SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>O R D E R<br \/>\nCIVIL APPEAL NO.  4200 OF 2007<br \/>\n[ Arising out of SLP [C] No.5549 of 2006 ]<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tThis appeal by special leave is filed against the<br \/>\njudgment and decree dated 12th January, 2006 passed by the<br \/>\nPunjab and Haryana High Court at Chandigarh in Regular<br \/>\nSecond appeal No. 1735 of 2005 whereby the High Court had<br \/>\ndismissed the regular second appeal filed by M.D. University,<br \/>\nRohtak  appellant herein &#8211; and affirmed the judgment of the<br \/>\nAppellate Court against which the said second appeal was<br \/>\nfiled by the appellant.\n<\/p>\n<p>3.\tThe facts giving rise to this appeal may briefly be<br \/>\nstated as under.\n<\/p>\n<p>4.\tA suit was filed by Ajit Singh Nandal for declaration<br \/>\nand mandatory injunction claiming that the notification dated<br \/>\n29th July, 1997 by which the post held by him was declared<br \/>\nvacant with effect from    15th January, 1996 was illegal and<br \/>\nnull and void. On contest, the suit was dismissed by the trial<br \/>\ncourt and an appeal preferred by the respondent-  Ajit Singh<br \/>\nNandal- before the appellate court was allowed, inter alia, on<br \/>\nthe findings that Ajit Singh Nandal was permitted to resume<br \/>\nhis duty on 11th October 1996 by the Registrar of M.D.<br \/>\nUniversity without imposing any condition, namely,<br \/>\nrequirement as to taking prior sanction of the Vice Chancellor,<br \/>\nM.D. University and as the declaration of the post held by Ajit<br \/>\nSingh Nandal as vacant amounted to his removal from service<br \/>\nand also that since no enquiry in compliance with Clause 2(B)<br \/>\nof Part II of the Rules was held, the imposition of the aforesaid<br \/>\nmajor penalty could not be sustained. On the aforesaid<br \/>\nfindings the regular second appeal filed by M.D. University,<br \/>\nRohtak before the High Court was dismissed by the impugned<br \/>\njudgment. This appeal in respect of which leave has already<br \/>\nbeen granted has arisen from the aforesaid judgment of the<br \/>\nHigh Court dismissing the regular second appeal.\n<\/p>\n<p>5.\tHaving heard the learned counsel for the parties and<br \/>\nafter considering the materials on record, we do not find any<br \/>\nreason to entertain this appeal as the appellant has failed to<br \/>\nsatisfy us that the grounds on which the regular second<br \/>\nappeal was dismissed could at all be said to be non<br \/>\nsustainable. Accordingly, we dismiss the appeal and affirm the<br \/>\njudgment of the High Court passed in the second appeal.<br \/>\nThere will be no order as to costs.
