Appellant and respondents were notified by the<br \/>\nCommission to be present at NIC&#8217;s VC facility at Mumbai. When the<br \/>\nhearing commenced, appellant was found to be absent, while the<br \/>\nrespondents represented by Ms.Jeny John were present. Commission<br \/>\nconducted the hearing from its New Delhi office.\n<\/p>\n<p>2.     Appellant&#8217;s RTI-application dated 04.10.2008 was replied to by<br \/>\nthe CPIO on 21.11.2008 and the Appellate Authority gave his decision in<br \/>\nthe first-appeal on 30.01.2009.\n<\/p>\n<p>3.    As stated in his second-appeal petition, appellant&#8217;s present<br \/>\nappeal is in respect of the following items of queries contained in his<br \/>\nRTI-application:-\n<\/p>\n<blockquote><p>      &#8220;A)   Copies of Internet Notes \/ Papers that must have been<br \/>\n            circulated within UTIAMC with notings \/ Comments thereon<br \/>\n            pertaining to Termination of the plan.\n<\/p><\/blockquote>\n<blockquote><p>       B)   Copy of reference made \/ Letter written to Government of<br \/>\n            India by UTIAMC regarding \/ Seeking approval for<br \/>\n            termination of the plan.\n<\/p><\/blockquote>\n<blockquote><p>       C)   Copy of Letter received by UTIAMC from Government of<br \/>\n            India conveying approval for termination of the SCUP.&#8221;\n<\/p><\/blockquote>\n<p>4.    Respondents had stated in their written and oral submissions<br \/>\nbefore the Commission in regard to the response to the above queries<br \/>\nthat these mostly pertain to copies of certain letters and<br \/>\ncorrespondence which have already been transmitted to the appellant<br \/>\non 08.07.2009 on the basis of the order of the Appellate Authority dated<br \/>\n30.01.2009. It has been further stated on behalf of the respondents<br \/>\nthat that UTI AMC \u23af the third-party who holds information requested<br \/>\nAT-25082009-19.doc<br \/>\n<span class=\"hidden_text\">                                                             Page 1 of 2<\/span><br \/>\n Sl. &#8216;A&#8217; at paragraph 3 above \u23af expressed their inability to part with the<br \/>\ninformation on account of its volume, which according to them, would<br \/>\ninvolve huge processing cost and thereby come within the scope of<br \/>\nSection 7(9) of the RTI Act. As regards items B and C, respondents have<br \/>\ntaken the plea that this information has since been transmitted to the<br \/>\nappellant through their communication dated 08.07.2009 following<br \/>\nAppellate Authority&#8217;s orders.\n<\/p>\n<p>5.     Appellant has also filed a rejoinder dated 22.07.2009 in relation<br \/>\nwith the second-appeal. From the text of the rejoinder, it is seen that<br \/>\nthe points he has highlighted are those mentioned at Sl. &#8216;B&#8217; and &#8216;C&#8217; in<br \/>\nparagraph 3 above. It is seen that the respondents have now stated<br \/>\nbefore the Commission that response to these two queries has been<br \/>\nfurnished to the appellant on 08.07.2009. There is no mention in the<br \/>\nrejoinder or in any of the submission of the appellant, of his receiving<br \/>\nthis response from the respondents. Presumably, CPIO&#8217;s communication<br \/>\ndated 08.07.2009 had not reached the appellant when he filed his<br \/>\nrejoinder dated 22.07.2009.\n<\/p>\n<p>6.     On the basis of appellant&#8217;s rejoinder dated 22.07.2009, I have<br \/>\nconfined the scope of this second-appeal to appellant&#8217;s queries at<br \/>\nSl. &#8216;B&#8217; and &#8216;C&#8217; at paragraph 3 above. As stated by the respondents,<br \/>\nreplies to these queries have already been furnished to the appellant on<br \/>\n08.07.2009. In the absence of the appellant at the hearing, it was not<br \/>\npossible for the Commission to verify whether he received the<br \/>\nrespondents&#8217; reply and, if so, whether he was satisfied with it.\n<\/p>\n<p>7.     In view of the above, I&#8217;m not in a position to interrogate the<br \/>\nrespondents further on behalf of the appellant. Accordingly, the appeal<br \/>\nis directed to be closed.\n<\/p>\n<p>8.
