3    17.1.2011            Heard learned counsel for the parties.<\/p>\n
                            Killing of informant’s son is reported<\/p>\n
                 to the Police suspecting co-accused Sanjay Kumar<\/p>\n
                 Choudhary.       Petitioner’s    name     appeared     in   the<\/p>\n
                 case after six months of the incident when some<\/p>\n
                 of the witnesses examined in paragraphs 42 to 49<\/p>\n
                 of the case diary is doubted on the ground that<\/p>\n
                 informant’s wife and his daughter-in-law (wife<\/p>\n
                 of the deceased) are naming co-accused Sanjay<\/p>\n
                 Kumar Choudhary and two unknown persons. Here<\/p>\n
                 the role of I.O. appears suspicious as both are<\/p>\n
                 examined only after examination of witnesses of<\/p>\n
                 paragraphs 42 to 49. There may be reason for<\/p>\n
                 delayed     examination     of    witnesses      not    family<\/p>\n
                 members but once family member is examined at<\/p>\n
                 belated stage that only doubts the act of the<\/p>\n
                 I.O., that is to favour any of the accused. It<\/p>\n
                 is   not   the    stage   to    doubt    the   statement        of<\/p>\n
                 witnesses     not    from      family     members      of   the<\/p>\n
                 informant.\n<\/p>\n
                            Hence, prayer for anticipatory bail on<\/p>\n
                 behalf of petitioner is rejected.<\/p>\n
