On the<br \/>\nlast hearing i.e. on 13th July 2010, the learned advocate<br \/>\nfor the applicants, in reply to an inquiry as to whether the amount<br \/>\nawarded is deposited or not, sought time to inquire and deposit, if<br \/>\nnot deposited.\n<\/p>\n<p>2.0\tPresent<br \/>\napplication is filed seeking condonation of delay of 82 days caused<br \/>\nin filing the First Appeal against judgment and award dated 17th<br \/>\nFebruary 2009.  It is the case set out in Para 2 that the appellant<br \/>\nDistrict Panchayat learnt about the judgment and award dated 17th<br \/>\nFebruary 2009 only when a Notice issued in Darkhast came to be served<br \/>\nto the District Panchayat on 30th June 2009.  Except bare<br \/>\nwords, there is nothing on record in support of this.\n<\/p>\n<p>3.0\tIt<br \/>\nis a matter of appreciation that after the Notice in Darkhast was<br \/>\nserved to the District Panchayat on 30th June 2009, the<br \/>\nDistrict Panchayat made an application for Certified Copy only after<br \/>\na month i.e. on 28th July 2009.  But then the said<br \/>\nCertified Copy was made ready and made available to the District<br \/>\nPanchayat on the next day i.e. on 29th July 2009.  If the<br \/>\nCourt can act so fast, it is expected that the District Panchayat,<br \/>\nwhen it wants to challenge the judgment and award, must act in a<br \/>\nsimilar fashion.\n<\/p>\n<p>3.1\tIf,<br \/>\nit is the case of the applicant that the learned advocate did not<br \/>\ninform him, either an affidavit of learned advocate or the action<br \/>\ntaken against the learned advocate, are required to be placed on<br \/>\nrecord.\n<\/p>\n<p>3.2\tAt<br \/>\nthis juncture, the learned advocate for the applicants wants some<br \/>\ntime to take instructions in the matter.\n<\/p>\n<p>4.0\tS.\n<\/p>\n<p>O. to 29th July 2010.\n<\/p>\n<p>[<br \/>\nRavi R.
