Singh, APP\n                                   -----------\n<\/pre>\n<p>2   14.01.2011                 Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                               Petitioner apprehends his arrest in a case<\/p>\n<p>                 registered for offences punishable under Section 3 of the<\/p>\n<p>                 R.P.U.P. Act.\n<\/p>\n<p>                               It is alleged that huge amount of stolen property<\/p>\n<p>                 belonging to the Railways have been recovered from the<\/p>\n<p>                 petitioner.\n<\/p>\n<p>                               It is submitted on behalf of the petitioner that he<\/p>\n<p>                 has been neither named in the First Information Report nor<\/p>\n<p>                 anything has been recovered from his possession, however,<\/p>\n<p>                 he has been implicated in this case simply on the ground<\/p>\n<p>                 that one of the co-accused has allegedly stated before the<\/p>\n<p>                 Police that they had gone to commit theft of Railways<\/p>\n<p>                 property after they had talked to this petitioner.          It is<\/p>\n<p>                 submitted that it is a far-fetched allegation and obviously is<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>            an afterthought. Learned counsel also submits that since<\/p>\n<p>            nothing has been recovered from the possession of the<\/p>\n<p>            petitioner, the ingredient of Section 3 of the Railways<\/p>\n<p>            R.P.,U.P. Act is not attracted. It is further submitted that all<\/p>\n<p>            the First Information Report named accused persons have<\/p>\n<p>            already been granted regular bail by different orders passed<\/p>\n<p>            in different cases.\n<\/p>\n<p>                       Considering the facts and circumstances of the<\/p>\n<p>            case, in the event of arrest or surrender of the petitioner,<\/p>\n<p>            Pradeep Kumar, within a period of four weeks from today<\/p>\n<p>            in Garhara R.P.F Case No. 13\/08 , he shall be released on<\/p>\n<p>            bail on furnishing bail bond of Rs. 10,000\/-(rupees ten<\/p>\n<p>            thousand) with two sureties of the like amount each to the<\/p>\n<p>            satisfaction of the Railway Judicial Magistrate, Barauni,<\/p>\n<p>            Begusarai, subject to the conditions as laid down under<\/p>\n<p>            section 438(2) of the Code of Criminal Procedure.<\/p>\n<p>                                            (Dr. Ravi Ranjan, J.)<\/p>\n<p>Sanjay-II\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Pradeep Kumar vs The State Of Bihar on 14 January, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
