SHAH\n\t\t\n\t\n\n \n\nDate\n: 22\/12\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tPresent<br \/>\nSpecial Criminal Application under Article 227 of the Constitution of<br \/>\nIndia read with Section 482 of the Code of Criminal Procedure has<br \/>\nbeen preferred by the petitioner &#8211; original complainant to<br \/>\nquash and set aside the impugned order dated 01\/11\/2010 passed by the<br \/>\nlearned JMFC, Borsad below application dated 01\/11\/2010, by which the<br \/>\nlearned Magistrate has rejected the said application submitted by the<br \/>\npetitioner to add offence under Section 307 of the Indian Penal Code<br \/>\nin complaint\/FIR being C.R. No.I-198\/2010 registered with Borsad Town<br \/>\nPolice Station.  In the alternative it is prayed to direct the<br \/>\nrespondents to ensure proper and effective investigation in<br \/>\nconnection with the FIR registered as C.R. No.I-198\/2010 with Borsad<br \/>\nTown Police Station after addition of the offence under Section 307<br \/>\nof the IPC.\n<\/p>\n<p>2.\tShri<br \/>\nHriday Buch, learned advocate appearing on behalf of the petitioner<br \/>\nhas vehemently submitted that infact looking to the injury and weapon<br \/>\nused on the vital part of the body of the victim, it is a clear case<br \/>\nof Section 307 of IPC and still the investigating officer has not<br \/>\naddedthe offence under Section 307 of the IPC against the accused<br \/>\npersons of complaint\/FIR being C.R. No.I-198\/2010.  It is submitted<br \/>\nthat looking to the medical\/injury certificate when an application<br \/>\nwas submitted to the learned Magistrate to add offence under Section<br \/>\n307 of IPC , the learned Magistrate ought to have granted the same.<br \/>\nIt is further submitted that even the concerned investigating officer<br \/>\nwas required to add offence under Section 307 of the IPC and is<br \/>\nrequired to investigate into the offence under Section 307 of the IPC<br \/>\nalso.\n<\/p>\n<p>3.\tHaving<br \/>\nheard learned advocates appearing on behalf of the respective parties<br \/>\nat length, it appears that a complaint being C.R. No.I-198\/2010 has<br \/>\nbeen lodged with the Borsad Town Police Station for the offences<br \/>\npunishable under Sections 143, 147, 148, 149, 324, 337, 504, 506(2)<br \/>\nof Indian Penal Code.  However, it is the case on behalf of the<br \/>\npetitioner &#8211; original complainant that infact looking to the<br \/>\ninjury and the weapon used, it is a case of Section 307 of IPC and<br \/>\ntherefore, an application was submitted before the learned Magistrate<br \/>\nto add the offence under Section 307 of the IPC, which is rightly<br \/>\nrejected by the learned JMFC at this stage.  Unless and until an<br \/>\nappropriate report is submitted by the concerned investigating<br \/>\nofficer, the learned Magistrate at this stage has no jurisdiction to<br \/>\npass any order to add a particular offence.  Hence, no illegality has<br \/>\nbeen committed by the learned Magistrate in dismissing the said<br \/>\napplication at this stage.  However, on investigation it is always<br \/>\nopen for the investigating officer and having been satisfied that<br \/>\nduring the investigation, it is found that an offence punishable<br \/>\nunder Section 307 of IPC also is committed, in that case, it is<br \/>\nalways open for the concerned investigating officer to add the<br \/>\noffence under Section 307 of the IPC and make a report to the<br \/>\nconcerned learned Magistrate which will form part of the FIR.<br \/>\nHowever, it is for the concerned investigating officer to make such a<br \/>\nreport.\n<\/p>\n<p>\tConsidering<br \/>\nthe above, Shri Hriday Buch, learned advocate appearing on behalf of<br \/>\nthe petitioner has submitted that in that case petitioner will<br \/>\napproach the concerned investigating officer\/DSP requesting to add<br \/>\nthe offence under Section 307 of the IPC and therefore, it is<br \/>\nrequested to make suitable observation.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, present Special Criminal Application is disposed<br \/>\nof permitting the petitioner to submit an appropriate<br \/>\nrepresentation\/application before the concerned investigating officer<br \/>\nas well as to DSP, Anand requesting to add offence under Section 307<br \/>\nand as and when such an application is made, the same may be<br \/>\nconsidered by concerned investigating officer and DSP in accordance<br \/>\nwith law and on merits and if the investigating officer is satisfied,<br \/>\nin that case, he may submit appropriate report to the concerned<br \/>\nMagistrate for adding offence which can be considered as part of the<br \/>\nFIR and the concerned investigating officer to inquire into the same<br \/>\nin accordance with law and on merits.  However, the said exercise is<br \/>\nto be completed at the earliest.  However, it is made clear that this<br \/>\nCourt has not expressed any opinion on merits with respect to the<br \/>\nsame and an appropriate case being made out and if the concerned<br \/>\ninvestigating officer\/DSP is satisfied prima facie<br \/>\nthat a case under Section 307<br \/>\nof the IPC is made out, it will be open for them to add the said<br \/>\noffence which can be considered as part of the FIR and the concerned<br \/>\ninvestigating officer to inquire into the same in accordance with law<br \/>\nand on merits.\n<\/p>\n<p>5.\tWith<br \/>\nthis, present Special Criminal Application is disposed of.
