M. SAHAI)<\/p>\n<p>\t\tThough<\/a><br \/>\nonly Civil Applications are listed today for hearing, with the<br \/>\nconsent of the parties, we have taken up the main appeals for final<br \/>\ndisposal.\n<\/p>\n<p>2.\t\tWe<br \/>\nhave heard Mr. B. Y. Mankad, learned counsel for the appellant and<br \/>\nMr. Mehul Shah, learned counsel appearing for the respondent.\n<\/p>\n<p>3.\t\tThese<br \/>\nLetters Patent Appeals have been filed by the appellant &#8211;<br \/>\noriginal petitioner challenging the judgment and order dated<br \/>\n21.03.2011 passed by the Learned Single Judge in Special Civil<br \/>\nApplication Nos.15422 to 15425 of 2010 whereby the Learned Single<br \/>\nJudge has issued the following directions :-\n<\/p>\n<p>\t&#8220;(1) The<br \/>\n\tpetitioner &#8211; Nagarpalika may file appropriate applications<br \/>\n\tunder Rule 26A of the Rules of 1966 before the Labour Court praying<br \/>\n\tfor setting aside the ex-parte order, within a period of fifteen<br \/>\n\tdays from the date of receipt of this order. It will also open for<br \/>\n\tthe petitioner &#8211; Nagarpalika to prefer appropriate<br \/>\n\tapplications under Rule 26B of the Rules of 1966 praying for stay of<br \/>\n\tthe operation of the ex-parte orders till the applications under<br \/>\n\tRule 26A of the Rules of 1966 are finally disposed of.\n<\/p>\n<p>\t(2) The Labour<br \/>\n\tCourt, on filing of such applications, shall decide the same in<br \/>\n\taccordance with law after giving opportunity of hearing to the<br \/>\n\trespondents-workmen, within a period of six weeks thereafter.\n<\/p>\n<p>\t(3) The Labour<br \/>\n\tCourt shall decide such applications which may be preferred by the<br \/>\n\tpetitioner &#8211; Nagarpalika without being influenced by the<br \/>\n\tpresent order as this Court has not expressed any opinion on the<br \/>\n\tmerits of the rival claims and contentions.&#8221;\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above directions, since the Learned Single Judge has only<br \/>\ndirected the appellant to file appropriate application for setting<br \/>\naside the ex-parte order before the Labour Court, we do not find to<br \/>\ninterfere in the order passed by the Learned Single Judge.  It is<br \/>\nopen for the appellant to raise all the grievances available under<br \/>\nthe law before the Labour Court and if such applications are filed by<br \/>\nthe appellant, the Labour Court shall decide the same in accordance<br \/>\nwith law.\n<\/p>\n<p>5.\t\tWith<br \/>\nthe aforesaid direction, all these Letters Patent Appeals stand<br \/>\ndisposed of.\n<\/p>\n<p>6.\t\tIn view of disposal of main<br \/>\nappeals, Civil Applications do not survive and they are accordingly<br \/>\ndisposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t[V.
