Justice K.P.BALACHANDRAN\n\n Dated :04\/05\/2007\n\n O R D E R\n                       K.P.BALACHANDRAN, J.\n\n\n                       Crl.M.C.No.1426  of 2007\n\n\n                  Dated this the 4th day of May 2007\n\n\n\n\n                                   O R D E R\n<\/pre>\n<p>       Heard   the   learned   counsel   for   the   petitioner   and   the<\/p>\n<p>learned Director General of Prosecutions.   The grievance that is<\/p>\n<p>highlighted   by   the   learned   counsel   for   the   petitioner   is   that   it<\/p>\n<p>was  believing   the   customs  officials   that  he   will   not   be   liable   to<\/p>\n<p>prosecution   if   he   pays   the   penalty   as   well,   over   and   above<\/p>\n<p>confiscation of the undisclosed gold found in his possession, that<\/p>\n<p>he   paid   the   penalty   as   well,     that,   at   present,   marriage   of   his<\/p>\n<p>daughter is fixed; that the bride groom is from Pune and that the<\/p>\n<p>marriage is to be solemnised on 20\/05\/2007 at Kannur and that<\/p>\n<p>in as much as warrant is pending against him from the court of<\/p>\n<p>learned   Additional   Chief   Judicial   Magistrate   (Economic<\/p>\n<p>Offences),          Ernakulam          in         C.C.No.119\/1988         (presently<\/p>\n<p>L.P.No.25\/05)   the   petitioner   will   not   be   able   to   have   the<\/p>\n<p>marriage of his daughter performed.   The grievance highlighted<\/p>\n<p>by the petitioner is genuine  and is not disputed by the Director<\/p>\n<p>General   of   Prosecution.     Though   prayers   1   and   2   of   Criminal<\/p>\n<p>Miscellaneous Case do not deserve to be allowed,  the petitioner<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.1426  of 2007               2<\/span><\/p>\n<p>is   directed   to   surrender   before   the     learned   Additional   Chief<\/p>\n<p>Judicial   Magistrate   (Economic   Offences),   Ernakulam   positively<\/p>\n<p>on or before 16\/5\/2007.   On such surrender before the   learned<\/p>\n<p>Additional   Chief   Judicial   Magistrate   (Economic   Offences),<\/p>\n<p>Ernakulam, he shall  surrender his passport before  the    learned<\/p>\n<p>Additional   Chief   Judicial   Magistrate   (Economic   Offences),<\/p>\n<p>Ernakulam   and   deposit   by   way   of   cash   security   an   amount   of<\/p>\n<p>Rs.50,000\/-   (Rupees   fifty   thousand   only)   and   execute   bail   bond<\/p>\n<p>for   an   amount   of   Rs.50,000\/-   (Rupees   fifty   thousand   only)   with<\/p>\n<p>two solvent sureties each for the like sums to the satisfaction of<\/p>\n<p>the     Additional   Chief   Judicial   Magistrate   (Economic   Offences),<\/p>\n<p>Ernakulam.     On   the   petitioner   complying   with   the   above<\/p>\n<p>conditions   and   filing   an   affidavit   undertaking   that   he   will   not<\/p>\n<p>leave India without the permission of the trial court till disposal<\/p>\n<p>of   the   case,   the     learned   Additional   Chief   Judicial   Magistrate<\/p>\n<p>(Economic   Offences),   Ernakulam  shall   release   the   petitioner   on<\/p>\n<p>bail.     On  such   release,   the   petitioner  shall   invariably  appear   in<\/p>\n<p>the court below on  all  posting dates of the  case till  its disposal<\/p>\n<p>and any failure  on his part to comply with  the  above directions<\/p>\n<p>shall entail forfeiture of the cash security that may be deposited<\/p>\n<p>by   him   in   the   court   below   and   the     learned   Additional   Chief<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.1426  of 2007            3<\/span><\/p>\n<p>Judicial Magistrate (Economic Offences), Ernakulam shall also be<\/p>\n<p>at liberty to consider the bail as cancelled and to proceed against<\/p>\n<p>the petitioner and his sureties under Section 446 Cr.P.C.<\/p>\n<p>       2.
