dismissal is mcalled and both the matters are taken  _<\/p>\n

S.    in a mad accident on
\n25.10.2005. At”‘abgmt   claimant was waiting for the
\nb.u$&_at  101:3 stop, at that tixne, a BMTC bus<\/p>\n
bea;ing\u00ab0g.KgA.01{F\u00bb35s7 being driven by its ciriver in a rash<\/p>\n
 _ and   031100 and ran over the left leg of the
\n T*:VVe\u00a70imanf..””.4.s of which, she su\ufb01bxed \ufb01acture to the left
\n ggrievous injuries on other parts of the body. She<\/p>\n
V   to Nelamangala Hospital and {mm them she was<\/p>\n
   , _   to Victoria Hospital. Claimant was inpatient from
\nL”e’V\u00abA.\u00e90.i0.2005 to 2’?.1.2006. Claimant has examined the doctor as<\/p>\n
 PW2- the Orthopedic Surgeon attached to the Victoria Hospital.<\/p>\n
Considering the evidence, the Tribunal held that the claimant is<\/p>\n
entitled for compensation of Rs. 1.22.000] -.<\/p>\n
6. The Corporation has seriously ques\ufb01ggz\u00e9\u00e9i’ “-.2.<\/p>\n
involvement of the BMTC bus in the accident,  H<\/p>\n
of the Corporation is that, the bus was    <\/p>\n
am. to Nclamangala bus stop and the   7.:<\/p>\n
bus is involved in the said accident

\nbus stop at 1 1,.1o4"5.\u00a7\u00a7%, ff\ufb01e {$1-:&si.:io11 of the-bus being involved in\n<\/p>\n
  1._1__.45  Nclamagaia bus stop does not<\/p>\n
s\u00a7n~$ng\u00a7:us1y gave a. \ufb01nding that the sync bus is<\/p>\n
 :z”~\u00a3nvolVc:’i  mg  }.at\u00a7cident It is also contended that, the<\/p>\n
s. s[ss’s;;;sn;pensau\u00a2sV_;\u00a7warded by the Tribunal is on the higher side.<\/p>\n
    contra. Icamed counsel for the claimant submitted<\/p>\n
  ‘  , _  claimant has su\ufb01entd fracture of left kg in the accident
\n be disputed. as she was admitted to the Nclamangala<\/p>\n
hospital and fnom there she was admitted to the Victoria<\/p>\n
Hosgital. In the Wound certi\ufb01cate, discharge summary, there is<\/p>\n
reference to the road accident and also refers to the BNFFC hes.<\/p>\n
He relied on the evidence collected tinting the investigatioa’: ._’
\nby the poiice and submitted that, merely because  4′ .
\nthat he left the Nelamangala Bus Stop as   k V’
\nitself cannot be held that, the bus  11’\u00a7r_j_\u00e9te~  7′<\/p>\n
accident He also submitted that,  is<\/p>\n
highly inadequate, and no eompensatien. :i_.s– err:  head
\nof loss of futuxe earning and evezlg-\u00a7t\\=va1*ded on the<\/p>\n
other heads is not reas<)nah]g ,…–   '<\/p>\n

Txibunal onthe   the evidence on
\nreccrd. it is: V::_1ot  police has registered the
\ncase as per    very same day, mahazar is
\ndmym. m; mre ex.I52.zeeeet1;e%As\u00e91ctoria Hospital certi\ufb01cate. Ex.P3-<\/p>\n
  the involvement of the BIWPC bus in<\/p>\n
  the accent  on 26.10.2005. This is also reflected
\n izhe  Hospital showing that the injury was due to<\/p>\n

9. As far as is concerned. though the
\nTribunal   of Rs.50,000\/- towards
\n pthexi\\iv’isae,___ifvit is calculated at 15% of disability<\/p>\n
