Justice THOMAS P.JOSEPH\n\n Dated :22\/12\/2010\n\n O R D E R\n                   THOMAS P JOSEPH, J.\n\n                  ----------------------------------------\n\n                     O.P(C).No.1276 of 2010\n\n                   ---------------------------------------\n\n             Dated this 22nd day of December, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>      Petitioner is the respondent in A.S.No.169 of 2010 of the<\/p>\n<p>court of learned Sub Judge, Irinjalakkuda. The husband of<\/p>\n<p>petitioner instituted O.S.No.1088 of 2001 for a decree for recovery<\/p>\n<p>of possession. It is stated, respondent herein made an attempt to<\/p>\n<p>get itself impleaded in the said suit as additional defendant which<\/p>\n<p>was not permitted. Later the trial court passed a decree infavour<\/p>\n<p>of the husband of petitioner.          He expired.       In the course of<\/p>\n<p>execution of the decree, respondent filed a claim petition claiming<\/p>\n<p>right over the property. Claim petition was dismissed against which<\/p>\n<p>respondent filed A.S.No.169 of 2010. Petitioner states that she is a<\/p>\n<p>widow aged about 83 years and that attempt of respondent is<\/p>\n<p>somehow prolong execution of the decree. Petitioner therefore<\/p>\n<p>wants an early disposal of the appeal or the application for stay<\/p>\n<p>(I.A.No.4361 of 2010). Learned counsel requested that learned Sub<\/p>\n<p>Judge may be directed to dispose of the appeal as early as possible.<\/p>\n<p>      2.
