SHAH\n\t\t\n\t\n\n \n\nDate\n: 17\/06\/2011 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy way of this<br \/>\npetition under Article 227 of the Constitution of India, petitioner &#8211;<br \/>\noriginal defendant has prayed for an appropriate order to quash and<br \/>\nset aside the impugned order passed by the learned 6th<br \/>\nAdditional Senior Civil Judge, Jamnagar below Exh.13 in Regular Civil<br \/>\nSuit No.337\/2010 dated 10\/05\/2011 by which the application submitted<br \/>\nby the petitioner &#8211; defendant to recall the earlier order to<br \/>\nappoint the Court Commissioner and to prepare the panchnama of the<br \/>\nsuit property has been rejected.\n<\/p>\n<p>2.\tShri Vivek<br \/>\nMapara, learned advocate appearing for Shri V.H.Kanara,<br \/>\nlearned advocate appearing on behalf of the petitioner has vehemently<br \/>\nsubmitted that as such there was no reason to appoint the Court<br \/>\nCommissioner and to prepare the panchnama.  It is submitted that as<br \/>\nsuch the application has been submitted by the original plaintiff to<br \/>\nprepare the panchnama to create the evidence in his favour and to<br \/>\nestablish the possession, which is not permissible.  It is submitted<br \/>\nthat as such even no reasons were assigned by the learned trial Court<br \/>\nwhile appointing the Court Commissioner to prepare the panchnama.<br \/>\nTherefore, it is requested to admit\/allow the present petition.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned advocate appearing on behalf of the petitioner and<br \/>\nconsidered the impugned order as well as the application submitted by<br \/>\nthe original plaintiff below Exh.5.  It is to be noted that so far as<br \/>\nthe possession in favour of the original plaintiff has been admitted<br \/>\nby the defendant by submitting that he was given the power of<br \/>\nattorney and given the possession for the possession of farming<br \/>\nactivity only.  Thus, the contention on behalf of the petitioner that<br \/>\nthe plaintiff has submitted an application to prepare the panchnama<br \/>\nand appoint Court Commissioner to create the evidence to establish<br \/>\nthe possession cannot be accepted.  As rightly observed by the<br \/>\nlearned trial Court with a view to find out the truth and position of<br \/>\nthe land in question, when the order as to prepare<br \/>\nthe panchnama and appoint Court Commissioner is passed,  the learned<br \/>\ntrial Court has not committed any error and\/or illegality which calls<br \/>\nfor interference of this Court in exercise of powers under Article<br \/>\n227 of the Constitution of India.
