Delay Condonation Application No.6342<br \/>\nof 2009<\/p>\n<p>This application has been filed for condoning the delay in filing<br \/>\nthe appeal.\n<\/p>\n<p>For the reasons given in the affidavit filed in support of the delay<br \/>\ncondonation application, the delay in filing the appeal is condoned.\n<\/p>\n<p>Application stands allowed.\n<\/p>\n<p>Order on memo of Special Appeal.\n<\/p>\n<p>Heard learned Standing Counsel for the State and Sri Prakash<br \/>\nPadia, learned Counsel for respondent No.1.\n<\/p>\n<p>The dispute relates to the appointment of respondent No.1 against<br \/>\na short term vacancy which had fallen vacant prior to<br \/>\npromulgation of the Government Order dated 25th of January,<br \/>\n1999. The papers with regard to the selection and appointment of<br \/>\nrespondent No.1 were forwarded to the District Inspector of<br \/>\nSchools for approval, but the same was turned down by order<br \/>\ndated 3rd of November, 2000 on the ground that the Management<br \/>\nhad no authority to proceed to make any selection or appointment<br \/>\nagainst the said vacancy. The order was challenged in a writ<br \/>\npetition and the learned Single Judge has arrived at the conclusion<br \/>\nthat the Management had the authority to make the appointment as<br \/>\nthe appointment was in consonance with the Removal of<br \/>\nDifficulties Order, 1981 and accordingly allowed the writ petition<br \/>\nwhich has given rise to the present appeal.\n<\/p>\n<p>Learned Standing Counsel has proceeded to justify the order<br \/>\nimpugned in the writ petition contending that the Deputy Director<br \/>\nof Education had the authority to proceed to make ad hoc<br \/>\n appointment.\n<\/p>\n<p>In view of the aforesaid facts, the finding of the learned Single<br \/>\nJudge cannot be faulted with inasmuch as it has now been settled<br \/>\nthrough a series of decisions that prior to notification of the<br \/>\nGovernment Order dated 25th of January, 1999, the Committee of<br \/>\nManagement was the competent authority to make ad hoc<br \/>\nappointments against a short term vacancy.\n<\/p>\n<p>In view of the aforesaid reasons, we do not find any error in the<br \/>\njudgment of the learned Single Judge.
