Justice R.BASANT\n\n Dated :12\/09\/2007\n\n O R D E R\n                               R.BASANT, J\n                     = = = = = = = = = = = = =\n                          B.A.No. 5508 of 2007\n                    = = = = = = = = = = = = = =\n\n              Dated this the 12th day of September, 2007\n\n                                  ORDER\n<\/pre>\n<p>      Application for regular bail. Petitioners are accuses 5 to 9. (not 1<\/p>\n<p>to 5 as stated in the petition, submits the learned Public Prosecutor).<\/p>\n<p>They face allegations for offences punishable, inter alia, under<\/p>\n<p>Sec.307, 324 and 354 read with 149 IPC. Political animosity is the<\/p>\n<p>alleged motive. The petitioners trespassed into the house of the victim<\/p>\n<p>and attacked the victim. A woman in the house who interfered was<\/p>\n<p>assaulted also, it is alleged. The alleged incident took place on 8.7.07.<\/p>\n<p>The arrest was on 11.07.07 The petitioners continue in custody from<\/p>\n<p>11.07.07.\n<\/p>\n<p>      2.   The learned counsel for the petitioners prays, the learned<\/p>\n<p>Public Prosecutor does not oppose the said prayer and I am satisfied<\/p>\n<p>that the petitioners, who continue in custody from 11.07.2007, can<\/p>\n<p>now be enlarged on bail subject to appropriate conditions.<\/p>\n<p>       3. In the result, this application is allowed. The petitioners shall<\/p>\n<p>be released on bail on the following terms and conditions.<\/p>\n<p>      i) The petitioners shall execute bonds for Rs.1,00,000\/- (Rupees<\/p>\n<p>one lakh thousand only) each with two solvent sureties each for the<\/p>\n<p>like sum to the satisfaction of the learned Magistrate;<\/p>\n<p><span class=\"hidden_text\">B.A.No.5508 of 2007                 2<\/span><\/p>\n<p>         ii) The petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and 12<\/p>\n<p>noon on all Mondays and Fridays for a period of three months and<\/p>\n<p>thereafter as and when directed by the Investigating Officer in writing<\/p>\n<p>to do so.\n<\/p>\n<p>      iii) The petitioners shall not enter the jurisdiction of Mattannur<\/p>\n<p>Police Station during the said period of three months except for<\/p>\n<p>complying the condition No.ii above, without the prior permission of<\/p>\n<p>the learned Magistrate.\n<\/p>\n<\/p>\n<p>                                                  (R.BASANT, JUDGE)<br \/>\nsj<br \/>\n                             \/TRUE COPY\/<\/p>\n<p>                                                      P.A.TO JUDGE<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vipin Raj O. vs State on 12 September, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 5508 of 2007() 1.
