Joshi,<br \/>\n\tlearned advocate appearing for the petitioner and perused the order<br \/>\n\tpassed by the learned Labour Judge and also the documents attached<br \/>\n\talongwith the petition. The reference is of 1989 which is still<br \/>\n\tpending and the application Ex.21 is decided by the learned Labour<br \/>\n\tJudge on 16.12.2009. Even by this time the reference itself could<br \/>\n\thave been disposed off. While deciding the application Ex.21 the<br \/>\n\tlearned Judge has observed that the original applicant i.e.<br \/>\n\tdelinquent has already expired and 20 years have already been<br \/>\n\tpassed. The Manager who has given charge-sheet and the person who<br \/>\n\thas conducted departmental inquiry have also expired. The learned<br \/>\n\tJudge has further observed that the applicant has failed to prove<br \/>\n\tthat the departmental inquiry conducted was improper or illegal.<br \/>\n\tExcept by making allegations no further evidence was led by the<br \/>\n\tpetitioner.\n<\/p>\n<p>\tSince this being an<br \/>\n\tinterim order and main reference is still pending the Court has not<br \/>\n\tgone into the merits of the matter. The Court is of the view that<br \/>\n\tinstead of raising this issue the petitioner should have proceeded<br \/>\n\twith the reference and hence without disturbing the impugned order<br \/>\n\tpassed by the Labour Court, the Court directs the Labour Court to<br \/>\n\tproceed with the main reference and decide it as expeditiously as<br \/>\n\tpossible, preferably within the period of 12 months from the date of<br \/>\n\treceipt of writ or from the date of receipt of certified copy of<br \/>\n\tthis order, whichever is earlier. The Court has not entertained this<br \/>\n\tpetition at this stage would not mean that the reference itself<br \/>\n\tstands concluded against the petitioner. While deciding the main<br \/>\n\treference the learned Labour Judge should take into consideration<br \/>\n\tand decide all the issues raised before him in accordance with law<br \/>\n\tand irrespective of the findings recorded by him in his interim<br \/>\n\torder.\n<\/p>\n<p>\tWith these clarification<br \/>\n\tand observation this petition is accordingly disposed off.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t(K.
