Garg, for the petitioner.\n<\/p>\n<p>Ms. Rajlaxmi, Public Prosecutor.\n<\/p>\n<\/p>\n<p>      The accused-petitioner, a member of Schedule Caste, is<\/p>\n<p>convicted by the trial court i.e. the court of Chief Judicial<\/p>\n<p>Magistrate, Chittorgarh for violation of Rajasthan Guest Control<\/p>\n<p>Order, 1978 read with Section 3\/7 of the Essential Commodities<\/p>\n<p>Act. The trial court awarded rigorous imprisonment for a term of<\/p>\n<p>six months with fine of Rs.2000\/- as sentence. The appellate<\/p>\n<p>court affirmed the conviction and sentence by judgment dated<\/p>\n<p>23.5.1994.\n<\/p>\n<\/p>\n<p>      While giving challenge to the orders aforesaid, the only<\/p>\n<p>argument advanced by the learned counsel for the accused-<\/p>\n<p>petitioner   is that admittedly the act of the accused is an<\/p>\n<p>outcome of social evils and therefore, the courts below must<\/p>\n<p>have extended the benefit of probation to him.<\/p>\n<p>      Per contra, the stand of learned Public Prosecutor is that<\/p>\n<p>stringent action are necessary to curb social evils and therefore,<\/p>\n<p>whatever sentence has been awarded by the trial court is<\/p>\n<p>adequate and no interference is required to be made by this<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>Court while exercising power under Section 397 read with<\/p>\n<p>Section 401 Cr.P.C.\n<\/p>\n<\/p>\n<p>     I have examined the orders impugned and record of the<\/p>\n<p>courts below.\n<\/p>\n<\/p>\n<p>     The factual matrix of the case is that on 9.6.1978, the<\/p>\n<p>Enforcement Officer alongwith police-force made a raid in Village<\/p>\n<p>Negadia, Tehsil Dugla, Distt. Chittorgarh whereon he recovered<\/p>\n<p>certain food articles purported to be prepared for organizing<\/p>\n<p>&#8220;death feast&#8221; as a consequent to death of accused&#8217;s father.<\/p>\n<p>Accordingly, a complaint was filed against the accused-petitioner<\/p>\n<p>before the competent court for offences punishable under<\/p>\n<p>Section 3\/7 of the Essential Commodities Act for violation of<\/p>\n<p>provisions of Guest Control Order, 1978.\n<\/p>\n<\/p>\n<p>     During the course of trial, the Enforcement Officer, Police<\/p>\n<p>Personnel and two independent witnesses were examined in<\/p>\n<p>support of prosecution case. The independent witnesses were<\/p>\n<p>declared hostile    and by relying upon the statements given by<\/p>\n<p>the Enforcement Officer and the Police Personnel, the trial court<\/p>\n<p>convicted the accused-petitioner and sentenced for six months&#8217;<\/p>\n<p>rigorous imprisonment with fine of Rs.2000\/-.<\/p>\n<p>     Before the appellate court, the case of the accused-<\/p>\n<p>petitioner was that there was no adequate evidence to held him<\/p>\n<p>guilty for the alleged charge.    It was also contended that the<\/p>\n<p>death feast     is a social evil and there was no intention on the<\/p>\n<p>part of the accused-petitioner to commit any offence. If the<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>prosecution story be accepted as it is then to the act in question<\/p>\n<p>was nothing but observance of a ritual, that become a social evil<\/p>\n<p>by flux of time. The appellate court negativated both the<\/p>\n<p>contentions and rejected the appeal.\n<\/p>\n<\/p>\n<p>      The arguments advanced by the learned counsel for the<\/p>\n<p>accused-petitioner is that now the Ordinance of 1978 has already<\/p>\n<p>been repealed and in totality of the facts it shall not be proper to<\/p>\n<p>remit the petitioner to undergo remaining sentence.<\/p>\n<p>      It is the position admitted that the accused-petitioner is<\/p>\n<p>coming from lower echelons of society, where the social evils are<\/p>\n<p>prevailing in the name of social rituals. True it is, necessary<\/p>\n<p>steps are always desired to curb social evils, but at the same<\/p>\n<p>time it is also required to be kept in mind that the social evils are<\/p>\n<p>not   individual   acts    but   are       outcome    of    prevailing   social<\/p>\n<p>circumstances. The social evils are required to be dealt with<\/p>\n<p>stringently, with an attitude and approach of reforms.<\/p>\n<p>      In the present case, the accused-petitioner was found<\/p>\n<p>guilty for holding &#8216;mratiyu bhoj&#8217; in excess to the number<\/p>\n<p>prescribed under the Order of 1978. Such kind of rituals are<\/p>\n<p>quite common in lower echelons of society. A person makes all<\/p>\n<p>efforts to adhere these rituals and gather satisfaction of<\/p>\n<p>discharging   social      responsibility.     To     curb   such   tendency,<\/p>\n<p>reprimand, censure or the extension of probation are reformative<\/p>\n<p>mode.\n<\/p>\n<\/p>\n<p>      In the case in hand, I do not find any reason for not<br \/>\n<span class=\"hidden_text\">                                        4<\/span><\/p>\n<p>       extending such benefit. Accordingly, while maintaining conviction<\/p>\n<p>       of the petitioner, I consider it appropriate to confine the<\/p>\n<p>       sentence only to the extend of fine of Rs.2000\/-.<\/p>\n<p>            Accordingly, the revision petition is allowed in-part. The<\/p>\n<p>       conviction of the petitioner is maintained.
