REETA CHANDRANA\nAGP for Respondent(s) : 1 -\n3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/10\/2008 \n\n \n\n \n \n\t\t\t\tORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npetition arises out of the proceedings under the Gujarat Agricultural<br \/>\nLand Ceiling Act, 1960 (&#8216;the Act&#8217; for short). The petitioner has<br \/>\nchallenged  orders passed by Mamlatdar &amp; ALT, Deputy Collector<br \/>\nand Gujarat Revenue Tribunal by virtue of which a total of 28 acres<br \/>\n38 gunthas of land of the petitioner is declared as surplus.<br \/>\nMamlatdar &amp; ALT gave sch a finding by his order dated 24.6.1987<br \/>\nwhich came to be upheld by the Deputy Collector by order dated<br \/>\n13.6.1988 and Gujarat Revenue Tribunal by decision dated 4.7.1992.<br \/>\nWith respect to the area of land  and the ceiling limit, there is no<br \/>\ndispute raised by the petitioner. The petitioner however, has raised<br \/>\nfollowing legal contentions:\n<\/p>\n<p>(i)\tLand<br \/>\nadmeasuring 18 acres 37 gunthas was transferred by him in favour of<br \/>\nhis son in the year 1970 and his wife, i.e., mother of his son, as<br \/>\nhis guardian, was looking after the land. It was contended that the<br \/>\nsaid transfer was not hit by the provisions of Sections 7 or 8 of the<br \/>\nAct and the land covered by the said transfer could not have been<br \/>\nclubbed in the holding of the petitioner.\n<\/p>\n<p>(ii)\t\tIt<br \/>\nwas  contended that certain portion of land, though falling within<br \/>\nthe command area of irrigation scheme, was not actually irrigated and<br \/>\nit was so admitted by the Canal Officer in his cross-examination<br \/>\nbefore the Mamlatdar. It was contended that in any case the<br \/>\ncertificates produced on record did not reflect the position of<br \/>\nirrigation as on 1.4.1976.\n<\/p>\n<p>3.\tHaving<br \/>\nheard learned advocate Mr. M.A. Kharadi for the petitioner and<br \/>\nlearned AGP Ms. Reeta Chandrana for the respondents and having<br \/>\nperused the decisions under challenge, I find that admittedly the son<br \/>\nof the petitioner was minor on 1.4.1976. Therefore, even if the<br \/>\nfactum of transfer of land by the petitioner in favour of his son in<br \/>\nthe year 1970 is accepted as a genuine one, provisions of sub-section<br \/>\n(2) of Section 6 of the Act would ensure that the land so transferred<br \/>\n would still have to be clubbed in the holding of the petitioner for<br \/>\nthe purpose of ascertaining his ceiling.\n<\/p>\n<p>4.\tSection<br \/>\n6 (2) of the Act reads as follows:\n<\/p>\n<p>\u00fdS6.Computation<br \/>\nof surplus land-Obligation of the Authorities:-{1} On<br \/>\nconsideration of the scheme contained in Sec.6 of the Act, in the<br \/>\nlight of what is provided in Sec.15, it is clear that the authorities<br \/>\nunder the Act are under obligation for purposes of computation of<br \/>\nsurplus land to decide:-\n<\/p>\n<p>(1)\tin<br \/>\nthe first place the total holding of the land of a person which may<br \/>\ninclude also a joint family;\n<\/p>\n<p>(2)\tif<br \/>\nsuch person is holding land individually as well has a share in the<br \/>\nland of joint family, the authorities must determine the land which<br \/>\nsuch joint family is entitled to hold under Sec.6 and then determine<br \/>\nas to what would be the share of such individual person in the joint<br \/>\nfamily land and then add the area of land equivalent to his share<br \/>\nwith the land held by him individually\u00fd\u00fd.\n<\/p>\n<p>5.\tAn<br \/>\nattempt was however, made to contended that the case of the<br \/>\npetitioner is covered under Section 15 of the Act and since the<br \/>\ntransfer was way back in the year 1970 neither clause (b) nor clause\n<\/p>\n<p>(c) of Section 15 would apply. Section 15 of the Act reads as under:\n<\/p>\n<p>\u00fdS15.\tComputation<br \/>\n\tof surplus land.&#8211; The extent of surplus land, if any, held by<br \/>\n\tany person shall be computed on the basis of the total land held by<br \/>\n\tsuch person;\n<\/p>\n<p>Provided<br \/>\n\tthat the total land so held shall include&#8211;\n<\/p>\n<p>\t(a)<br \/>\nwhere such person holds in addition to the land held by him<br \/>\nindividually as owner or tenant, a share in the land held by a joint<br \/>\nfamily, an area of land equivalent to his share in the land which<br \/>\nsuch joint family, is entitled to hold under Section 6,<\/p>\n<p>(b)\tland,<br \/>\n\t\t\tif any, transferred or sub-divided by or on behalf of such person<br \/>\n\t\t\tin contravention of section 7, and <\/p>\n<p>(c)\tland,<br \/>\n\t\t\tif any, transferred or partitioned by such person after the 15th<br \/>\n\t\t\tday of January, 1959 but before the commencement of this Act or<br \/>\n\t\t\tafter 14th January, 1971 but before the specified date, and in<br \/>\n\t\t\trespect of which no application for a declaration under section 8<br \/>\n\t\t\twas made or any application made under section 8 has been<br \/>\n\t\t\trejected.\u00fd\u00fd<\/p>\n<p>6.\tThough<br \/>\nit is true that by virtue of clause (b) or (c) of Section 15 of the<br \/>\nAct, the land transferred by the petitioner in favour of his son<br \/>\nwould not revert back to him for the purpose of the Act, one cannot<br \/>\nlose sight of the provisions contained in Section 6 (2) of the Act<br \/>\nnoted herein above. In the present case, the land having been<br \/>\ntransferred by the petitioner in favour of his son who was a minor as<br \/>\non 1.4.1976, by virtue of provisions of sub-section (2) of Section 6<br \/>\nof the Act, holding of the minor son would have to be clubbed<br \/>\ntogether in the hands of the petitioner for the purpose of deciding<br \/>\nthe extent of land he had  in excess of ceiling limit.\n<\/p>\n<p>7.\tWith<br \/>\nrespect to the question of land being irrigated or not, Mamlatdar in<br \/>\nhis order dated 24.6.1987, on the basis of the statement made by the<br \/>\nCanal Officer in the cross-examination, accepted the stand of the<br \/>\npetitioner that 14 acres and 14 gunthas of land though falling within<br \/>\nthe command area  cannot be treated as perennially irrigated or<br \/>\nseasonally irrigated. Apparently, Mamlatdar accepted the statement of<br \/>\nCanal Officer that on account of  various difficulties such<br \/>\nland was not being effectively irrigated. Consequently, Mamlatdar<br \/>\ntreated 14 acres and 14 gunthas of land of the petitioner as being<br \/>\nnon-irrigated land. When the stand of the petitioner was wholly<br \/>\naccepted by the Mamlatdar and when such conclusion of the Mamlatdar<br \/>\nwas not disturbed either by  Deputy Collector or by  Gujarat Revenue<br \/>\nTribunal, the petitioner would have no further grievance in this<br \/>\nregard.\n<\/p>\n<p>8.\tIt<br \/>\nis undisputed that rest of the land is taken to be  perennially<br \/>\nirrigated as per the certificate produced by the Government and it<br \/>\nwas not seriously disputed by the petitioner.\n<\/p>\n<p>9.\tUnder<br \/>\nthe circumstances, since no other contentions were raised, I find no<br \/>\nmerit in the petition.\n<\/p>\n<p>10.\t\tIt<br \/>\nwould however, be open for the  petitioners who were pursuing this<br \/>\npetition being heirs of deceased petitioner to indicate to the<br \/>\nauthorities which portion of the land to the extent of excess land<br \/>\nthey wish to surrender to the Government. If they wish to do so, they<br \/>\nmay do it  in writing within four weeks hereof.\n<\/p>\n<p>11.\t\tThe<br \/>\npetition is dismissed. Rule is discharged.
