    This  revision   petition  is   filed  by   the<\/p>\n
petitioners, who are the defendants in O.S.No.<\/p>\n
265\/99 on the file of the Munsiff’s Court, Tirur.<\/p>\n
The suit is stated to be one for eviction of the<\/p>\n
petitioners from their residential house.  The suit<\/p>\n
was decreed ex parte on 21.8.2006.      Petitioners<\/p>\n
filed I.A.No.1765\/06 before the trial court to get<\/p>\n
the  ex  parte  decree  set  aside   and the   said<\/p>\n
application was dismissed by the trial court vide<\/p>\n
order  dated  6.3.2007.  Against  the  said  order,<\/p>\n
petitioners filed C.M.A.No.14\/07 before the Sub<\/p>\n
Court, Tirur and that was dismissed vide judgment<\/p>\n
dated 31.5.2008.  It is assailing the order of the<\/p>\n
trial court on I.A.No.1765\/06 in O.S.No.265\/99 and<\/p>\n
the judgment of the first appellate court in C.M.A.<\/p>\n
No.14\/07 that this revision is filed.<\/p>\n
    2.   Counsel for the respondent also entered<\/p>\n
appearance and submissions of both the counsel were<\/p>\n

heard.\n<\/p>\n
     3. Counsel for the petitioners submitted that<\/p>\n
against the rejection of kukikidappu application<\/p>\n
filed by them, A.A.No.224\/00 was filed before the<\/p>\n
Land Reforms Appellate Authority, Thrissur and that<\/p>\n
was dismissed on 13.3.2006 and against that order,<\/p>\n
a revision was filed before this Court on 26.5.2006<\/p>\n
with c.f.No.3583, but that the said file is missing<\/p>\n
in this Court and that therefore, petitioners could<\/p>\n
not get any relief from that revision. In view of<\/p>\n
the said submission, the office was directed to<\/p>\n
verify and report whether any revision had been<\/p>\n
filed as is submitted.    Office has reported that<\/p>\n
revision in fact was filed on 26.5.2006 against the<\/p>\n
order in A.A.No.224\/00 with filing No.3583, but the<\/p>\n
same was returned as defective on 11.10.2006, vide<\/p>\n
Defect No.10550\/06 of defect register and that on<\/p>\n
verification of the re-presentation register and<\/p>\n
defect register, the same is not seen re-presented<\/p>\n
thereafter. Hence, the grievance that tenancy right<\/p>\n

claimed independently by filing application before<\/p>\n
the Land Tribunal could not be taken up to this<\/p>\n
Court, when it was concurrently dismissed by the<\/p>\n
Land Tribunal as also by the appellate authority is<\/p>\n
not a grievance that can be countenanced and the<\/p>\n
petitioners have to blame themselves.<\/p>\n
     4.    As regards the claim of the petitioners to<\/p>\n
have the ex parte decree set aside also, I do not<\/p>\n
see much merit.    The suit is one of the year 1999.<\/p>\n
The court below has observed that it was on account<\/p>\n
of non co-operation of the petitioners that the<\/p>\n
dismissal of the suit could not be had on merits.<\/p>\n
When the suit was listed in 2002, they remained ex<\/p>\n
parte.     Then also, petition to set aside the ex<\/p>\n
parte     decree was  filed  and  that  was  allowed.<\/p>\n
Again, when the suit was listed in the year 2006,<\/p>\n
the petitioners remained absent and ex parte and<\/p>\n
the suit was again decreed ex parte.       The court<\/p>\n
below has further observed that the petitioners<\/p>\n
were claiming kudikidappu right over the property<\/p>\n

involved in the suit and their prayer for issuance<\/p>\n
of purchase certificate was dismissed by the Land<\/p>\n
Tribunal and the said dismissal was upheld by the<\/p>\n
appellate    authority as  well. It   is the   said<\/p>\n
decision    of  the  appellate authority that   was<\/p>\n
attempted to be assailed before this Court by<\/p>\n
filing a revision. But the revision was defective<\/p>\n
and despite return of the same for curing the<\/p>\n
defects, they have not re-presented the revision.<\/p>\n
When the claim of the petitioners, who were the<\/p>\n
defendants in the suit, which was decreed ex parte,<\/p>\n
was that they are entitled to kudikidappu right and<\/p>\n
are entitled to purchase the same and it is found<\/p>\n
that the said right independently agitated before<\/p>\n
the appropriate forum and the appellate authority<\/p>\n
were dismissed and it is not prosecuted further,<\/p>\n
there     is no merit  in  the contentions  of  the<\/p>\n
petitioners and the very same contentions cannot<\/p>\n
also be agitated afresh in the suit. It is probably<\/p>\n
for that reason that they have abstained from<\/p>\n

contest and are filing petitions to set aside the<\/p>\n
ex parte decree when once the decree is passed ex<\/p>\n
parte.    The evidence adduced on the side of the<\/p>\n
petitioners have been discussed threadbare by the<\/p>\n
trial court in the order dismissing the petition to<\/p>\n
set aside the ex parte decree.     The courts below<\/p>\n
have concurrently considered the matter and found<\/p>\n
that the petition to set aside the ex parte decree<\/p>\n
is ill conceived and is devoid of any merit.   There<\/p>\n
is no reason for this Court to take a different<\/p>\n
view on the facts and circumstances emerging from<\/p>\n
the records available.\n<\/p>\n
     In the result, I dismiss this CRP.\n<\/p>\n
