Justice M.SASIDHARAN NAMBIAR\n\n Dated :31\/05\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n\n            ---------------------------------------------\n             CRL.R.P.NO.1346 OF 2003\n            ---------------------------------------------\n                Dated 31st           May, 2010\n\n\n                           O R D E R\n<\/pre>\n<p>               Petitioner,                  the          accused   in<\/p>\n<p>C.C.185\/1996 on the file of Additional Chief<\/p>\n<p>Judicial Magistrate, Thalassery was convicted<\/p>\n<p>and sentenced to simple imprisonment for six<\/p>\n<p>months  and  a     fine         of      Rs.25,000\/-           and  in<\/p>\n<p>default simple imprisonment for six months for<\/p>\n<p>the offence under Section 55(a) of Abkari Act.<\/p>\n<p>Petitioner  challenged                the         conviction      and<\/p>\n<p>sentence before Sessions court, Thalassery in<\/p>\n<p>Crl.A.339\/1998.      Learned            Additional           Sessions<\/p>\n<p>Judge  on  re-appreciation                    of      the    evidence<\/p>\n<p>confirmed  the     conviction               and        sentence   and<\/p>\n<p>dismissed the appeal.             It is challenged in the<\/p>\n<p>revision.\n<\/p>\n<p>       2.     Learned               counsel appearing for<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>the       petitioner and learned Public Prosecutor<\/p>\n<p>were heard.\n<\/p>\n<p>           3. Argument of the learned counsel  is<\/p>\n<p>that though Ext.P3 report of chemical analysis<\/p>\n<p>was relied on by the courts below to find that<\/p>\n<p>petitioner was in possession of illicit arrack,<\/p>\n<p>courts below should not have relied on Ext.P3<\/p>\n<p>in the absence of evidence to prove that the<\/p>\n<p>said certificate was obtained on examination of<\/p>\n<p>the    sample    collected  from  the   contraband<\/p>\n<p>article seized       from the petitioner. It was<\/p>\n<p>pointed     out  that  though  PW1  the  detecting<\/p>\n<p>officer     was  examined, he  did  not  give  any<\/p>\n<p>evidence as to the production of MO.1 can or<\/p>\n<p>the sample in court and there is no evidence to<\/p>\n<p>prove when exactly the sample was produced in<\/p>\n<p>court or when it was forwarded for chemical<\/p>\n<p>analysis and therefore, courts below should not<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>have     convicted   the   petitioner  relying   on<\/p>\n<p>Ext.P3. Learned counsel would argue that even<\/p>\n<p>if   the     property  list  and  forwarding   note<\/p>\n<p>available among the records were     perused, they<\/p>\n<p>will not throw any light on when exactly MO.1<\/p>\n<p>sample      was received in court and was forwarded<\/p>\n<p>and in such circumstances, petitioner is at<\/p>\n<p>least entitled to the benefit of reasonable<\/p>\n<p>doubt.       Learned   counsel further argued that<\/p>\n<p>in any case, conviction      for the offence under<\/p>\n<p>Section 55(a) of Abkari Act will not lie as<\/p>\n<p>there     is  no  allegation  that  petitioner  was<\/p>\n<p>found in possession of illicit arrack in the<\/p>\n<p>course of import or export. Reliance was placed<\/p>\n<p>on the decision of this court in <a href=\"\/doc\/1546232\/\">Surendran v.<\/p>\n<p>Excise Inspector<\/a> (2004 (1) KLT 404) and <a href=\"\/doc\/98247\/\">Mohanan<\/p>\n<p>v. State of Kerala<\/a> (2007 (1) KLT 845).<\/p>\n<p>           4. Learned Public Prosecutor submitted<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                         4<\/span><\/p>\n<p>that neither    before the trial court nor before<\/p>\n<p>the appellate court    the question of production<\/p>\n<p>of MO.1 or the sample or validity of Ext.P3<\/p>\n<p>report      was challenged  and   property   list<\/p>\n<p>accepted by the     learned Magistrate shows that<\/p>\n<p>on 2\/11\/1995 itself MO.1 and the sample were<\/p>\n<p>produced in court and records show that when<\/p>\n<p>the     final   report  was  submitted   it   was<\/p>\n<p>returned , as there is no requisition to send<\/p>\n<p>the sample and the requisition was submitted<\/p>\n<p>before the court on    12\/4\/1996 as seen from the<\/p>\n<p>court seal and in such circumstances, based on<\/p>\n<p>the   lack    of such   evidence  the  conviction<\/p>\n<p>cannot be quashed. Learned Public Prosecutor<\/p>\n<p>pointed out that both the courts have properly<\/p>\n<p>appreciated the evidence and there is no reason<\/p>\n<p>to      interfere  with  the  conviction  or the<\/p>\n<p>sentence.<\/p>\n<pre>\n\nCRRP 1346\/03\n<span class=\"hidden_text\">                          5<\/span>\n\n\n           5. Prosecution    case   is   that   on\n\n1\/11\/1995     at  about  7.45  a.m  while  PW1  the\n\nExcise     Inspector,  Koothuparamba  Excise  Range\n\n<\/pre>\n<p>along with PW2 Excise Guard were on patrol<\/p>\n<p>duty, they found the petitioner standing on the<\/p>\n<p>side of the road holding MO.1 can and getting<\/p>\n<p>suspicious,     petitioner  was   apprehended.  On<\/p>\n<p>opening the can it was found that it contained<\/p>\n<p>about four liters of illicit arrack ascertained<\/p>\n<p>by    its    smell   and  taste.   Petitioner   was<\/p>\n<p>arrested.     Mo.1  can  which  contained  illicit<\/p>\n<p>arrack was seized. The sample was taken in a<\/p>\n<p>180 ml. bottle. The sample and MO.1 were sealed<\/p>\n<p>in the presence of the petitioner and Pws.3 and<\/p>\n<p>4 the attesting witnesses. After the sample was<\/p>\n<p>sent    for   chemical   analysis  from  court   on<\/p>\n<p>requisition      submitted.   Ext.P3   report   of<\/p>\n<p>chemical analysis was received on examination<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                         6<\/span><\/p>\n<p>of the sample.\n<\/p>\n<p>           6. Argument of the learned counsel is<\/p>\n<p>that PW1 did not depose that sample taken or<\/p>\n<p>MO.1 can were produced in court and therefore,<\/p>\n<p>there is no evidence. It is      also argued that<\/p>\n<p>property list and the forwarding note were also<\/p>\n<p>not marked and in such circumstances, there is<\/p>\n<p>no evidence when the sample was produced in<\/p>\n<p>court and when it was sent and      and even if,<\/p>\n<p>the     records available, are perused they will<\/p>\n<p>not show when the sample and MO.1 were received<\/p>\n<p>in court and at best, it would show      that it<\/p>\n<p>was sent for chemical analysis in 1996. True,<\/p>\n<p>when    PW1   was examined,  he  did  not  depose<\/p>\n<p>specifically that MO.1 can containing illicit<\/p>\n<p>arrack seized or the sample were produced in<\/p>\n<p>court.      But Ext.P3 was  marked as the report<\/p>\n<p>of chemical analysis,     received on examination<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                         7<\/span><\/p>\n<p>of the sample from the laboratory. Ext.P3 shows<\/p>\n<p>that       the said report was submitted   after<\/p>\n<p>analysis of the sample sent from court, as per<\/p>\n<p>R.P.29\/1995    dated  12\/4\/1996. Though  property<\/p>\n<p>list and forwarding note were marked, I have no<\/p>\n<p>hesitation to hold that those records could be<\/p>\n<p>looked      into, especially when petitioner did<\/p>\n<p>not challenge these aspects before the trial<\/p>\n<p>court or the appellate court. Property list<\/p>\n<p>shows as it was prepared on 1\/11\/1995 by PW1<\/p>\n<p>Excise Inspector on the date of seizure itself.<\/p>\n<p>On    the reverse side of property list    it is<\/p>\n<p>noted     that it  was  received and  entered  as<\/p>\n<p>R.P.29\/1995. Forwarding note accompanying the<\/p>\n<p>property list shows that it was received in<\/p>\n<p>court on 12\/4\/1996. Final report shows that<\/p>\n<p>was submitted before the court on 12\/2\/1996 and<\/p>\n<p>was returned, as there was no requisition for<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                         8<\/span><\/p>\n<p>sending the sample     for chemical analysis. It<\/p>\n<p>further     shows that   final  report  was  re-<\/p>\n<p>submitted on 11\/4\/1996, with the requisition to<\/p>\n<p>send the sample for chemical analysis. Court<\/p>\n<p>seal in the final report shows that it was<\/p>\n<p>received in court on 12\/4\/1996. Requisition to<\/p>\n<p>forward the sample to chemical analysis sent<\/p>\n<p>along with property list shows the court seal<\/p>\n<p>dated 12\/4\/1996. Therefore, it is absolutely<\/p>\n<p>clear that Ext.P3 report was prepared after<\/p>\n<p>examination of the sample which was produced in<\/p>\n<p>court and received as R.P.29\/1995 as per     the<\/p>\n<p>property     list  prepared  on   1\/11\/1995  and<\/p>\n<p>received       in court   on 2\/11\/1995.  It  was<\/p>\n<p>forwarded     on   12\/4\/1996  pursuant   to  the<\/p>\n<p>requisition to forward the sample, as clear<\/p>\n<p>from    Ext.P3  report.  In the  light  of these<\/p>\n<p>materials     and inherent   evidence, I have no<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                          9<\/span><\/p>\n<p>hesitation to hold Ext.P3 report was submitted,<\/p>\n<p>on chemical analysis of the sample produced in<\/p>\n<p>court     by  PW1  after   its seizure  from  the<\/p>\n<p>petitioner on 1\/11\/1995.\n<\/p>\n<p>           7. Though   seizure   was   challenged,<\/p>\n<p>learned Magistrate and learned Sessions Judge<\/p>\n<p>appreciated the evidence of Pws.1 and 2    in the<\/p>\n<p>light     of  Ext.P3  the  contemporaneous  record<\/p>\n<p>prepared and evidence of Pws.3 and 4 show that<\/p>\n<p>though they did not support the prosecution<\/p>\n<p>case in toto, on their evidence the seizure<\/p>\n<p>cannot      be  disbelieved.  Learned   Magistrate<\/p>\n<p>accepted       the    evidence     after    proper<\/p>\n<p>appreciation.     Learned   Sessions  Judge   also<\/p>\n<p>accepted it. I find no reason        to interfere<\/p>\n<p>with    the     appreciation of  evidence  or  the<\/p>\n<p>finding      that  MO.1   was  seized   from   the<\/p>\n<p>petitioner on 1\/11\/1995 and sample was prepared<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                         10<\/span><\/p>\n<p>as   deposed   by  PW1  and  corroborated  by  the<\/p>\n<p>evidence of PW2.\n<\/p>\n<p>           8. Then   the   question  is   whether<\/p>\n<p>identity of the sample produced in court is<\/p>\n<p>established. Ext.P1 seizure mahazar itself show<\/p>\n<p>that    after     sealing  MO.1  and  the  sample<\/p>\n<p>petitioner was asked to     affix his seal and he<\/p>\n<p>declined stating that the        seal affixed is<\/p>\n<p>sufficient. PW1    from the box  re-iterated that<\/p>\n<p>version.     It  was  not   challenged  in  cross<\/p>\n<p>examination.    Therefore,  evidence   establishes<\/p>\n<p>that PW1 has taken sample from MO.1 can seized<\/p>\n<p>in the presence of the petitioner and sealed<\/p>\n<p>it. Ext.P3 report is based on chemical analysis<\/p>\n<p>of the sample so taken. Ext.P2        establishes<\/p>\n<p>that    sample  is   illicit  arrack.   Therefore,<\/p>\n<p>prosecution    has  conclusively  establish   that<\/p>\n<p>petitioner has been in possession of illicit<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                          11<\/span><\/p>\n<p>arrack on 1\/11\/1995.\n<\/p>\n<p>           9. Then the question is what is the<\/p>\n<p>offence      attracted.   Though  petitioner   was<\/p>\n<p>convicted for the      offence under Section 55(a)<\/p>\n<p>of Abkari Act, as held by the Division Bench of<\/p>\n<p>this court in <a href=\"\/doc\/1546232\/\">Surendran v. Excise Inspector<\/a><\/p>\n<p>(2004 (1) KLT 404) and <a href=\"\/doc\/98247\/\">Mohanan v. State of<\/p>\n<p>Kerala<\/a> (2007 (1) KLT 845), conviction for the<\/p>\n<p>offence under Section 55(a) of Abkari Act will<\/p>\n<p>not    lie    as  prosecution  has  no  case  that<\/p>\n<p>petitioner was in possession of the contraband<\/p>\n<p>article, either in the course of import or<\/p>\n<p>export. He could only be convicted for the<\/p>\n<p>offence      under  Section  58  of   Abkari  Act.<\/p>\n<p>Conviction for the offence under Section 55(a)<\/p>\n<p>is therefore, not sustainable. But petitioner<\/p>\n<p>is   to     be convicted  for  the  offence under<\/p>\n<p>Section 58 of Abkari Act.\n<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                          12<\/span><\/p>\n<p>            10.   Then the question is regarding<\/p>\n<p>the    sentence.   As   Section  58   then  stood,<\/p>\n<p>sentence provided was fine which shall not be<\/p>\n<p>less      than   rupees   fifteen   thousand   and<\/p>\n<p>imprisonment for a term which may extend to one<\/p>\n<p>year. Though there was minimum fine of rupees<\/p>\n<p>fifteen thousand provided, there was no minimum<\/p>\n<p>substantive sentence provided. Considering the<\/p>\n<p>fact     that  the   incident  was   in  1995 and<\/p>\n<p>petitioner     was   not   involved  in  any other<\/p>\n<p>abkari offences,      interest of justice will be<\/p>\n<p>met,    if   petitioner  is  sentenced  to  simple<\/p>\n<p>imprisonment for one month and a fine of rupees<\/p>\n<p>fifteen      thousand  and    in   default  simple<\/p>\n<p>imprisonment for one month.\n<\/p>\n<p>           Revision is allowed in part. Conviction<\/p>\n<p>of the petitioner for the offence under Section<\/p>\n<p>55(a) of Abkari Act and sentence awarded are<\/p>\n<p>CRRP 1346\/03<br \/>\n<span class=\"hidden_text\">                         13<\/span><\/p>\n<p>set aside. Petitioner is convicted       for the<\/p>\n<p>offence under Section 58 of Kerala Abkari Act<\/p>\n<p>and sentenced to simple imprisonment for one<\/p>\n<p>month and fine of Rs.15,000\/- (Rupees Fifteen<\/p>\n<p>thousand      only)  and    in   default   simple<\/p>\n<p>imprisonment     for one   month.  Petitioner  is<\/p>\n<p>entitled to get set off, as provided under<\/p>\n<p>Section     428 of  Code  of Criminal  Procedure.<\/p>\n<p>Additional Chief Judicial Magistrate, Thalssery<\/p>\n<p>is directed to execute the sentence.
