No.6351 of 2011\n                           SUFIA PRAVEEN\n                                Versus\n                         THE STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>02.   25.02.2011                Petitioner being the Mukhiya of the Gram<\/p>\n<p>                   Panchayat is apprehending her arrest in a case<\/p>\n<p>                   registered under Sections 466, 468, 471, 420, 120B of<\/p>\n<p>                   the I.P.C. and Section 7\/13(2) read with Section 13(1)(d)<\/p>\n<p>                   of the Prevention of Corruption Act.\n<\/p>\n<p>                                The     F.I.R.   has   been    instituted   on    a<\/p>\n<p>                   complaint of one unsuccessful candidate for the post of<\/p>\n<p>                   Panchayat Teacher.\n<\/p>\n<p>                                It is submitted by learned counsel for the<\/p>\n<p>                   petitioner that the order of appointment was challenged<\/p>\n<p>                   before the Appellate Tribunal and the Tribunal did not<\/p>\n<p>                   choose to interfere. Subsequently the order of the<\/p>\n<p>                   Appellate Tribunal has been challenged in a writ<\/p>\n<p>                   proceeding.\n<\/p>\n<p>                                Learned     counsel    for    the   Vigilance   has<\/p>\n<p>                   submitted that during enquiry, it has been found that<\/p>\n<p>                   the selected candidate&#8217;s marks has been inflated which<\/p>\n<p>                   prima facie suggests that fraudulent appointment has<\/p>\n<p>                   been done.\n<\/p>\n<p>                                Since    there   is    a   provision   under     the<\/p>\n<p>                   Appointment Rules for making objections and filing the<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>          case before the Tribunal constituted for the said<\/p>\n<p>          purpose and the Tribunal has tested the legality of the<\/p>\n<p>          appointment, let the petitioner namely Sufia Praveen, in<\/p>\n<p>          the event of her arrest or surrender before the Court<\/p>\n<p>          below within a period of 12 weeks from today, be<\/p>\n<p>          released on anticipatory bail on furnishing bail bond of<\/p>\n<p>          Rs. 10,000\/-(ten thousand) with two sureties of the like<\/p>\n<p>          amount each to the satisfaction of Special Judge,<\/p>\n<p>          Vigilance, North Bihar, Muzaffarpur in connection with<\/p>\n<p>          Special Case No. 10 of 2009, Vigilance P.S. Case No. 20<\/p>\n<p>          of 2009.\n<\/p>\n<p>                     Learned   counsel    for   the   Vigilance   is<\/p>\n<p>          permitted to submit the investigation report in the writ<\/p>\n<p>          proceeding.
