                 E.S.I         Corporation,             the         respondent            in<\/p>\n
I.C.31\/01,   is   challenging   the   order   passed   by   Employees’<\/p>\n
Insurance   Court,   Kollam   upholding   the   contentions   raised<\/p>\n
by   respondent        that   the   canteen   run   by   respondent<\/p>\n
hospital  is   not   covered   under   Section   2(12)   of   Employees<\/p>\n
State Insurance Act and hence respondent is not liable to<\/p>\n
comply  with the provisions of the Act.\n<\/p>\n
      2.    Learned   counsel   appearing   for   appellant     was<\/p>\n
heard.\n<\/p>\n
      3.    Hospital                  of         respondent               is              at\n\n\n\nThiruvananthapuram.   160   employees   were     working   in   the\n\n\n\n<\/pre>\n
hospital   apart   from   60   doctors.   Hospital   is   running   a<\/p>\n
canteen     within   the   same   premises   to   provide   boarding<\/p>\n
facilities   to   the   staff,   inpatients   and   employees   of<\/p>\n
hospital.   According   to   respondent   it   is   part   and   parcel<\/p>\n
of   the hospital and is not a separate unit and   canteen<\/p>\n
does   not   employ   more   than   ten   employees   and   therefore<\/p>\n

does   not   attract   coverage   provided   under   Section   2   (12)<\/p>\n
of   Employees   State   Insurance   Act.   Appellant   opposed   the<\/p>\n
application   contending   that     wage   register   produced   to<\/p>\n
Insurance   Inspector   shows   that   ten   employees   have   been<\/p>\n
employed         for   wages.   Insurance   Inspector   inspected<\/p>\n
canteen   in   July   2001   and   reported   that   electrically<\/p>\n
operated   devices   like   Grinder   and   Fridge   are   installed<\/p>\n
in   the   canteen.   It   was   contended   that   canteen   is<\/p>\n
qualified   for  coverage  as  a  factory  under  Section  2  (12)<\/p>\n
of the Act.\n<\/p>\n
      4.      Insurance   Court   on   evaluating   the   materials<\/p>\n
placed   before   it,   including   Ext.B1   report   filed   by     RW1<\/p>\n
found   that   evidence   of   RW1   establish   that   she   did   not<\/p>\n
make head  count   of employees  of the  canteen  and workers<\/p>\n
of   the   canteen     are   last   grade   workers   of   the   hospital<\/p>\n
and wages are   also paid from the hospital and there are<\/p>\n
no     separate   account   maintained     by   the   canteen.   It   was<\/p>\n
also   found  that  though  Fridge    and  Grinder  are  installed<\/p>\n
in   the   canteen,     electric   supply   was   from   the   hospital<\/p>\n
and   canteen   was   not   run   as   separate   unit.     In   such<\/p>\n
circumstances,   Insurance   court   held   that     canteen   does<\/p>\n
not   attract  coverage  as  provided  under  Section  2  (12)  of<\/p>\n
the Act.\n<\/p>\n
      5.      Argument   of   learned   counsel   appearing   for<\/p>\n

appellant   relying  on  the  decisions  of  Apex  court  in  RITZ<\/p>\n
Private Limited  &  others   v.   Shivaraman  &  another (1993<\/p>\n
(4)   SCC  364)   and   Christian   Medical   College   v.   Employees’<\/p>\n
State   Insurance   Corporation   (2001   (1)   SCC   256)  are   that<\/p>\n
though   canteen        is   part   of   hospital,   it   is   being<\/p>\n
separately   maintained   as   a   unit   and   satisfies   the<\/p>\n
definition of factory as provided under Section 2 (12) of<\/p>\n
Factories   Act   and   therefore   the   impugned   order   is<\/p>\n
unsustainable.   Facts   of   the   cases   relied   on   by   learned<\/p>\n
counsel   are   entirely   different.     In   both   the   cases,   on<\/p>\n
the   evidence   it   was   found   that   more   than   ten   persons<\/p>\n
were   employed   in   that   unit   which   were   separately<\/p>\n
functioning.   The   decisions   are   not   applicable   to   the<\/p>\n
facts of this case.\n<\/p>\n
      6.    Insurance   court   on   the   evidence   found   that<\/p>\n
canteen was not   run   as separate unit but was being run<\/p>\n
as part of hospital. It was also found that employees  of<\/p>\n
canteen   are  last  grade  employees  of  hospital  and  RW1  who<\/p>\n
submitted   Ext.B1   report   did   not   make   head   count   of<\/p>\n
employees   of   canteen   and   therefore   on   the   basis   of   the<\/p>\n
report it  cannot  be said that  canteen is  run  as separate<\/p>\n
unit.   More   over   the   Employees   Insurance   Court   found   that<\/p>\n
the   canteen   does   not   employ   ten   or   more   employees.   In<\/p>\n

such   circumstances.   Canteen   does   not   attract   coverage<\/p>\n
under   Section   2(12)   of   Employees   State   Insurance   Act.\n<\/p>\n
No   substantial   question   of   law     is   involved   in   the<\/p>\n
appeal.\n<\/p>\n
       Appeal is dismissed.\n<\/p>\n
