PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 19\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\t\tRULE.\n<\/p>\n<p>Learned APP waives service of notice of rule on behalf of<br \/>\nrespondent-State.\n<\/p>\n<p>1.\t\tLearned Counsel for<br \/>\nthe petitioner submitted that the petitioner has no criminal<br \/>\nantecedents.  The investigation is over and the charge-sheet is also<br \/>\nfiled.  He, further, pointed out that for the alleged incident of<br \/>\n22.01.2008, the complaint was lodged only on 26.03.2008.  He also<br \/>\ndrew my attention to the statement of the girl dated 17.09.2010,<br \/>\nwherein she has clearly pointed out that she had resided with the<br \/>\npetitioner as a wife and out of the said co-habitation she has also<br \/>\ngiven birth to a child.\n<\/p>\n<p>2.\t\tConsidering<br \/>\nthe above prima facie<br \/>\naspects of the matter and considering<br \/>\nthat the trial is unlikely to complete shortly and since<br \/>\ncharge-sheet<br \/>\nis also filed, I find<br \/>\nthis is a fit case for granting bail. Under the circumstances, the<br \/>\npetitioner is ordered to be released on bail in connection with C.R.<br \/>\nNO. I-27\/2008,<br \/>\nregistered with PETLAD<br \/>\nRURAL POLICE STATION,<br \/>\nDistrict : Anand, on his furnishing bond of Rs. 5,000\/-(Rupees Five<br \/>\nThousand), with one surety of the like amount to the satisfaction of<br \/>\nthe lower Court and subject to the conditions that, he shall:\n<\/p>\n<p>(1).\t\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>(2).\t\tnot act in a<br \/>\nmanner injurious to the interest of the prosecution;\n<\/p>\n<p>(3).\t\tmaintain law and<br \/>\norder;\n<\/p>\n<p>(4).\t\tmark his presence<br \/>\nbefore the concerned Police Station on every 1st and 15th<br \/>\nday of English Calendar month between 11:00 a.m. to 2:00 p.m.;\n<\/p>\n<p>(5).\t\tnot leave the<br \/>\nState of Gujarat without prior permission of the Sessions  Judge<br \/>\nconcerned;\n<\/p>\n<p>(6).\t\tfurnish the<br \/>\naddress of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>(7).\t\tsurrender his<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>3.\t\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>4.\t\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>5.\t\tRule<br \/>\nis made absolute.
