5.\tThereafter,<br \/>\nCriminal Misc. Application No. 111\/2009 was preferred for temporary<br \/>\nbail of 30 days on the ground that the mother of the applicant is<br \/>\nsuffering from cardiac failure and the following order was passed by<br \/>\nthis Court on 27.1.2009:\n<\/p>\n<p> Realising<br \/>\nthat the Court is not inclined to entertain the application<br \/>\nconsidering the two different medical certificates produced by the<br \/>\napplicant, learned Advocate for the applicant seeks permission to<br \/>\nwithdraw this application. Permission is granted. The application is<br \/>\nrejected as withdrawn.\n<\/p>\n<p>6.\tAgain<br \/>\nanother application being Criminal Misc. Application No. 3142\/2009<br \/>\nwas also preferred for temporary bail of 60 days by another advocate<br \/>\nand the same was considered on 17.4.2009 by this Court and the<br \/>\nfollowing order was passed:\n<\/p>\n<p> Pursuant<br \/>\nto the order passed by this Court on 20.3.2009, the Commissioner of<br \/>\nPolice, Vadodary City, sent the Fax Message to the Superintendent of<br \/>\nPolice, Madurai Rural, Madurai, seeking information regarding the<br \/>\napplicant. Today,  learned APP has produced report received from the<br \/>\nSuperintendent of Police, Sivagangal, which is taken on record. In<br \/>\nview of the said report, no case is made out to release the applicant<br \/>\non temporary bail. Hence, this application is rejected. Rule<br \/>\ndischarged.\n<\/p>\n<p>7.\tThereafter,<br \/>\nanother application being Criminal Misc. Application No. 12569\/2009<br \/>\nwas also preferred for regular bail by suspension of the sentence and<br \/>\nthe said application was heard on 26.11.2009 and the following order<br \/>\nwas passed:\n<\/p>\n<p> Learned<br \/>\nadvocate Ms. SG Patel appearing for the applicant seeks permission to<br \/>\nwithdraw this application for regular bail on instructions from her<br \/>\nclient. Permission is granted. Petition  is disposed of as<br \/>\nwithdrawn.\n<\/p>\n<p>8.\tIt<br \/>\nappears that, thereafter, once again another application being<br \/>\nCriminal Misc. Application No. 13449\/2009 was preferred by the<br \/>\napplicant for releasing him on temporary bail for a period of six<br \/>\nmonths by  suspension of sentence on the ground of performance of his<br \/>\nmarriage and making preparation of the marriage. The aforesaid<br \/>\napplication came to be considered by this court on 2.12.2009 and the<br \/>\nfollowing order was passed. The relevant paragraphs of which reads as<br \/>\nunder:\n<\/p>\n<p> 4.\tThe<br \/>\nCourt is not able to restrain itself from recording the fact that the<br \/>\npresent application is filed soon after withdrawing the earlier<br \/>\napplication only on 26.11.2009.  Today it is 02.12.2009.  The Court<br \/>\nalso is of the opinion that the prayer made in this application is<br \/>\nnovel and hence, it is reproduced hereunder:-\n<\/p>\n<p> 15.\t[B]\tYour<br \/>\nLordships may be pleased to pass order suspending sentence and<br \/>\nenlarge \/release the applicant on temporary bail for 6 months [six<br \/>\nmonths]  on the ground of performing his marriage and making<br \/>\npreparation for marriage and for going to honey-moon and for being<br \/>\nwith his newly weeded wife sufficiently reasonable time, in<br \/>\nconnection with the order of conviction dated 26.3.2008 passed by<br \/>\nHon&#8217;ble the Additional Sessions Judge, Fast Track Court No.8, Baroda,<br \/>\nin Sessions Case No.70 of 2006, on such terms and conditions as may<br \/>\nbe deemed just and necessary by this Hon&#8217;ble Court.   (emphasis<br \/>\nsupplied).\n<\/p>\n<p>The<br \/>\nCourt has come across such a prayer for the first time.\n<\/p>\n<p>5.\tThe<br \/>\napplicant has produced the relevant part of the judgment and order<br \/>\npassed by the learned Sessions Judge.  Paragraph No.37 of the<br \/>\njudgment records as under:-\n<\/p>\n<p> 37.\tThe<br \/>\naccused caused injuries to the complainant and after committing<br \/>\noffence of loot, he was trying to escape in Maruti.  At that time,<br \/>\npolice employees reached to the scene of offence; they too were<br \/>\nattacked with knife and with revolver.  There was a public firing and<br \/>\ntaking that into consideration along with the loot, under Section 397<br \/>\nof Indian Penal Code, the offence of causing grievous heart and death<br \/>\nwas also attempted and therefore, the Court took the offence in its<br \/>\nright perspective, treating it to be a grave offence and imposed<br \/>\npunishment of 10 years&#8217; R.I., fine of Rs.5,000\/-, in default, 2<br \/>\nyears&#8217; S.I.\n<\/p>\n<p>6.\tLearned<br \/>\nAdditional Public Prosecutor invited attention of the Court to an<br \/>\naffidavit filed by one Talpada Rupalben Shantilal, aged 24 years,<br \/>\nresiding at &#8216;Kuver Nivas&#8217;, Nr.Gujarati Shala, village-Mahudha, Tal.-<br \/>\nMahudha, Dist.-Kheda.  The averments made in one of the paragraphs of<br \/>\nthe affidavit, if not contemptuous, are certainly unwarranted and<br \/>\nvery dis-tasteful casting aspersion even to the learned Sessions<br \/>\nJudge, when it is stated that:-\n<\/p>\n<p> The<br \/>\napplicant   Sevalam Sashi is totally innocent person; only because<br \/>\nhe is from out side Gujarat, the police had impleaded him in false<br \/>\nloot case and the  Hon&#8217;ble Sessions court has also<br \/>\npunished him for 10 years imprisonment.<br \/>\n For last 4 years, I am not able to meet the applicant to my heart&#8217;s<br \/>\nsatisfaction.\n<\/p>\n<p>7.\tTaking<br \/>\ninto consideration the nature of the offence and the gravity, which<br \/>\nis reflected from the contents of paragraph No.37 of the judgment,<br \/>\nthe Court finds no substance in the application.  Hence, the<br \/>\napplication is rejected.  Rule is discharged.\n<\/p>\n<p>\tThe<br \/>\nCourt restrains itself from rejecting the application with costs.\n<\/p>\n<p>9.\tThereafter,<br \/>\nthe present application has been preferred by the applicant-convict<br \/>\nfor suspension  of the sentence for releasing him on temporary bail.<br \/>\nIt is hardly required to be stated that once the application was<br \/>\nconsidered on merits by this court vide order dated 2.12.2009 in<br \/>\nCriminal Misc. Application No. 13449\/2009 referred to hereinabove,<br \/>\nand the Court having found that there is no substance in the<br \/>\napplication even for temporary bail, it would not at all be a case<br \/>\nfor grant of regular bail by suspension of the  sentence.\n<\/p>\n<p>10.\tThe<br \/>\ncontention of the learned for the applicant that the advocate of the<br \/>\napplicant did not remain present at the relevant point of time and<br \/>\nthat observations were made by the Court in the order dated 2.12.2009<br \/>\nwas for temporary bail, even if considered, it would not make out a<br \/>\ncase for suspension of sentence and for releasing the applicant on<br \/>\nregular bail and the reason being that if this Court after<br \/>\nconsidering the merits of the matter has found that there is no case<br \/>\nto release the applicant on temporary bail, such ground would apply<br \/>\nwith more vigore in the matter of regular bail.\n<\/p>\n<p>11.\tIn<br \/>\nthe above view of the matter, we find that the present application is<br \/>\nnothing but a successive bail application. There is no  material<br \/>\nchange in the circumstances which may warrant the review of all the<br \/>\nearlier orders and to release the applicant on regular bail by<br \/>\nsuspension of the sentence. As the ground<br \/>\nof merits are already considered by the Court on earlier occasion<br \/>\nmore particularly in the order dated 2.12.2009, we find it proper not<br \/>\nto reiterate the same.\n<\/p>\n<p>12.\tLearned<br \/>\ncounsel for the applicant by relying upon the averments made in the<br \/>\ngrounds (d), (e), (h) and (I), made an attempt to contend that court<br \/>\nmay consider the case of releasing the applicant on regular bail. We<br \/>\nare afraid such can be considered to up-set the view already taken<br \/>\nby this court  earlier.  Further, even if, the contentions are<br \/>\nconsidered for the sake of examination, the same would not make out a<br \/>\ncase for suspension of the sentence imposed for a grave offence<br \/>\nconsidering the facts and circumstances of the case. The another<br \/>\npertinent aspect is that the applicant is originally resident of<br \/>\nTamil Nadu State, Dist. Madurai and, therefore, if the applicant is<br \/>\nreleased on bail, it may not be possible for this Court also to have<br \/>\na control over the applicant so as to secure his presence and the<br \/>\nsame can be considered as an additional ground for rejecting the<br \/>\nprayer for regular bail.\n<\/p>\n<p>13.\tIn<br \/>\nview of the aforesaid, the application deserves to be rejected and<br \/>\ntherefore, rejected.
