In pursuance of<br \/>\nthe said impugned order, the petitioner is detained in jail.\n<\/p>\n<p>\t\tHeard the learned advocate<br \/>\nfor the petitioner and the learned AGP for the respondents.  It is<br \/>\nstated by the learned advocate for the petitioner that the<br \/>\npetitioner-detenu has been acquitted by the trial court.\n<\/p>\n<p>2.\t\tFrom the grounds of<br \/>\ndetention, it appears that one offence being CR.III.No.1060 of 2007<br \/>\nunder sections 66 (1)b and 65(e)  etc.  under the Bombay Prohibition<br \/>\nAct,  was registered with Palsana police station, wherein  Indian<br \/>\nmade foreign liquor was found from the possession of the detenu.<br \/>\nOn the basis of registration of this case, the detaining authority<br \/>\nheld that the present detenu was carrying activities of selling<br \/>\nliquor which is harmful to the health of the public.  It is held by<br \/>\nthe detaining authority that as the detenu is indulged in illegal<br \/>\nactivities, it is required to restrain him from carrying out further<br \/>\nillegal activities i.e. selling of liquor. The detaining authority<br \/>\nhas placed reliance  on  the above registered offence and statements<br \/>\nof  unnamed witnesses.   In the opinion of this court, the activities<br \/>\nof the detenu  can, by no stretch of reasoning, be said to be<br \/>\ndisturbing the public order.   It is seen from the grounds that a<br \/>\ngeneral statement that has been made by the detaining authority that<br \/>\nconsuming liquor is injurious to health.   In fact, a perusal of the<br \/>\norder passed by the detaining authority shows that the grounds which<br \/>\nare mentioned in the order are in reference to the situation of &#8216;law<br \/>\nand order&#8217; and not &#8216;public order&#8217;.  Therefore, on this ground, the<br \/>\nsubjective satisfaction of the detaining authority is vitiated on<br \/>\naccount of non-application of mind and the impugned order, therefore,<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p>3.\t\tExcept two statements of<br \/>\nthe anonymous witnesses, there is no material on record which shows<br \/>\nthat the petitioner-detenu is carrying out illegal activities of<br \/>\nselling  liqour which is harmful to the health of the public.  In the<br \/>\ncase of Ashokbhai Jivraj @ Jivabhai Solanki  v.Police<br \/>\nCommissioner, Surat (2001 (1) GLH 393), having considered the<br \/>\ndecision of the Hon&#8217;ble Apex Court in the case of Ram Manohar<br \/>\nLohia v. State of Bihar (AIR 1966 SC 740), this court held<br \/>\nthat the cases wherein the detention orders are passed on the basis<br \/>\nof the statements of such witnesses fall under the maintenance of<br \/>\n\u00fdSlaw and order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.\n<\/p>\n<p>4.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing  an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the &#8216;public order&#8217; and it<br \/>\nis very clear that  the present case  would not fall within the<br \/>\ncategory of threat to a public order.  In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.  \t\tNo affidavit-in-reply is filed by the learned AGP on behalf<br \/>\nof the respondent-detaining authority controverting the averments<br \/>\nmade in the petition.\n<\/p>\n<p>5.\t\t I am fortified in my view<br \/>\nby the decision taken by this court in the case of <a href=\"\/doc\/662396\/\">Sandip<br \/>\nOmprakash Gupta  v. State of Gujarat<\/a> (2004 (1) GLR 865) that<br \/>\nsolitary incident of violation of prohibition law, normally would not<br \/>\nbe a problem to the maintenance of public order and for such solitary<br \/>\noffence, no person can be detained under the Act.\n<\/p>\n<p>6.\t\tIn the result, this Special<br \/>\nCivil Application is allowed.  The impugned order of detention  dated<br \/>\n 24.11.2007 passed by the District Magistrate, Surat is hereby<br \/>\nquashed and set aside.  The detenu is ordered to be set at liberty<br \/>\nforthwith, if not required in any other case.  Rule is made absolute<br \/>\naccordingly.
