SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/07\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India the petitioner has prayed for an appropriate writ, order or<br \/>\ndirection quashing and setting aside the impugned order dated<br \/>\n16\/03\/2010 passed by the learned revisional authority i.e the Officer<br \/>\non Special Duty and Deputy Secretary (Inquiry) Panchayat, Rural<br \/>\nHousing and Rural Development Department, Sachivalaya, Gandhinagar by<br \/>\nwhich the learned revisional authority has quashed and set aside the<br \/>\norder passed by the District Development Officer, Gandhinagar dated<br \/>\n17\/01\/2007 by which development permission was granted in favour of<br \/>\nthe petitioner.\n<\/p>\n<p>2.\tIt<br \/>\nappears that there is a dispute with respect to the identity of the<br \/>\nplot for which Civil Suit is pending between the parties i.e. Regular<br \/>\nCivil Suit No. 58\/2008 pending in the Court of learned Civil Judge<br \/>\n(Senior Division), Mansa and, therefore, it is submitted by the<br \/>\nlearned advocate appearing on behalf of the petitioner that instead<br \/>\nof cancelling\/quashing and setting aside the development permission<br \/>\ngranted by the District Development Officer dated 17\/01\/2007 the<br \/>\nlearned revisional authority ought to have continued the said order<br \/>\nsubject to the decision that may be taken by the Civil Court in the<br \/>\naforesaid Civil Suit.\n<\/p>\n<p>3.\tShri<br \/>\nMitul Desai, learned advocate appearing on behalf of respondent no. 5<br \/>\nhas stated at the bar that if the aforesaid is considered, in that<br \/>\ncase, the petitioner may take advantage of the order passed by the<br \/>\nDistrict Development Officer dated 17\/01\/2007, and, therefore, it may<br \/>\nbe clarified that the order passed by the District Development<br \/>\nOfficer dated 17\/01\/2007  granting development permission shall be<br \/>\nsubject to the decision that may be taken by the Civil Court and the<br \/>\npetitioner shall not take any advantage and\/or disadvantage of the<br \/>\naforesaid order in the pending suit.  It is also further submitted<br \/>\nthat till then as observed by the learned revisional authority in<br \/>\nparagraph 2, parties may be directed to maintain status-quo as per<br \/>\nthe order passed in Civil Miscellaneous Appeal No. 30\/2009 and\/or the<br \/>\norder that may be passed by the learned appellate Court.\n<\/p>\n<p>4.\tShri<br \/>\nDodia, learned advocate appearing on behalf of the petitioner has no<br \/>\nobjection if the order passed by the District Development Officer,<br \/>\nGandhinagar is modified to the aforesaid extent.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above, the present Special Civil Application is disposed<br \/>\nof and the impugned order passed by the learned<br \/>\n                                         revisional authority dated<br \/>\n16\/03\/2010  is modified to the extent that instead of quashing and<br \/>\nsetting aside the order passed by the District Development Officer<br \/>\ndated 17\/01\/2007 it is directed to continue the order passed by the<br \/>\nDistrict Development Officer dated 17\/01\/2007 granting development<br \/>\npermission in favour of the petitioner, however, the same shall be<br \/>\nsubject to the ultimate outcome of the proceedings pending before the<br \/>\nCivil Court, being Regular Civil Suit No.  58\/2008  and as agreed by<br \/>\nthe learned advocate appearing on behalf of the petitioner,<br \/>\npetitioner shall not take advantage and\/or disadvantage of the<br \/>\naforesaid order passed by the District Development Officer dated<br \/>\n17\/01\/2007 and the aforesaid suit shall be decided and disposed of by<br \/>\nthe learned trial Court on its own merits and on the basis of the<br \/>\nevidence led.  Rest of the order passed by the learned revisional<br \/>\nauthority, more particularly, paragraph 2 of the operative portion of<br \/>\nthe order is not disturbed.\n<\/p>\n<p>6.\tWith<br \/>\nthis, the present Special Civil Application is disposed of.\n<\/p>\n<p>   (M.R.
