Learned AGP Mr. Sharma<br \/>\n\treceived copy of present application and appearing on behalf of<br \/>\n\trespondent no. 2. With consent of both learned advocates,<br \/>\n\tapplication is taken up for final disposal today.\n<\/p>\n<p>Rule.\n<\/p>\n<p>\t Learned AGP Mr. Sharma waives service of notice on behalf of<br \/>\n\trespondent no. 2.  the present application is filed with a prayer to<br \/>\n\tcondone delay of 62 days in filing Misc. civil application for<br \/>\n\tindigent person.  Considering submission made by both learned<br \/>\n\tadvocates and averment made in this application supported with<br \/>\n\taffidavit, delay of 62 days is condoned in interest of justice as<br \/>\n\tsufficient cause is shown by applicant to the satisfaction of this<br \/>\n\tCourt. Accordingly, Rule is made absolute.\n<\/p>\n<p>Registry<br \/>\n\tis directed to register MCA as delay has been condoned by this Court<br \/>\n\ttoday.\n<\/p>\n<p> ORDER<br \/>\n\tIN MISC CIVIL APPLICATION<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Gade requests to this Court to join State of Gujarat,<br \/>\n\tDistrict Collector, Navsari as a party respondent no. 2. Considering<br \/>\n\this request, permission is granted to join State of Gujarat,<br \/>\n\tDistrict Collector, Navsari.  Learned AGP Mr. Sharma received copy<br \/>\n\tof Misc. civil application and appearing on behalf of respondent no.\n<\/p>\n<p>\t2.<\/p>\n<p>Rule.\n<\/p>\n<p>\t Learned AGP Mr. Sharma waives service of notice on behalf of<br \/>\n\trespondent no. 2. With consent of both learned advocates, present<br \/>\n\tapplication is taken up for hearing.\n<\/p>\n<p>The<br \/>\n\tpresent application is filed with a prayer to permit applicant to<br \/>\n\tfile first appeal as indigent person.  The Trial Court has permitted<br \/>\n\tto file civil suit as indigent person.  The property schedule is<br \/>\n\talso attached with present application.  The financial condition of<br \/>\n\tapplicant is not improved thereafter.  Still he is not able to pay<br \/>\n\tcourt fees being a poor person.\n<\/p>\n<p>Considering<br \/>\n\tsubmission made by both learned advocates and averment made in this<br \/>\n\tapplication supported with affidavit, prayer made in this<br \/>\n\tapplication is granted.
