Justice V.GIRI\n\n Dated :25\/03\/2009\n\n O R D E R\n                          V.GIRI, J.\n          -------------------------\n                W.P.(C).No.22849 of 2008\n          -------------------------\n            Dated this the 25th day of March, 2009.\n\n                        JUDGMENT\n<\/pre>\n<p>         The petitioner is working as a sweeper on daily<\/p>\n<p>wages in the 2nd respondent panchayat since 1.2.2001. The<\/p>\n<p>sweeping area serviced by her is in excess of 100 sq.m,<\/p>\n<p>according to her. The petitioner claims that she has been<\/p>\n<p>appointed as Part Time Sweeper, pursuant to the decision<\/p>\n<p>taken by the panchayat on 19.1.2001.<\/p>\n<p>         2. The petitioner claims that the sweeping area<\/p>\n<p>serviced by her is 479.87 sq.m., as evidenced by Ext.P6<\/p>\n<p>report of the Assistant Engineer. The panchayat committee<\/p>\n<p>decided to request the Deputy Director to regularise the<\/p>\n<p>services of the petitioner. The panchayat also sought for<\/p>\n<p>permission to promote the petitioner from the post of Part<\/p>\n<p>Time Sweeper to the post of Full Time sweeper, after<\/p>\n<p>declaring her probation. These requests were rejected under<\/p>\n<p>Exts.P8 and P9. The writ petition has been filed challenging<\/p>\n<p>Exts.P8 and P9.\n<\/p>\n<p>W.P.(C).No.22849 of 2008<\/p>\n<p>                            :: 2 ::\n<\/p>\n<\/p>\n<p>          3.  The petitioner claims the benefit of G.O.(P)<\/p>\n<p>No.501\/05\/Fin dated 25.11.2005 and claims the right to be<\/p>\n<p>regularised on the ground that she has been in service since<\/p>\n<p>1.2.2001, and the sweeping area is in excess of 100 sq.m.,<\/p>\n<p>and that she has been continuously working as a casual<\/p>\n<p>sweeper from the said date.\n<\/p>\n<p>          4.  Learned Government Pleader points out that<\/p>\n<p>G.O.(P)No.501\/05\/Fin essentially applies to cases where<\/p>\n<p>casual sweepers have been engaged on a monthly wage basis<\/p>\n<p>in offices where no posts have been sanctioned as such. In<\/p>\n<p>such cases, subject to the satisfaction of other conditions,<\/p>\n<p>the Government would sanction a post of Part Time Sweeper<\/p>\n<p>and direct regularisation of the incumbent. The present is a<\/p>\n<p>case were, according to the learned Government Pleader,<\/p>\n<p>there was a temporary post of Part Time Sweeper in the<\/p>\n<p>Vechoochira Grama Panchayat, in which case, the panchayat<\/p>\n<p>should have appointed a person from the list sponsored by<\/p>\n<p>the concerned employment exchange. They could not have<\/p>\n<p>appointed the petitioner.\n<\/p>\n<p>W.P.(C).No.22849 of 2008<\/p>\n<p>                            :: 3 ::\n<\/p>\n<\/p>\n<p>          5. The petitioner has been working as Part Time<\/p>\n<p>Sweeper in the panchayat. The panchayat ought not to have<\/p>\n<p>appointed a person against a sanctioned post without<\/p>\n<p>following the procedure for appointment.         But the fact<\/p>\n<p>remains that the petitioner has been working initially on daily<\/p>\n<p>wage basis and thereafter on a consolidated payment of<\/p>\n<p>Rs.600\/- per month. The sweeping area serviced by the<\/p>\n<p>petitioner is 479.87 sq.m, going by the certificate issued by<\/p>\n<p>the Assistant Engineer of the Public Works Department<\/p>\n<p>(Ext.P6).\n<\/p>\n<p>          6. In these circumstances, the Government should<\/p>\n<p>consider the claim of the petitioner, if necessary by relaxing<\/p>\n<p>the rigour of any other conditions contained in G.O.(P)<\/p>\n<p>No.501\/05\/Fin, taking note of the fact that the petitioner has<\/p>\n<p>actually been working with effect from 1.2.2001 and there<\/p>\n<p>was a sanctioned post in the panchayat. Fresh orders shall<\/p>\n<p>be passed on Ext.P10 filed by the petitioner in this regard,<\/p>\n<p>after hearing the petitioner, in the light of the observations<\/p>\n<p>made above, within six months from the date of receipt of a<\/p>\n<p>copy of this judgment.
