DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/04\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\nApplication under section 482 of the Code of Criminal Procedure, 1973<br \/>\nis filed by the petitioner, a serving  personnel in the Armed Forces<br \/>\nof the rank of Colonel challenging FIR dated 16.4.2010 filed at<br \/>\nSanand police station in Prohibition Case No.177\/2010  for the<br \/>\nalleged offences  under sections 65(a), 66(1), 116-B, 81, 83, 75-A,<br \/>\n85(1) c, 86 and 110 and 117 of the Bombay Prohibition Act on the<br \/>\nground that the FIR impugned does not contain any allegations of<br \/>\ncommission of crime against the applicant.\n<\/p>\n<p>2.\t\tMr<br \/>\nN K Majmudar, learned Advocate for the applicant submits that the<br \/>\napplicant is wrongly arraigned as accused No.1 who is a Defence<br \/>\nPersonnel  and when he was on a visit to a place belonging to his<br \/>\nfriend,  police personnel of Sanand police station raided the Club<br \/>\nHouse pursuant to information received and, therefore,  he was<br \/>\narrested  and FIR is lodged.  It is further submitted that there is<br \/>\nno material against the applicant and the allegations are to the<br \/>\nextent that one liquor  bottle of foreign brand, sealed Beer tins 11<br \/>\nin numbers and other such items were recovered.  It is further<br \/>\nsubmitted that such recovery against other accused will not  lead or<br \/>\nconnect the present applicant with the crime.  It is further<br \/>\nsubmitted that the petitioner being a Defence Officer, is entitled to<br \/>\nhave his quota of foreign liquor, cannot be brought within the<br \/>\npurview of provisions of Bombay Prohibition Act.  The learned<br \/>\nAdvocate  also referred to section 39 of the Prohibition Act and<br \/>\ndefinition of section 2 (12)  i.e.  &#8220;to drink&#8221; and<br \/>\nsubmitted that admittedly the petitioner was not found drunk and,<br \/>\ntherefore, invocation of various provisions of Prohibition Act<br \/>\nagainst the applicant is illegal and the impugned FIR deserves to be<br \/>\nquashed and set aside.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAPP for the respondent-State submits that the case is at the stage of<br \/>\nfiling of FIR  and details about the alleged incident is under<br \/>\ninvestigation.  According to the learned APP, this is not a case<br \/>\nwhere a person consuming liquor\/alcohol prohibited by virtue of<br \/>\noperation of the  Bombay Prohibition Act is arrested at private place<br \/>\nbut there were about 29 accused who had gathered to enjoy a drink<br \/>\nparty accompanied by women bar dancers brought from places like<br \/>\nBombay and Surat and recovery panchnama reveals that the present<br \/>\napplicant was in company of those persons  with prohibited items and<br \/>\npanchas have found them in drunken condition.  It is further<br \/>\nsubmitted that FSL report is yet to be obtained and on completion of<br \/>\ninvestigation appropriate report will be filed and, therefore, at<br \/>\nthis stage, interference in exercise of powers  under section 482 of<br \/>\nthe Criminal Procedure Code is not warranted.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard the learned Advocate for the applicant and the learned APP and<br \/>\nin the facts and circumstances of the case, perusal of the FIR  and<br \/>\nprovisions of section 39 of the  Bombay Prohibition Act, I am of the<br \/>\nopinion that at this stage,  no case is made out for  this court to<br \/>\nexercise  power under section 482 of the Code inasmuch as the<br \/>\naverments made in the FIR reveal involvement of the applicant in<br \/>\ncommission of the crime for the offences  under sections 65(a),<br \/>\n66(1), 116-B, 81, 83, 75-A, 85(1) c, 86 and 110 and 117 of the Bombay<br \/>\nProhibition Act.  Not only that but the applicant being an Officer of<br \/>\nthe rank of Colonel with Indian Army,  prima facie, is found to have<br \/>\ncommitted alleged crimes  in the company of number of persons who<br \/>\nhave gathered to enjoy drink party and sleaze dance in  contravention<br \/>\nof provisions of the Bombay Prohibition Act and recovery  panchnama<br \/>\nprima facile reveals prohibited items of bottle of liquor, alcohol<br \/>\netc.  So far as section 39 is concerned, it is pertinent to note<br \/>\nthat permission to use or consume foreign liquor on warships<br \/>\ntroopships and in messes and canteens of Armed Forces, the State<br \/>\nGovernment is empowered to specify by general or special order that<br \/>\nmembers of  the Armed Forces  in messes and canteens of the Armed<br \/>\nForces can consume liquor.  Admittedly  the place of offence was a<br \/>\nprivate club house and, therefore, it is not covered under the<br \/>\ndefinition of section 39 of the Prohibition Act.\n<\/p>\n<p>4.\t\tConsidering<br \/>\nthe fact that the  investigation  is yet to be completed  against  29<br \/>\naccused and their statements are yet to be recorded,  and  at the end<br \/>\nof  investigation, report will have to be submitted before the<br \/>\ncompetent court,  at this stage, this  court will not embark upon an<br \/>\nenquiry to ascertain the truthfulness or otherwise of the allegations<br \/>\nin exercise of powers under section 482 of the Code  of Criminal<br \/>\nProcedure .\n<\/p>\n<p>\t\tNo<br \/>\ncase is made out,<br \/>\nthis application is rejected.\n<\/p>\n<p>\t\t\t\t\t\t\t[ANANT<br \/>\nS.
