S.A.NO.712   OF  2005\n\n                              ------------------------------------------\n\n\n                               Dated     15th   March   2007\n\n\n\n\n                                        J U D G M E N T\n<\/pre>\n<p>                     Second appeal is filed challenging the concurrent<\/p>\n<p>decree   for   recovery   of   possession   of   plaint   schedule<\/p>\n<p>property   after   demolishing   the   structure   raised   therein<\/p>\n<p>from         the          possession         of         appellant.          Appellant         filed<\/p>\n<p>I.A.568\/07   to   dismiss   the   appeal   granting   six   months&#8217;   time<\/p>\n<p>to   demolish   and   surrender   vacant   possession   of   the   plaint<\/p>\n<p>schedule property. Learned counsel appearing for respondent<\/p>\n<p>argued  that  both    courts  have    granted  decree  and  there  is<\/p>\n<p>no   reason   to   grant   further   time   to   vacate.   On   hearing<\/p>\n<p>learned   counsel   appearing   for   appellant   and   respondent   it<\/p>\n<p>is only in the interest of justice to grant the time sought<\/p>\n<p>for by the appellant. I.A.568\/07 is allowed.\n<\/p>\n<p>                    R.S.A.712\/05   is   dismissed.   Appellant   is   granted<\/p>\n<p>six months&#8217; time from today to surrender vacant position of<\/p>\n<p>the   building   after   demolishing   the   structure   raised<\/p>\n<p>therein.
