No.934 of 2009\n    ------------------------------------------------\n   Dated this the 14th day of September, 2009\n\n                    JUDGMENT\n<\/pre>\n<p>Pius C. Kuriakose, J<\/p>\n<p>     The claimant is in appeal being not satisfied by<\/p>\n<p>the award of the Land Acquisition Reference Court.<\/p>\n<p>The acquisition was for the purpose of Kochi Refineries<\/p>\n<p>Ltd. pursuant to Section 4(1) notification published on<\/p>\n<p>04\/11\/2000.     The    property    was    situated   in<\/p>\n<p>Thiruvaniyoor village. The Land Acquisition Officer<\/p>\n<p>awarded land value at the rate of Rs.34,800\/- per Are.<\/p>\n<p>Ext.A1 was the only tangible item of evidence<\/p>\n<p>produced by the appellant in support of the claim for<\/p>\n<p>enhancement in land value. Ext.A1 was relied on and<\/p>\n<p>proportionate increase was given. Thus, the land value<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.934 of 2009         -2-<\/span><\/p>\n<p>      was re-fixed at Rs.45,818\/- per Are. For the<\/p>\n<p>      structures, the appellant was awarded a total amount<\/p>\n<p>      of Rs.1,30,807\/- by the Land Acquisition Officer. A<\/p>\n<p>      commissioner&#8217;s report was relied on. The court below<\/p>\n<p>      was not very much impressed by the Commissioner&#8217;s<\/p>\n<p>      Report or by the oral evidence adduced by the<\/p>\n<p>      appellant. Thus, no enhancement was granted towards<\/p>\n<p>      value of structures.\n<\/p>\n<\/p>\n<p>             2. We have heard submissions of T.A.Shaji, the<\/p>\n<p>      learned counsel for the appellant, Smt.Thushara<\/p>\n<p>      James for the Requisitioning Authority\/Kochi Refineries<\/p>\n<p>      Ltd. and Sri.Basant Balaji, the learned Senior<\/p>\n<p>      Government Pleader. Sri.Shaji would argue that the<\/p>\n<p>      court below should have awarded land value at<\/p>\n<p>      Rs.55,000\/- per Are. We cannot accept the above<\/p>\n<p>      argument. Ext.A1, as already indicated, was the only<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.934 of 2009             -3-<\/span><\/p>\n<p>      item of tangible evidence. Ext.A1 was relied on and<\/p>\n<p>      the maximum value which could have been granted<\/p>\n<p>      based on Ext.A1 is granted.\n<\/p>\n<\/p>\n<p>             3. But we find that there is an element of<\/p>\n<p>      genuineness in the grievance voiced by the appellant<\/p>\n<p>      regarding      the  compensation      awarded     for   the<\/p>\n<p>      structures. May be, the Advocate Commissioners<\/p>\n<p>      Report was not convincing. Even then, it is well known<\/p>\n<p>      that construction of buildings in accordance with PWD<\/p>\n<p>      schedule of rates is not a pragmatic proposition. We<\/p>\n<p>      feel that there is justification for granting at least 20%<\/p>\n<p>      increase on the building value taking into account the<\/p>\n<p>      ground realities. Accordingly, in modification of the<\/p>\n<p>      award of the Reference Court, we award a further<\/p>\n<p>      amount of Rs.26,160\/- towards value of structures.<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.934 of 2009           -4-<\/span><\/p>\n<p>             4. The appeal will stand allowed to the above<\/p>\n<p>      extent only. It is needless to mention that for the total<\/p>\n<p>      enhanced compensation to which the appellant<\/p>\n<p>      becomes eligible by virtue of this judgment he will be<\/p>\n<p>      entitled for statutory benefits admissible under law.<\/p>\n<p>      Parties are directed to suffer their costs.<\/p>\n<p>                                         PIUS C.
