No.6784 of 2010\n                                 -----------\n<\/pre>\n<p>05.   31.08.2010           I.A. No. 6784 of 2010 is a petition under<\/p>\n<p>                   Section 5 of the Limitation Act, wherein prayer has<\/p>\n<p>                   been made for condoning the delay of four years and<\/p>\n<p>                   five months in filing of this restoration application<\/p>\n<p>                   under instant M.J.C. No. 2192 of 2009. The said<\/p>\n<p>                   restoration application No. 2192 of 2009 has been<\/p>\n<p>                   filed for restoration of F.A. No. 270 of 1973, which<\/p>\n<p>                   stood dismissed by this Court on 27.01.2005, as a<\/p>\n<p>                   result of having been found incompetent due to its&#8217;<\/p>\n<p>                   dismissal against respondent Nos. 11(c ) and 11(a) on<\/p>\n<p>                   account of non-compliance of peremptory order<\/p>\n<p>                   No.106 therein. There has been a delay of four years<\/p>\n<p>                   and five months in the filing of this restoration<\/p>\n<p>                   application under M.J.C. No.2192 of 2009.          For<\/p>\n<p>                   condoning the delay this I.A. No.6784 of 2010 has<\/p>\n<p>                   been filed. As to the grounds as set forth in this I.A.<\/p>\n<p>                   it is mentioned that the petitioner\/appellant had no<\/p>\n<p>                   knowledge about the dismissal of the said F.A. No.<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>270 of 1973 and that after the disposal of the said<\/p>\n<p>F.A. when the respondent took copy of the order and<\/p>\n<p>started disposing of the property of their share, the<\/p>\n<p>petitioner\/appellant    came      to    know      about   the<\/p>\n<p>restoration application and thereafter he came to the<\/p>\n<p>Court, contacted his lawyer and after verifying the<\/p>\n<p>records learnt about the dismissal of the said F.A.<\/p>\n<p>No.270 of 1973 and that thereafter he file the<\/p>\n<p>restoration application.\n<\/p>\n<p>          Learned counsel for the petitioner\/appellant<\/p>\n<p>submits    that   the    petitioner\/appellant       had   no<\/p>\n<p>knowledge of the disposal of F.A. No.270 of 1973<\/p>\n<p>and he could not file the restoration application<\/p>\n<p>within time.\n<\/p>\n<p>          Thus,   from      the        averment     of    the<\/p>\n<p>petitioner\/appellant in the very I.A. itself, it appears<\/p>\n<p>that the petitioner being appellant in the said F.A.<\/p>\n<p>was quite negligent in prosecuting his appeal and that<\/p>\n<p>even the respondents were vigilant so that they<\/p>\n<p>obtained the copy of the dismissal order but the<\/p>\n<p>petitioner being the appellant did not take care of his<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>       appeal. The appellant was also not fully vigilant in<\/p>\n<p>       prosecuting his First Appeal, as a result of which it<\/p>\n<p>       stood dismissed due to non-compliance of the<\/p>\n<p>       peremptory order No.106 therein.        It appears that<\/p>\n<p>       petitioner was also negligent and there appears to be<\/p>\n<p>       a grave laches on his part in filing this restoration<\/p>\n<p>       application and the delay is not being reasonably<\/p>\n<p>       explained. In the result, I do not find any reason to<\/p>\n<p>       allow I.A. No.6784 of 2010; hence, the I.A. is<\/p>\n<p>       dismissed. As a result of the dismissal of the I.A. the<\/p>\n<p>       restoration application under M.J.C. No.2192 of 2009<\/p>\n<p>       also stands dismissed as time barred.<\/p>\n<p>                                   (C.M.
