          Petition is filed under Section<\/p>\n
482 of Code of Criminal Procedure to quash<\/p>\n
the cognizance taken for the offences under<\/p>\n
Sections 184 and 185 of Motor                         Vehicles<\/p>\n
Act, on  Annexure-A2 final report submitted<\/p>\n
by Sub Inspector of Police Udayamperoor<\/p>\n
police station, contending that ingredients<\/p>\n
of the offence under Sections 184 or 185 of<\/p>\n
Motor Vehicles Act are not attracted.<\/p>\n
       2.    Learned             counsel appearing for<\/p>\n
the   petitioner            and           learned       Public<\/p>\n
Prosecutor were heard.\n<\/p>\n
       3. Case           against              petitioner    in<\/p>\n
Annexure-A2   final            report            is   that  on<\/p>\n
23\/12\/2009 at about 6.20 p.m, petitioner<\/p>\n

\n                          2<\/span><\/p>\n
was found driving       the vehicle,    KL-7.Q-<\/p>\n
6220, along     Puthiyakavu-Kareeckadu  road in<\/p>\n
a zig-zag manner     dangerously. It is alleged<\/p>\n
that petitioner was under the influence of<\/p>\n
liquor and     has committed the  offence under<\/p>\n
Sections 184 and 185(a) of M.V.Act.<\/p>\n
           4.   Annexure-A3   certificate    of<\/p>\n
drunkenness issued by Dr.Bejeesh, shows that<\/p>\n
petitioner was examined by the doctor at<\/p>\n
6.55 p.m on the same day, when he was<\/p>\n
produced before the doctor by the police, on<\/p>\n
examination     doctor    found   that   though<\/p>\n
petitioner had     consumed alcohol he was not<\/p>\n
under its influence. As rightly pointed out<\/p>\n
by the learned counsel appearing for the<\/p>\n
petitioner, to attract an offence         under<\/p>\n
Section 185(a) there should be evidence to<\/p>\n
prove      that  petitioner  was   driving   or<\/p>\n

attempting to drive motor vehicle and at<\/p>\n
that time there was alcohol in his blood<\/p>\n
exceeding     30  mg  per  100  ml  of  blood,<\/p>\n
detected     in  a  test  by  breach  analyser.<\/p>\n
Admittedly, no blood test was conducted and<\/p>\n
there is no material to show that when<\/p>\n
petitioner was driving the vehicle, at the<\/p>\n
relevant time, his blood contained alcohol<\/p>\n
in excess of 30 mg       per 100 ml. In such<\/p>\n
circumstances, though he consumed alcohol<\/p>\n
when he was not under the influence of<\/p>\n
liquor,     petitioner cannot be prosecuted for<\/p>\n
the offence under Section 185(a) of M.V.Act.<\/p>\n
Hence, continuation of the prosecution for<\/p>\n
the said offence is only an abuse of process<\/p>\n
of the court.\n<\/p>\n
           5. But  I  cannot  agree  with  the<\/p>\n
submission that offence under Section 184<\/p>\n

of M.V.Act is not attracted. Under Section<\/p>\n
184, whoever drives a motor vehicle at a<\/p>\n
speed or in a manner which is dangerous to<\/p>\n
the public        having regard to    all the<\/p>\n
circumstances     of  the case  including  the<\/p>\n
nature, condition and use of the place where<\/p>\n
the vehicle is driven and the amount of<\/p>\n
traffic which actually is at the time or<\/p>\n
which may reasonably be expected to be in<\/p>\n
the     place     is  punishable as   provided<\/p>\n
therein. When the final report shows that<\/p>\n
petitioner was driving the vehicle in a zig-<\/p>\n
zag manner and that too in a manner likely<\/p>\n
to cause danger to the public, it cannot be<\/p>\n
said that Section 184 is not attracted.<\/p>\n
Hence      prosecution for  the said   offence<\/p>\n
cannot be quashed.\n<\/p>\n
           Petition   is  allowed  in    part.\n\nCrmc 627\/10\n                       5<\/span>\n\n\n<\/pre>\n
Cognizance taken on Annexure-A2 final report<\/p>\n
taken cognizance in S.T.186\/2010 on the file<\/p>\n
of    Additional Chief Judicial  Magistrate,<\/p>\n
Ernakulam, to the extent of the offence<\/p>\n
under Section 185(a) of M.V.Act is quashed.<\/p>\n
But cognizance taken   under Section 184 of<\/p>\n
M.V.Act is valid and the  learned Magistrate<\/p>\n
can proceed with the trial for that offence.<\/p>\n
