WAGHELA, J.)<\/p>\n<p>1.\tThe<br \/>\npresent appellant, an Institution of  local self Government, has<br \/>\ninvoked   Clause 15 of the Letters Patent  for  challenging  the<br \/>\ncommon judgment  dated  2.4.2003 of the learned Single  Judge,<br \/>\nwhereby the petitions  of the appellant  were dismissed  after<br \/>\nelaborately dealing  with the contentions  raised  on behalf of the<br \/>\nappellant.  It is noted  in the impugned judgment  that  the<br \/>\npetitioner- Municipality  had not produced any evidence,  either<br \/>\ndocumentary  or  oral,  giving  details  as to for how many days,<br \/>\nworkman  concerned had  worked  during  his  period of service.<br \/>\nThere was  evidence   before the  Labour  Court to show  that  each<br \/>\nworkman  concerned  had  continuously  worked  for more  than one<br \/>\nyear  and  their  services  were  admittedly  terminated  orally  and<br \/>\nwithout  following any procedure prescribed under the  provisions of<br \/>\nthe  Industrial  Disputes Act, 1947. It was argued  before the<br \/>\nlearned  Single  Judge  by learned  counsel for the appellant  that<br \/>\nthere was  mere  technical breach  of  the provisions of  Section 25F<br \/>\n of  the Industrial Disputes  Act  and  the appellant, being a<br \/>\nstatutory  and  public  body,  should not be made  to suffer<br \/>\nfinancial  burden  by way of idle wages  in the form  of  back wages.<br \/>\n It  was admitted that there was  some  lapse  on the part of the<br \/>\nappellant Municipality in not leading proper  evidence. In those<br \/>\nfacts, learned  Single Judge  did not  find any  jurisdictional<br \/>\nerror  or  infirmity  in the impugned  award  of the Labour Court as,<br \/>\nobviously, the extraordinary  writ  jurisdiction  of the  Court under<br \/>\nArticles 226 or 227 of the Constitution could not be exercised in<br \/>\nfavour of the appellant.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel Mr. Sanchela, appearing for the appellant,  submitted that<br \/>\nthe workmen concerned had, after  the impugned award made in the year<br \/>\n1999,  filed  recovery applications  and, now, the appellant was<br \/>\nrequired to pay  huge sums of  back wages, which  it was not in a<br \/>\nfinancial position to pay  and, therefore, the appellant was<br \/>\nconstrained to prefer the present appeals.\n<\/p>\n<p>3.\tWe<br \/>\n have  to take  serious  note  of  ironical situation  in which the<br \/>\nappellant did not care to comply  with the mandatory provisions of<br \/>\nlaw while terminating the services of the workmen  concerned  and<br \/>\nthen  did not care  to  present  its  case  properly before the<br \/>\nLabour  Court, but  has continued  the litigation  for almost a<br \/>\ndecade, which could not be carried  on  without spending  public<br \/>\nmoney  at the disposal of the appellant  and, now,  the litigation is<br \/>\nsought to be carried further  in the same way without any valid<br \/>\nground  worth the name,  in the name  of  not having  sufficient<br \/>\nfunds  and  for  saving  public money.  We  can  only look  down upon<br \/>\nsuch litigation   because it is at the cost of  not  only  the  tax<br \/>\npayers of the town concerned  but at the cost of the public  time of<br \/>\nthe Court which  could be devoted to  other  genuine litigants who<br \/>\nmight  be  waiting for  decades  for  redressal of their genuine<br \/>\ngrievances. Under the circumstances,  we  summarily  dismiss  these<br \/>\nappeals  with  cost quantified at Rs.1,500\/- (Rupees  One  Thousand<br \/>\nFive hundred)  in each  appeal, which shall be paid  by the<br \/>\nappellant  to  the Gujarat State Legal Service  Authority, Ahmedabad,<br \/>\n within 15  days.\n<\/p>\n<p> ORDER<br \/>\nIN THE CIVIL APPLICATIONS:\n<\/p>\n<p>\tIn<br \/>\nview of the order  passed in the Letters Patent Appeals,  the civil<br \/>\napplications do not survive  and  accordingly  disposed.\n<\/p>\n<p>(BHAGWATI<br \/>\nPRASAD, J.)
