Challenge  in  this  petition is to  the  order  dated<br \/>\n       04\/04\/2009 (Annexure P\/1) whereby the order dated 16\/04\/2008<br \/>\n       (Annexure P\/8) passed by the Sub Divisional Officer-cum-<br \/>\n       Competent Authority holding that the petitioner was guilty of<br \/>\n       embezzlement and as such he was declared disqualified to hold<br \/>\n       the post of Sarpanch, Gram Panchayat, Kumhari under the<br \/>\n       provisions of Section 40 of Chhattisgarh Panchayat Raj<br \/>\n       Adhiniyam, 1993 (for short &#8220;the Adhiniyam, 1993&#8221;), was<br \/>\n       affirmed  Further, the petitioner was declared disqualified<br \/>\n       for a period of six years\n<\/p>\n<p>2.   Shri Sharma, leaned counsel appearing for the petitioner<br \/>\nsubmits that the Director Panchayat has not considered the<br \/>\nfact that Sub-Divisional Officer-cum-Competent<br \/>\nAuthority\/respondent No3 has proceeded ex-parte against the<br \/>\npetitioner without affording an opportunity of hearing  He<br \/>\nfurther submits that it is clearly stated in the order dated<br \/>\n16\/07\/2008 (Annexure P\/8) that a notice dated 09\/04\/2008 was<br \/>\nissued to the petitioner by the registered post and the<br \/>\nregistered envelope came back with a remark that the<br \/>\npetitioner does not live in village-Kumhari He further<br \/>\nsubmits that Rule 3 of the Chhattisgarh Panchayat (Method of<br \/>\nService of Notice and Documents) Rules, 1995 (for short &#8220;the<br \/>\nRules, 1995&#8221;) clearly provides that if officer directing the<br \/>\nissue of such notice or document is satisfied that the<br \/>\naddressee is evading the notice or document and notice or<br \/>\ndocument cannot be served by the method mentioned as above<br \/>\nThe said officer shall cause such notice or document to be<br \/>\nserved by affixing a copy thereof upon some conspicuous part<br \/>\nof the last known place of residence or business of the<br \/>\nperson concerned and service shall be as effectual as if it<br \/>\nhad been made on the addresses personally\n<\/p>\n<p>3.   In the case on hand, admittedly no notice has been<br \/>\nposted on his residence or the office as last known place of<br \/>\nresidence or business Thus, finding of the respondent No3<br \/>\nthat the notice has been served and proceeded ex-parte<br \/>\nagainst the petitioner is vitiated  Thus, the order dated<br \/>\n16\/07\/2008 is bad and vitiated on the ground of being<br \/>\nviolative of basic principle of natural justice before<br \/>\ncondemning the petitioner\n<\/p>\n<p>4.   The Director in his order dated 04\/04\/2009 (impugned<br \/>\nherein) has not examined the abovestated facts and affirmed<br \/>\nthe finding on the basis of certain materials produced by<br \/>\nother people  The same is also vitiated accordingly\n<\/p>\n<p>5.   Shri Bhatia, learned State counsel submits that having<br \/>\nregard to the procedure as prescribed under the Rules 1995,<br \/>\nthe notice has to be served in accordance with provisions of<br \/>\nRule 3  It appears that the service has not been effected in<br \/>\naccordance with law and the matter has been proceeded ex-<br \/>\nparte  However, on the facts as narrated in the orders passed<br \/>\nby the authorities below, the petitioner does not deserve to<br \/>\ncontinue as Sarpanch of village-Kumhari\n<\/p>\n<p>6.   On hearing learned counsel appearing for the parties,<br \/>\nperusing the documents on record and without going into the<br \/>\nmerits of the case about sufficiency of material, for<br \/>\ndeclaring the petitioner disqualified under the provisions of<br \/>\nSection 40 of the Adhiniyam, 1993, it is held that the<br \/>\nmaterial\/documents have not been put to scrutiny and the<br \/>\npetitioner has not been afforded opportunity of hearing to<br \/>\nrebut or explain the same  The Competent Authority has<br \/>\nproceeded ex-parte in a manner which is not permissible under<br \/>\nthe provisions of law, if the petitioner was not available at<br \/>\na particular place  As per provisions of Rule 3, a notice<br \/>\nought to have been posted on a conspicuous part of last known<br \/>\nplace of residence or business, the same has not been done<br \/>\nThus, the order passed by the authority is vitiated and bad<br \/>\nThe Director Panchayat has also not examined the aspects when<br \/>\nthe same was raised before him in revision  It appears that<br \/>\nhe has affirmed the order passed ex-parte on the basis of<br \/>\ncertain facts, which were recorded in the order passed by the<br \/>\nCompetent Authority accepting the same as truth  Without<br \/>\naffording an opportunity of being heard to the petitioner,<br \/>\nthe order has been passed against the petitioner, by the<br \/>\ncompetent authority\n<\/p>\n<p>7.   It is well settled principles of law that &#8220;no one shall<br \/>\nbe condemned unheard&#8221; This is one of the clear cut cases<br \/>\nwhere the petitioner has been condemned without being heard\n<\/p>\n<p>8.   On the question of prejudice, since the petitioner has<br \/>\nbeen disqualified for a period of six years, prima facie, it<br \/>\nappears that the prejudice has been caused to him, as<br \/>\naccording to the petitioner, all the allegations made against<br \/>\nthe petitioner are untrue and needs clarification\/explanation<br \/>\nbefore passing the order by the Competent Authority\n<\/p>\n<p>9.   For the reasons mentioned hereinabove, the impugned<br \/>\norder dated 04\/04\/2009 (Annexure P\/1) and 16\/07\/2008<br \/>\n(Annexure P\/8) are quashed  However, on the request of<br \/>\nlearned counsel appearing for the respondent\/State, liberty<br \/>\nis reserved to the respondent authority to take appropriate<br \/>\nsteps, in accordance with law and pass the order accordingly\n<\/p>\n<p>10.
