\n    The petitioner in O.P.(MV)No.2059\/92 on the<\/p>\n
file  of  the  Motor  Accidents  Claims   Tribunal,<\/p>\n
Kottayam is the appellant.  He filed an application<\/p>\n
claiming a total compensation of Rs.1,50,000\/- on<\/p>\n
account of the injuries caused to him in a motor<\/p>\n
accident. The Tribunal, considering the evidence in<\/p>\n
the case, came to the conclusion that the case of<\/p>\n
the appellant that he sustained injuries in a motor<\/p>\n
accident,   as   alleged,   is   not   proved   and<\/p>\n
consequently dismissed the claim petition.    Hence<\/p>\n
this appeal.\n<\/p>\n
    2.  It is contended before us by the learned<\/p>\n
counsel for the appellant that the Tribunal should<\/p>\n
have, on a proper evaluation of the entire evidence<\/p>\n
in the case, found that the accident alleged is<\/p>\n
true and should have allowed compensation for the<\/p>\n

injuries sustained to the appellant.<\/p>\n
    3.    It is the case of the appellant\/petitioner<\/p>\n
that at about 1 p.m. on 16.7.1992, while he was<\/p>\n
riding his scooter bearing Reg.No.KEK 8004, an<\/p>\n
autorickshaw bearing Reg.No.KL-5\/A 4847, owned by<\/p>\n
the first respondent and driven by the second<\/p>\n
respondent,   knocked  him  down  and he   sustained<\/p>\n
injuries   and  became  unconscious;  that  he   was<\/p>\n
treated in the Medical College Hospital, Kottayam;<\/p>\n
that  the   accident  occurred  solely due  to   the<\/p>\n
negligence   of  the  second  respondent,  who   was<\/p>\n
driving the autorickshaw; that the third respondent<\/p>\n
is the insurer of the autorickshaw and that all the<\/p>\n
respondents    are  liable  for   the   compensation<\/p>\n
claimed.\n<\/p>\n
    4.     The third respondent resisted the claim<\/p>\n
contending that the allegation that the accident<\/p>\n
occurred when the autorickshaw hit the scooter is<\/p>\n
false and that the autorickshaw was not at all<\/p>\n
involved in the alleged incident.      They further<\/p>\n

contended    that  there  is  collusion  between  the<\/p>\n
appellant and respondents 1 and 2 in advancing the<\/p>\n
claim    as  against  them,  who  have  insured   the<\/p>\n
autorickshaw.    According to them, the incident took<\/p>\n
place when the scooter had a skid on the road while<\/p>\n
the appellant was riding the scooter under the<\/p>\n
influence of alcohol and then there was rain also.<\/p>\n
    5.     The appellant gave evidence as PW1 and he<\/p>\n
also examined PW2 to speak to the occurrence.<\/p>\n
According to PW1, the autorickshaw which came from<\/p>\n
the opposite side knocked him down while he was<\/p>\n
riding    the  scooter  and  immediately  he   became<\/p>\n
unconscious and regained consciousness only after<\/p>\n
eight days.     According to PW2, he witnessed the<\/p>\n
occurrence; that PW1 was riding the scooter at slow<\/p>\n
speed and the autorickshaw driven negligently by<\/p>\n
the second respondent was knocking down the scooter<\/p>\n
and PW1 was taken in the same autorickshaw to the<\/p>\n
Medical College Hospital.    However, he admitted in<\/p>\n
cross-examination that PW1 is his close friend.    He<\/p>\n

also   stated  that   his  house   is  situated   3=<\/p>\n
kilometres away from the place of incident and<\/p>\n
stated further that while he was returning after<\/p>\n
the  second   show,  he  happened  to  witness   the<\/p>\n
incident.   He  further  testified  that  after  the<\/p>\n
incident he went to the residence of PW1 and<\/p>\n
informed his wife about the incident on the same<\/p>\n
day,   namely  on  16.7.1992.  Crime  No.197\/92  was<\/p>\n
registered   by  the  police  in  relation  to   the<\/p>\n
occurrence at 5.30 p.m. on 16.7.1992 on the basis<\/p>\n
of the F.I. Statement given by the wife of PW1, the<\/p>\n
injured and that is Exhibit B2.   FIR registered on<\/p>\n
the basis thereof is Exhibit B4. On the side of the<\/p>\n
appellant those documents were being suppressed.<\/p>\n
    6. The F.I. Statement was recorded at the<\/p>\n
Medical College Hospital when the wife of the<\/p>\n
appellant   reached  there  on  getting  information<\/p>\n
about the accident.    Then she had no case in her<\/p>\n
statement that her husband sustained injuries when<\/p>\n
an autorickshaw hit against the scooter, which PW1<\/p>\n

was riding.    She also does not say that it was PW2<\/p>\n
who had taken her husband to the hospital.     These<\/p>\n
are material particulars which one would normally<\/p>\n
find in the F.I. Statement had those been facts to<\/p>\n
the knowledge of the wife of the injured.<\/p>\n
    7.     It is worthy to note that Exhibit B2 was<\/p>\n
recorded only at 4 p.m. and wife of the injured had<\/p>\n
sufficient opportunity also to enquire about the<\/p>\n
cause of the accident.    The Tribunal also observed<\/p>\n
that in Exhibit A5 wound certificate, the doctor<\/p>\n
has stated that the injured had the smell of<\/p>\n
alcohol. If at all it was PW2 who had taken the<\/p>\n
injured    to  the  hospital,  especially  when  the<\/p>\n
injured    is  his  close  friend,  he   would  have<\/p>\n
necessarily    disclosed as  to   how  the  incident<\/p>\n
occurred to the doctor as stated by him in court.<\/p>\n
On the other hand, Exhibit A5 showed that the<\/p>\n
injured was brought to the hospital by one Mathew,<\/p>\n
where as PW2 is Joseph. These aspects go a long way<\/p>\n
to belie the testimony of PW2.     The Tribunal also<\/p>\n

observed that in Exhibit A1 charge against the<\/p>\n
second respondent he pleaded guilty of the charge<\/p>\n
and fine was imposed on him and that it was a<\/p>\n
collusive   affair   between   the   claimant   and<\/p>\n
respondents 1 and 2.  Further, the evidence of PW1<\/p>\n
showed that the second respondent is a neighbour<\/p>\n
having residence adjacent to his wife’s house at<\/p>\n
Piravithanam.  In inspection of the autorickshaw by<\/p>\n
the Motor Vehicle Inspector, no damage could be<\/p>\n
found to the autorickshaw which is alleged to have<\/p>\n
collided with the scooter. Considering all the<\/p>\n
above aspects, the Tribunal came to the conclusion<\/p>\n
that the appellant\/petitioner sustained injuries by<\/p>\n
falling down from the scooter on his own and that<\/p>\n
the alleged involvement of an autorickshaw is a<\/p>\n
subsequently  cooked up   story, so   as  to  claim<\/p>\n
compensation from the third respondent. The reasons<\/p>\n
stated    by the Tribunal  to  dismiss  the   claim<\/p>\n
petition do not deserve to be upset so as to come<\/p>\n
to a different conclusion, in the circumstances<\/p>\n

discussed above.    We concur with the findings of<\/p>\n
the Tribunal that the accident alleged is not true<\/p>\n
and that there was no involvement of autorickshaw<\/p>\n
insured by the third respondent in the appellant\/<\/p>\n
petitioner   falling  down  from his   scooter  and<\/p>\n
sustaining injuries.\n<\/p>\n
     In the result, this appeal deserves only to be<\/p>\n
dismissed and it is, accordingly, dismissed.<\/p>\n
