RAMACHANDRAN NAIR, J.\n               ---------------------------------------\n                   W.P.(C) No.10501 OF 2008\n               ---------------------------------------\n            Dated this the 22nd day of October, 2009.\n\n\n                         J U D G M E N T\n<\/pre>\n<p>      It is submitted that in the light of the judgment rendered by<\/p>\n<p>this Court in W.P.(C) No.28363 of 2007, a similar direction can<\/p>\n<p>be issued in this case also.\n<\/p>\n<p>      2. The petitioners herein are working as Peons, Sanitation<\/p>\n<p>Workers and Sweeper under the 4th respondent-Management.<\/p>\n<p>The advertisement to fill up the posts was published as per<\/p>\n<p>Exhibit P1 by the Management. The Management prepared the<\/p>\n<p>list of eligible candidates for being appointed, and all the<\/p>\n<p>petitioners except petitioners 5 and 7 were appointed in the<\/p>\n<p>colleges coming under the University of Kerala and the others<\/p>\n<p>were appointed in the colleges coming under the Calicut<\/p>\n<p>University. The petitioners are aggrieved by Exhibit P9 whereby<\/p>\n<p>the Government took the view that the petitioners cannot claim<\/p>\n<p>salary for their appointment during the ban period.<\/p>\n<p>      3. In W.P.(C) No.28363 of 2007, this Court considered the<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.10501\/2008                       2<\/span><\/p>\n<p>question in the light of the directions issued by this Court in<\/p>\n<p>O.P.No.21268\/2002 and connected cases. The findings contained<\/p>\n<p>in paragraph 10 are extracted below:\n<\/p>\n<p>                     &#8220;In    the     context     of   the   refusal    of    the<\/p>\n<p>              Government to approve the appointments made to<\/p>\n<p>              teaching posts in view of the ban imposed on<\/p>\n<p>              appointments          by    virtue    of   executive      orders<\/p>\n<p>              subsequent        to    expiry     of  the    statutory     ban,<\/p>\n<p>              O.P. No.21268\/2002 and connected cases were filed<\/p>\n<p>              before this Court.           Those original petitions were<\/p>\n<p>              disposed of by judgment dated 26\/03\/2002, where<\/p>\n<p>              dealing with the validity of the ban imposed by<\/p>\n<p>              executive orders, this Court held as follows:-<\/p>\n<blockquote><p>                    &#8220;13.   It is trite law that no executive order or circular<br \/>\n                    issued by the Government can override the statutory<br \/>\n                    provisions. As per the provisions of the MG University<br \/>\n                    Act and the Statutes made thereunder, the private<br \/>\n                    college managements are competent to appoint<br \/>\n                    teachers having the prescribed qualifications in the<br \/>\n                    vacancies of teaching posts permissible, in accordance<br \/>\n                    with the workload prescribed by the ordinance. The<br \/>\n                    appointments so made are liable to be approved by<br \/>\n                    the University in accordance with law.          (See the<br \/>\n                    decision of this Court in <a href=\"\/doc\/1487672\/\">Cherian Mathew v. Principal,<br \/>\n                    S.B.College, Changanacherry<\/a> &#8211; 1998(2) KLT 144). The<br \/>\n                    power of the University in this regard is a power<br \/>\n                    coupled with a duty to act when circumstances<br \/>\n                    warranting exercise of that power are shown to exist<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.10501\/2008                     3<\/span><\/p>\n<p>                    and a person interested makes an application for<br \/>\n                    exercising it. After the statutory ban created under<br \/>\n                    Section 5 of Ext.P3 Act is over, there is no ban in the<br \/>\n                    eye of law against making fresh appointments to<br \/>\n                    teaching posts or against approving them.          Any<br \/>\n                    executive order or circular issued by the Government<br \/>\n                    banning appointments or their approval are invalid. It<br \/>\n                    is declared so.    Therefore, this Original Petition is<br \/>\n                    disposed of with the following directions:\n<\/p><\/blockquote>\n<blockquote><p>                           14.    The University shall fix the strength of<br \/>\n                    teaching staff in the colleges of the petitioners from<br \/>\n                    the academic year 2000-2001 onwards.        Of course,<br \/>\n                    this can be done taking into account the revised work<br \/>\n                    load of teachers of 16 periods a week.           If the<br \/>\n                    appointments are made by the managements in the<br \/>\n                    posts permissible in accordance with the staff strength<br \/>\n                    so fixed, the approval of appointments of the<br \/>\n                    incumbents shall be considered by the University in<br \/>\n                    accordance with law.      If the appointments are in<br \/>\n                    accordance with the provisions of the Statutes and<br \/>\n                    Ordinance, they shall be approved ignoring the orders<br \/>\n                    or circulars issued by the Government banning<br \/>\n                    appointments and their approval. The University shall<br \/>\n                    complete the exercise within four months from the<br \/>\n                    date of receipt of a copy of this judgment. In the case<br \/>\n                    of the appointments duly approved by the University,<br \/>\n                    the concerned Deputy Director shall release the salary<br \/>\n                    due to the incumbents in accordance with law without<br \/>\n                    any further delay.&#8221;\n<\/p><\/blockquote>\n<p>              In this case also, since the Managements are entitled<\/p>\n<p>              to make appointments in terms of the staff pattern<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.10501\/2008                  4<\/span><\/p>\n<p>              approved by the respondents, the executive orders<\/p>\n<p>              banning appointments to such posts can have no<\/p>\n<p>              force. In my view, reasoning adopted by the learned<\/p>\n<p>              Judge in the aforesaid judgment is applicable to the<\/p>\n<p>              facts of this case well&#8221;.\n<\/p>\n<p>       4. In paragraphs 11 and 12 the following directions were<\/p>\n<p>issued:\n<\/p>\n<blockquote><p>                     &#8220;If so, it is for the respondents to consider<\/p>\n<p>              whether the appointments in question were made to<\/p>\n<p>              posts available in terms of the approved staff<\/p>\n<p>              pattern, and on such examination, the finding is that<\/p>\n<p>              the posts were available, the Government cannot<\/p>\n<p>              avoid its responsibility to pay salary to the<\/p>\n<p>              appointees.\n<\/p><\/blockquote>\n<blockquote><p>                     Therefore, these writ petitions are disposed of<\/p>\n<p>              directing the respondents to examine whether the<\/p>\n<p>              posts, against which appointments were made, were<\/p>\n<p>              available in terms of the approved staff pattern. If<\/p>\n<p>              the finding is that appointments were to such posts,<\/p>\n<p>              the respondents shall complete formalities and pay<\/p>\n<p>              salary to the petitioners for the period from October,<\/p>\n<p>              2002 to 27\/07\/2005&#8243;.<\/p><\/blockquote>\n<p>       Since the petitioners are also similarly placed, I am of the<\/p>\n<p>view that a similar direction can be issued in their case also.<\/p>\n<p>Therefore, Exhibit P9 is quashed. The respondents are directed<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.10501\/2008               5<\/span><\/p>\n<p>to examine whether the posts against which the appointments<\/p>\n<p>were made were available in terms of the approved staff pattern.<\/p>\n<p>If the finding is that the appointments were made to such posts,<\/p>\n<p>the respondents shall complete formalities and pay salary to the<\/p>\n<p>petitioners for the respective periods (from 06.10.2002 to<\/p>\n<p>27.07.2005). Appropriate orders shall be passed within a period<\/p>\n<p>of three months from the date of receipt of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<p>       This writ petition is disposed of as above.<\/p>\n<p>                                   T.R.
