DAVE\n\t\t\n\t\n\n \n\nDate\n: 14\/11\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned Advocates for the parties.\n<\/p>\n<p>This<br \/>\n\tpetition under Article 226 of the Constitution of India is filed<br \/>\n\twith the following prayers :-\n<\/p>\n<p>\t&#8220;A) Directing the<br \/>\n\tRespondents to grant the retiral benefits like pension, gratuity,<br \/>\n\tleave encashment, etc. to the petitioner and to pay the arrears with<br \/>\n\t8% interest from 2.4.2007 till payment.\n<\/p>\n<p>\tB) During the pendency<br \/>\n\tand final disposal of this petition, the respondent No.1 may be<br \/>\n\tdirected to pay the amount of gratuity and leave encashment<br \/>\n\tforthwith.\n<\/p>\n<p>\tC) To grant such and<br \/>\n\tfurther relief as may be deemed fit and proper.&#8221;\n<\/p>\n<p>By<br \/>\n\tthis Writ Petition, the petitioner has claimed that he is entitled<br \/>\n\tto the amount of retiral benefits from 02.04.2007 and in support of<br \/>\n\this submissions, the petitioner has placed reliance on Rule 44(6) of<br \/>\n\tChapter VII of Gujarat Civil Service (Pension) Rules, 2002 and other<br \/>\n\tprovisions.  Upon issuance of Notice, and as directed in the oral<br \/>\n\torder dated 22.09.2011, the Registrar, District Court, Vadodara has<br \/>\n\tfiled affidavit-in-reply in which the competent authority namely the<br \/>\n\tlearned Principal District Judge, Vadodara has by an order dated<br \/>\n\t29.09.2011 substituted the penalty of dismissal with compulsory<br \/>\n\tretirement with effect from the date on which the order of dismissal<br \/>\n\tcame into force and further directed that the entries be made in the<br \/>\n\tService Book of the petitioner accordingly and the pension papers of<br \/>\n\tthe petitioner be prepared expeditiously.  Further, in the<br \/>\n\taffidavit-in-reply as filed above, it is made clear that pension to<br \/>\n\tbe paid will be subject to outcome of proposed departmental enquiry<br \/>\n\tincase permission is granted by the Government in accordance with<br \/>\n\tlaw.\n<\/p>\n<p>In<br \/>\n\tview of the above and what is stated in the affidavit-in-reply, in<br \/>\n\tno certain terms, now by an order dated 29.09.2011, the petitioner<br \/>\n\tstands compulsorily retired with effect from the date on which the<br \/>\n\torder of dismissal came into force and therefore, it is expected of<br \/>\n\tthe respondents to expedite preparation of pension papers of the<br \/>\n\tpetitioner as expeditiously as possible and act accordingly.\n<\/p>\n<p>With<br \/>\n\tthe aforesaid observation, this petition stands disposed of.
