M. SAHAI)<\/a><\/p>\n<p>1.\tWe<br \/>\nhave heard learned counsel Mr. A.K. Vadera  holding brief of Mr. C.N.<br \/>\nTrivedi for the appellants.\n<\/p>\n<p>2.\tThe<br \/>\nrespondent-LIC promoted the appellant No.2 from the post of<br \/>\nAdministrative Officer to the post of Assistant Divisional Manager as<br \/>\nper the promotion list dated 23.4.2009. By order 4.5.2009, issued by<br \/>\nthe respondent-LIC, the appellant No.2 was informed that he has been<br \/>\nposted as a Manager (I.T.) in Gandhinagar Divisional Office and he<br \/>\nwas required to join within a period of seven days.\n<\/p>\n<p>3.\tAppellant<br \/>\nNo.2, on 7.5.2009, wrote a letter to the respondent-LIC, requesting<br \/>\nto change his place of posting from Gandhinagar to Ahmedabad, where<br \/>\nhe was serving as an Administrative Officer, on the ground that he<br \/>\nwas aged 59 years. The competent authority, by order dated 27.5.2009,<br \/>\n advised appellant No.2 to take charge of the new assignment<br \/>\nimmediately, failing which, his promotion would be cancelled.\n<\/p>\n<p>4.\tInstead<br \/>\nof following the advice of the respondent-LIC, appellant No.2 again<br \/>\nwrote a letter dated 30.5.2009 that he is willing to accept the<br \/>\npromotion unconditionally. However, by letter dated 6.6.2009, he<br \/>\nrequested the respondent-LIC to relieve him from the post at<br \/>\nAhmedabad on 17.6.2009 to enable him to take charge of the<br \/>\npromotional post on 18.6.2009.\n<\/p>\n<p>5.\tAppellant<br \/>\nNo.2 was informed by the respondent-LIC that he shall be relieved<br \/>\nafter office hours on 8.6.2009 and thereafter, he has to take charge<br \/>\nof the new assignment, failing which, his promotion would be<br \/>\ncancelled without any further intimation. In spite of the said letter<br \/>\nof the respondent-LIC, appellant No.2 did not join on the promotional<br \/>\npost at Gandhinagar.\n<\/p>\n<p>6.\tThe<br \/>\nrespondent-LIC, by letter dated 11.6.2009,  cancelled the promotion<br \/>\norder of appellant No.2, which was also informed to him by letter<br \/>\ndated 15.6.2009.\n<\/p>\n<p>7.\tAgainst<br \/>\nthe cancellation of the promotion order, appellant No.2 filed an<br \/>\nappeal before the Chairman, also sent legal notice and ultimately<br \/>\nfiled a writ petition before this Court.\n<\/p>\n<p>8.\tLearned<br \/>\nSingle Judge considered the matter and came to the conclusion that<br \/>\nappellant No.2 had failed to resume duty at the place where he was<br \/>\npromoted, within the time prescribed by the office orders and<br \/>\ntherefore, the respondents have cancelled his promotion. Apart from<br \/>\nthe promotion of the appellant No.2, 72 other promotions were also<br \/>\ncancelled.  Therefore, the learned Singe Judge was of the view  that<br \/>\nit is not a case of malafide or victimization by the<br \/>\nrespondent-LIC.\n<\/p>\n<p>9.\tHaving<br \/>\nheard the learned counsel for the appellants, we are of the opinion<br \/>\nthat once appellant No.2 was promoted and time was fixed for joining<br \/>\nat the promotional post, he could not dictate terms to his superior<br \/>\nthat he will join the place of his choice. Though, earlier,<br \/>\nsufficient indulgence was given by the respondent-LIC permitting<br \/>\nappellant No.2 to join on the promotional post,  the appellant kept<br \/>\non insisting that either he be posted at Ahmedabad, where he was<br \/>\nearlier serving as Administrative Officer, or time may be extended<br \/>\nand for the same, he has been making applications from time to time.<br \/>\nSuch attitude of appellant No.2 shows that he has got no regards for<br \/>\nthe orders passed by his superior officers. Appellant No.2 did not<br \/>\njoin the promotional post, for which, only he has to blame himself.<br \/>\nThe learned Single Judge rightly did not interfere with the matter.\n<\/p>\n<p>10.\tThe<br \/>\nlearned counsel for the appellants has placed reliance on para 9 of<br \/>\nthe judgment of the learned Single Judge that, in future, if any<br \/>\npromotional post is available and is vacant and the appellant is<br \/>\nfound eligible, then he shall be considered as per the prevailing<br \/>\npolicy.  This argument is fallacious inasmuch as the appellant has<br \/>\nretired in September 2010.\n<\/p>\n<p>11.\tWe are<br \/>\nin agreement with the view taken by the learned Single Judge.
