and as a resuit thattthedddauto turned turtle and the \ufb01rst<\/p>\n
I-respondeenti\u00bb-.”esustainedvdddddidnjuries and claimed compensation.<\/p>\n
 awarded a sum of i’.1,76,332\/– with<\/p>\n
d”AA\u00b0i;1terest–~..at  from 30 days after the award. Aggrieved<\/p>\n

5. The learned counsel for the appellant — Insurance<\/p>\n
Company contended that, the Commissioner has.:’*e..rredVv in<\/p>\n
taking the loss of earning capacity of the 1st <\/p>\n
40%. He also submitted that, the -.1\u00a7t   ‘ j. <\/p>\n
sustained fracture of right ankle
\nDoctor has exaggerated the
\nCapacity and therefore, was notjusti\ufb01ed in
\ntaking the loss of earning respondent at
\n40%. Further  has occurred
\non 08.01.2008″  has been issued on
\n Corninissioner was not justified
\nin placingvvreitiance I\/1e therefore submitted that<\/p>\n
the impuggned   order cannot be sustained in<\/p>\n
   :against this, the learned counsel for the first<\/p>\n
tV….v.resporitientV_sut):nitted that the Commissioner has rightly<\/p>\n
 the” loss of earning Capacity of the first respondent at<\/p>\n
   therefore, it does not call for any interference. He<\/p>\n
also submitted that the first respondent has suffered in’i_ury to<\/p>\n
his right ankle joint and right wrist and the doctorV”d’eL_p:o’sed<\/p>\n
that the first respondent has suffered peirrrlanel-it”disAahi1i’tf,i_”‘_of V <\/p>\n
40% and therefore, it does not call for”interfere_noev.’._ urther, 9<\/p>\n
he submitted that the Commissionerhfasd. erred. in avirardivngu<\/p>\n
interest at 120\/op.a. from 30 da3r,s””V-after.  the<\/p>\n
Commissioner should have,’  i:nt.erest’Vat “fl\/2% p.a.
\nfrom the date of applicatifon’   of award and
\nthereafter, at    of payment and
\ntherefore, the   order needs to be<\/p>\n
modified.\n<\/p>\n
7. I have  considered the submissions made<\/p>\n
‘1_3;,r. the learned counsel. ,fo__r. V the parties.<\/p>\n
   substantial question of law that arises for<\/p>\n
 o’onsider’ati0.,1_’i <\/p>\n
 .. _’_fWh’ether the Commissioner was justified in<\/p>\n
it ‘~ .,td\u00a7cing the loss of earning capacity of the<\/p>\n
 respondent at 40% and awarding interest at
\n12% p. a. from the 30 days after the award?<\/p>\n
;\/<\/p>\n
9. It is relevant to note, the first respondent has<\/p>\n
sustained injury to his right ankle joint and right<\/p>\n
the doctor has deposed that the first respondenf  <\/p>\n
injuries to his right ankle joint anciwri-ght  hast’? <\/p>\n
resulted in permarlent disability of  of <\/p>\n
capacity is 40%. Therefore, the the<\/p>\n
loss of earning at 40%, which <\/p>\n
10. Th Comn1issio:n’e1*:.hfasVftalkenll’th:e:’.’iAiages of the first
\nrespondent at   respondent has
\ndeposed    of \u20ac14,000\/-p.m. and
\nbatta of ?:’r100\/ is no acceptable evidence.<\/p>\n
Therefore, the”e\ufb01jomniissionefhas taken the wages of the first<\/p>\n
or-es_pondent: ?.l3;50Q_[:v per month which is proper and<\/p>\n
th-erefore,  not call for interference.<\/p>\n
11;. 1E__nsoiar as the interest is concerned, the<\/p>\n
it iifisrrimirssioner has awarded interest at 12\u00b0\/op.a. from 30 days<\/p>\n
