JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/03\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\napplication has been filed with a prayer to issue appropriate<br \/>\ndirection to respondents Nos.2 and 3 to immediately release and<br \/>\ndisburse the amount of salary of the applicants from February, 2009<br \/>\nalong with interest at the rate of 18% per annum.\n<\/p>\n<p>2.\tMr.N.V.Solanki,<br \/>\nlearned advocate states that he has received instructions to appear<br \/>\non behalf of respondent No.3 and has already filed his Vakalatnama in<br \/>\nthe Registry.\n<\/p>\n<p>3.\tMs.Kruti<br \/>\nM. Shah, learned advocate for the applicants has submitted that by<br \/>\norder dated 27.10.2010 passed in Special Civil Application<br \/>\nNo.365\/2010 and cognate matters, including Special Civil Application<br \/>\nNo.2096\/2010 filed by the petitioners, directions have been issued to<br \/>\nthe respondents to disburse the amount of salary as early as<br \/>\npossible, but not later than 5.11.2010. It is submitted that the<br \/>\namount of salary, has been released by the Central Government and<br \/>\nforwarded to the State Government. Respondent No.2 has forwarded the<br \/>\namount to respondent No.3 for disbursal. However, respondent No.3 is<br \/>\nnot disbursing the said salary to the applicants in spite of the<br \/>\nclear directions contained in the order of this Court.\n<\/p>\n<p>4.\tMr.Nirag<br \/>\nPathak, learned Assistant Government Pleader for respondents Nos.1<br \/>\nand 2 submits that as the amount towards salary has been disbursed by<br \/>\nrespondent No.2 to respondent No.3, it is for respondent No.3 to do<br \/>\nthe needful.\n<\/p>\n<p>5.\tMr.M.K.Vakharia,<br \/>\nlearned Senior Central Government Standing Counsel for respondents<br \/>\nNos.4 and 5 submits that pursuant to order dated 27.10.2010 of this<br \/>\nCourt, the Central Government has disbursed the amount to be paid as<br \/>\nsalary to the State Government.\n<\/p>\n<p>6.\tMr.N.V.Solanki,<br \/>\nlearned advocate for respondent No.3, states that he has still to<br \/>\nreceive full instructions, but also states that respondent No.3 is<br \/>\nalways ready and willing to obey the orders of the Court.\n<\/p>\n<p>7.\tHaving<br \/>\nheard the learned counsel for the respective parties, and in view of<br \/>\nthe clear directions contained in order dated 27.10.2010 for payment<br \/>\nof salary; and as the amount of salary has already been disbursed by<br \/>\nthe Central Government to the State Government and from the State<br \/>\nGovernment to respondent No.3, no further order is required to be<br \/>\npassed save and except, to direct respondent No.3 to disburse the<br \/>\namount of salary of the applicants to the applicants, forthwith. It<br \/>\nis so directed.
