Rule was issued by<br \/>\nthis Court on 11th May 2010 returnable today, viz. 29th<br \/>\nJune 2010.  The rule is served to respondents no.1 to 3 in all the<br \/>\nmatters.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Mr.Harshad K. Patel has instructions to appear for<br \/>\nrespondents no.1  and 3 in Civil Application No.5148 of 2010.<br \/>\nRespondent no.2, who is stated to be driver though served does not<br \/>\nappear. Heard learned advocate Mr.Maulik J. Shelat for the applicants<br \/>\nand Mr.Harshad K. Patel for opponents no.1 and 3 in CA No.5148 of<br \/>\n2000.  Rule is made absolute in CA No.5148 of 2000.  Interim order<br \/>\npassed by this Court in this Civil Application to operate till final<br \/>\ndisposal of the matter, subject to a modification to the effect that<br \/>\nthe amount shall be invested in a Cumulative Fixed Deposit Account of<br \/>\nany Nationalized Bank in the name of  respondent \/claimants initially<br \/>\nfor a period of three years  with periodical renewals<br \/>\ntill the appeal is finally decided by this Court.\n<\/p>\n<p>3.\tIn<br \/>\nCivil Applications No.5149 of 2010 and 5150 of 2010, though served<br \/>\nnobody appears for the respondents.   Heard learned advocate<br \/>\nMr.Maulik J. Shelat for the applicants. Rule is made absolute.<br \/>\nInterim order passed by this Court in this Civil Application to<br \/>\noperate till final disposal of the matter, subject to a modification<br \/>\nto the effect that the amount shall be invested in a Cumulative Fixed<br \/>\nDeposit Account of any Nationalized Bank in the name of  respondent<br \/>\n\/claimants initially for a period of three years  with<br \/>\nperiodical renewals till the appeal is finally decided by<br \/>\nthis Court.\n<\/p>\n<p>4.\tIn<br \/>\nall the these Civil Applications, though the amount is deposited in<br \/>\nthe name of the respondent\/ claimants, the Fixed Deposit Receipt<br \/>\nshall remain with the Nazir of the Claims Tribunal till the appeal is<br \/>\nfinally decided by this Court.\n<\/p>\n<p>(RAVI<br \/>\nR.
