In pursuance of the said impugned order, the<br \/>\ndetenue is detained in District Jail, Bhavnagar.\n<\/p>\n<p>3.\tFrom<br \/>\nthe grounds of detention, it appears that only one offence being CR<br \/>\nNo.5029 of 2008 under the provisions of Section 66B, 65AE and 116.1B<br \/>\nunder the Bombay Prohibition Act, was registered with Vejalpur Police<br \/>\nStation, wherein a quantity of total 279 bottles of foreign  liquor<br \/>\nwere found from the possession of the detenue. On the basis of<br \/>\nregistration of this case, the detaining authority held that the<br \/>\npresent detenue was carrying on activities of selling liquor which is<br \/>\nharmful to the health of the public. It is held by the detaining<br \/>\nauthority that as the detenue is indulged in illegal activities, it<br \/>\nis required to restrain the detenu from carrying out further illegal<br \/>\nactivities, i.e. selling of liquor. The detaining authority has<br \/>\nplaced reliance on the above registered offences and statements of<br \/>\nunnamed witnesses.  In the opinion of this Court, the activities of<br \/>\nthe detenue can, by no stretch of imagination, be said to be<br \/>\ndisturbing the \u00fdSpublic order.\u00fd\u00fd It is seen from the grounds that a<br \/>\ngeneral statement that has been made by the detaining authority that<br \/>\nconsuming liquor is injurious to health.  In fact, a perusal of the<br \/>\norder passed by the detaining authority shows that the grounds which<br \/>\nare mentioned in the order are in reference to the situation of \u00fdSlaw<br \/>\nand order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.  Therefore, on this ground,<br \/>\nthe subjective satisfaction arrived at by the detaining authority is<br \/>\nvitiated on account of non-application of mind and the impugned<br \/>\norder, therefore, deserves to be quashed and set aside.\n<\/p>\n<p>4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v.<br \/>\nPolice Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having considered<br \/>\nthe decision of the Hon&#8217;ble Apex Court in the case of Ram Manohar<br \/>\nLohia v. State of Bihar (AIR 1966 SC 740), this Court held that<br \/>\nthe cases wherein the detention order passed on the basis of the<br \/>\nstatements of the witnesses falls under the maintenance of \u00fdSlaw and<br \/>\norder\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the \u00fdSpublic  order\u00fd\u00fd<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to \u00fdSpublic order\u00fd\u00fd. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this<br \/>\nSpecial Civil Application is allowed. The<br \/>\nimpugned order of detention dated 7.3.2008 passed by the detaining<br \/>\nauthority is hereby quashed and set aside. The detenue is ordered to<br \/>\nbe set at liberty forthwith, if not required in any other case. Rule<br \/>\nis made absolute accordingly.
