The Assistant Engineer, Road Construction Department,Bhojpur At Arrah\n\n                                          ----------------------------------\n<\/pre>\n<p>02\/   04.11.2011                    In the instant writ application, the grievance of the<\/p>\n<p>                        petitioner is that the respondents have marked the temple for its<\/p>\n<p>                        demolition on assumption that it has been constructed on public<\/p>\n<p>                        land.\n<\/p>\n<p>                                    The petitioner submits that the temple stands on<\/p>\n<p>                        khesra No. 3194, 3195 and 3197 measuring 13 decimals, which<\/p>\n<p>                        belongs to the temple itself. The petitioner further submits that<\/p>\n<p>                        the villagers donated 6 acres and 8 decimals land in the name of<\/p>\n<p>                        temple, which was constructed way back in the year, 1995. The<\/p>\n<p>                        petitioner asserts that temple has not been constructed on public<\/p>\n<p>                        land. In support of his submission, the petitioner has referred to<\/p>\n<p>                        certain agreements and rent receipts.\n<\/p>\n<p>                                    Counsel for the State submits that petitioner should<\/p>\n<p>                        have made representation before the authority concerned instead<\/p>\n<p>                        of moving this Court.\n<\/p>\n<p>                                    After hearing the counsel for the petitioner and the<\/p>\n<p>                        State, I am of the view that the petitioner should file a detailed<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>       representation before District Magistrate, Bhojpur at Ara, who<\/p>\n<p>       will ascertain the facts whether the temple stands on the land<\/p>\n<p>       donated by the villagers or whether it has been constructed on<\/p>\n<p>       public land. The petitioner must file his representation before<\/p>\n<p>       District Magistrate, Bhojpur at Ara within three weeks from<\/p>\n<p>       today, thereafter, the learned District Magistrate has the<\/p>\n<p>       verification done within further six weeks.<\/p>\n<p>                   Status quo as of today would be maintained, till the<\/p>\n<p>       verification is completed.\n<\/p>\n<p>                   This application stands disposed of.\n<\/p>\n<\/p>\n<p>                                (Samarendra Pratap Singh, J.)<br \/>\nDKS\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
